C.4 EXISTING DEFICIENCY INSPECTION AND REPORT

The Contractor shall be allowed to perform and submit an existing deficiency list (EDL) inspection and submit a report within 60 days after the beginning of the contract period. The report is meant to identify and document all equipment deficiencies (with the exception of Vertical Transportation Equipment) , as well as the cost for correcting each deficiency, that exist in the equipment and system covered by this performance work statement, at time the Contractor begins work covered by this Contract. All EDL reports must contain pricing for correcting each deficiency. The Contractor will not be responsible for applying the Repair deductible to items listed on the approved Existing Deficiency List report.

C.4.1 Existing Deficiency List Report If the Contractor intends to submit a report, the CO and the COR must be informed prior to the inspection occurring, and be given the opportunity to be present during the inspection. No items may be added to the report without the CO or designee present during the inspection unless written authorization to proceed is provided by the CO or designee.

The Existing Deficiency List report shall only include items that can be specifically identified as needing an immediate repair. The report shall not contain entire systems, or potential deficiencies that will, or should be, replaced or repaired at a future date; the report shall not contain items that will be adjusted during the performance of normal preventive or predictive maintenance. The report shall not include building or system design issues that the Contractor may consider substandard, or show some deterioration due to age, i.e. system “outdated” or system “worn throughout” are not acceptable list items. Code violations may be included in the list.

The report must be submitted to the CO and on-site designee and be approved by both, in writing, prior to being added to the Contract’s documentation. The Government may elect to have all, or any part of this work, performed by the Contractor (at the price or prices quoted), by Government employees, or by other Contractors. Any dispute between the Government and the Contractor as to classification of existing deficiency list report items will be resolved under the Disputes Clause in this document. Items requiring an engineering study may be presented beyond the time period with approval of the COR, however they must receive approval from the CO before being considered part of the Contract’s EDL.

C.4.2 Pricing The report should include the Contractor's itemized price (including, but not limited to, labor, subcontracting costs, coefficient, materials, overhead, and profit) for correcting each deficiency.

The Contractor’s itemized estimates for correcting each deficiency shall remain in effect for 120 days after submission of the initial deficiency list report.

C.4.3 Deficiency Status Deficiencies discovered after the submission of the Existing Deficiency List report will not be considered pre-existing for purposes of this Contract, unless equipment is operational and could not be secured and inspected during the list inspection. Any piece of equipment or system that cannot be inspected shall be highlighted at the beginning of the deficiency list stating why it cannot be secured and inspected. An estimate of when the Contractor reasonably expects to be able to inspect the piece of equipment shall be provided.
