About this file

This is a Trade Secret/Confidential Proprietary Information Notice form for the Commonwealth of Pennsylvania related to a Professional Broadcast, Audio Visual & Multi-Media Equipment and related services contract opportunity. The form serves as a template for third parties submitting materials to the Commonwealth to designate information they believe is exempt from public disclosure under Pennsylvania's Right-to-Know Law. The document requires submitting parties to provide their name and contact information, describe the materials being submitted, explain the purpose of submission, and identify any portions containing trade secrets, confidential proprietary information, or data that could jeopardize safety or security if disclosed.

The form establishes that submitting parties bear full responsibility for ensuring all statements and assertions are legally defensible and accurate, and that the Commonwealth will not provide legal advice regarding Right-to-Know exemptions. Notably, the form specifies that certain information will not be considered exempt without substantial justification, including vendor cost responses, technical responses that do not implicate safety and security, publicly available information, and details regarding product names, quantities, and prices purchased by the Commonwealth. The submitting party must acknowledge that the Commonwealth is not liable for disclosure of unmarked or unexplained materials, agrees to defend any release actions, and indemnifies the Commonwealth against related costs and judgments. The form also notes that the Commonwealth may reject exemption claims if the burden of proof is not met, and that any non-protected portions of materials will become public while only protected information remains nonpublic.
