About this file
This justification document supports a firm-fixed-price construction contract award for a Radiology Expansion project at the Northern Arizona VA Health Care System in Prescott, Arizona. The project scope involves demolishing an existing laboratory expansion and constructing a new optimized footprint for the radiology department with a centralized waiting room, wide hallways, and sufficiently sized rooms. The justification is for awarding one brand-name component for direct digital HVAC controls to Delta Controls due to standardization across the facility. The construction magnitude is between $5 million and $10 million. The solicitation will be issued as an Invitation for Bid and advertised as a Service-Disabled Veteran-Owned Small Business set-aside, with bids due on the date specified. The period of performance is approximately 425 calendar days from notice to proceed.

For Other Than Full and Open Competition
1. Contracting Activity:
Veterans Health Administration (VHA), Program Contracting Activity Central (PCAC)
The proposed procurement, Invitation For Bid (IFB) 36E77619B0012 is for the Radiology Expansion (Construction) project at the Northern Arizona VA Health Care System (NAVAHCS), Prescott, AZ.
2. Nature and/or Description of the Action Being Processed:
This justification is to support the Radiology Expansion (Construction) project at the Northern Arizona VA Health Care System (NAVAHCS) that will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of certain construction materials. The use of a particular brand name for the item listed below accommodates standardization of this item throughout the facility.
The individual brand name item identified is as follows:
A. Direct Digital Controls for HVAC
i. Delta Controls
3. Description of Supp :
This procurement is to construct the Radiology Expansion (Construction) project at the Northern Arizona VA Health Care System (NAVAHCS). The scope includes everything necessary to construct a functional building that meets the requirements of the Department of Veterans Affairs. There is one
(1) brand name item listed for which the VA is not able to accept equal or alternate items. The value of this item is listed below and the VAAR Construction magnitude for the entire project is between $5,000,000.00 and $10,000,000.00.
The individual brand name item identified is as follows:
A. Direct Digital Controls for HVAC
i. Delta Controls
ii. Value:
iii. Description: The direct-digital control system(s) shall be native BACnet. All new workstations, controllers, devices and components shall be listed by BACnet Testing Laboratories. All new workstations, controller, devices and components shall be accessible using a Web browser interface and shall communicate exclusively using the ASHRAE Standard135 BACnet communications protocol without the use of gateways, unless otherwise allowed by this Section of the technical specifications, specifically shown on the design drawings and specifically requested otherwise by the VA.
4. Statutory Authority Permitting Other than Full and Open Competition:
(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 41 USC §253(c)(1) ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;

( ) (6) National Security per FAR 6.302-6;
( ) (7) Public Interest per FAR 6.302-7;
5.
the Use of the Authority Cited Above (applicability of authority):
This item has been standardized throughout the Northern Arizona VA Health Care System (NAVAHCS). Installing a different manufacturer system will create significant duplication in cost for the facility, and in most cases the equipment will not function properly. The specific impact for not using the brand name item is listed below:
A. Direct Digital Controls for HVAC
i. Delta Controls
ii. Impact: In previous projects at the NAVAHCS, native BACNet system obtained until contracts were able to be finalized with Delta Controls. Delta Controls has installed a true BACNet system that does not require any gateways to convert from proprietary control language to BACNet prior to communicating with the main workstation, since the programming is strictly BACNet. Delta Controls continues to integrate the current system to meet the VA requirements for non-proprietary BACNet controls. The use of Delta Controls will be more efficient to the Government.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the component listed above is identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) Set-Aside. This Justification for Other Than Full and Open Competition will be posted to Federal Business Opportunities with the solicitation.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:
The Government estimate was prepared and provided by the design Architect- Engineer (A-E), Spur Design. The anticipated price to the Government for the item requested to be brand name is approximately
The item for which brand name approval is being requested is a subsequent component to the overall construction project. This procurement will be competed and based on competition; the CO will make a determination of fair and reasonable pricing prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted:
The market research for the equipment was conducted and prepared by the A-E and shared with the CO for further review. The CO was in concurrence with information provided in the estimate that supported the brand name item. Approval of the item as brand name only is critical for the overall efficiency of the completed project and the Northern Arizona VA Health Care System (NAVAHCS) facility as a whole.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
NAVAHCS is in the final stages of completing a $2.7M comprehensive campus wide Building Automation System for controlling the HVAC systems in 12 buildings, including building 107 where the new radiology suites are being added on. This new BAS utilizes the Delta Controls system. The new component must be able to tie into this existing and operational system including the use of software. At this time, there are no competing vendors whose product is fully compatible with the existing system being used at Northern Arizona VA Health Care System (NAVAHCS).
