Work, reasonable safeguards for safety and protection, including posting danger signs and other warnings against hazards, promulgating safety regulations and notifying owners and users of adjacent sites and utilities.

24.6 When use or storage of explosives or other hazardous materials or equipment or unusual methods are necessary for execution of the Work, the Contractor shall exercise the utmost care and carry on such activities under the direct supervision of properly qualified personnel.

24.7 The Contractor shall promptly remedy damage and loss (other than damage or loss insured under property insurance required by the Contract Documents) to property referred to Section 24.2 and

24.3 herein; caused in whole or in part by the Contractor, a Subcontractor, a Sub-subcontractor, or anyone directly or indirectly employed by any of them, or by anyone for whose acts they may be liable and for which the Contractor is responsible under the above Section 24.2 and 24.3 herein; except damage or loss attributable to acts or omissions of the County or Architect/Engineer or anyone directly or indirectly employed by either of them, or by anyone for whose acts either of them may be liable, and not attributable to the fault or negligence of the Contractor.

24.8 The Contractor shall designate a responsible member of the Contractor’s organization at the site whose duty shall be the prevention of accidents. This person shall be the Contractor’s superintendent unless otherwise designated by the Contractor in writing to the County’s Project Manager.

24.9 The Contractor shall not load or permit any part of the construction or site to be loaded so as to endanger its safety.

25. TIME OF COMPLETION

25.1 The work to be performed under this Contract shall be commenced upon issuance of individual Work

Orders and in conjunction with associated Notices to Proceed, which will not be issued until receipt of all required documentation.

25.2 Time of completion for each Work Order will be determined mutually by the County’s Project

Manager and the Contractor’s representative and specified in each Work Order. In the event, that the County and the Contractor representatives cannot agree on the time of completion for the specified Work, the time of completion shall be calculated as 15 calendar days per bus stop location from the issuance of a Notice to Proceed.

25.3 The time of completion will be stipulated on the Notice to Proceed. Once the Work is completed, it is the Contractor’s responsibility to schedule a final inspection with the County’s Project Manager and

ALL applicable agencies / representatives overseeing the Work. The date of final inspection MUST be performed on or before the stipulated time of completion.

25.4 If the Contractor fails to schedule the final inspection for a date that is on or before the time of completion, or if the work is not completed on or before the time of completion (as stated on the Notice to Proceed), the specific Work Order will be deemed late and Liquidated Damages as established in Sections 27 shall apply.

25.5 In the event that work is delayed for unforeseen reason(s), it is the Contactor’s responsibility to submit a Request for Time Extension to the County’s Project Manager within three business days of such delay(s).

25.6 Request for Time Extension shall clearly state reason(s) for the delay(s), number of days that the job was delayed, and number of additional calendar days required to complete the job. It is the County’s Project Manager’s responsibility to review and provide an answer to the Request for Time Extension within five business days after the Request is submitted. If the Request for Time Extension is approved, a revised Notice to Proceed or Notice of Required Correction with the new completion date will be issued.

26. SUBSTANTIAL COMPLETION

26.1 When the Contractor considers that the Work, or a portion thereof which the County’s Project Manager agrees to accept separately, is substantially complete, the Contractor shall prepare and submit to the County’s Project Manager a comprehensive list of items to be completed or corrected prior to final payment. Failure to include an item on such list does not alter the responsibility of the Contractor to complete all Work in accordance with the Contract Documents.

26.2 Upon receipt of the Contractor’s list, the County’s Project Manager will make an inspection to determine whether the Work or designated portions thereof is substantially complete. If the Project Manager’s inspection discloses any item, whether or not included on the Contractor’s list, which is not sufficiently complete in accordance with the Contract Documents so that the Work may be occupied/utilized or designated portions thereof for its intended use, the Contractor shall, before issuance of the Certificate of Substantial Completion, complete or correct such items upon notification by the County’s Project Manager. In such case, the Contractor shall then submit a request for another inspection by the County’s Project Manager to determine substantial completion.

27. LIQUIDATED DAMAGES

27.1 In the event that the Work Order fails the final inspection, the Contractor will be issued a Notice of Required Correction due to inspection failure. The Contractor is then required to bring site into compliance. Upon inspection failure, the time of completion will be determined mutually by the County’s Project Manager and the Contractor’s representative.

27.2 In the event that the County and Contractor representatives cannot agree on the time of completion, the time of completion after inspection failure shall be no later than 14 calendar days from the date of Notice of Required Correction. Once the Contractor addresses job deficiencies as per the Notice of Required Correction, it is the Contractor’s responsibility to schedule a Re-Inspection with the County’s Project Manager or his/her designee, and any other agency overseeing the work on a date that is on or before the stipulated time of completion.

27.3 If the Contractor fails to schedule the final inspection or if the work is not completed on or before the time of completion date (as stated on the Notice of Required Correction), the job will be deemed late and liquidated damages as established in below (27.4) of this Section.

27.4 Upon failure of the Contractor to complete the Work awarded pursuant to this Contract within the specified period of time (plus approved extensions, if any) the Contractor shall pay to County the sum of One thousand three hundred eighteen dollars ($1,318.00) for each calendar day after the time specified for completion. This amount is not a penalty but liquidated damages to the County.

Liquidated damages are hereby fixed and agreed upon between the parties, recognizing the impossibility of precisely ascertaining the amount of damages that will be sustained by the County as a consequence of such delay. Contractor acknowledges and agrees that damages to County from untimely completion are extremely difficult to determine, and accordingly the Contractor agrees that the amount of liquidated damages provided for herein is the nearest and most exact measure of damages for such delays.

27.5 The County is authorized to deduct liquidated damage amounts from the monies due to Contractor for the work under this Contract, or as much thereof as the County may, at its own option, deem just and reasonable.
