SUMMARY OF WORK

1. PART 1 – GENERAL

1.1 SUMMARY

1.1.1 Description: This is a Simplified Acquisition of Base Engineering Requirements (SABER) indefinite-delivery, indefinite-quantity (IDIQ) contract for design and construction efforts at Nellis Air Force Base (NAFB), Creech Air Force Base (CAFB), Range 63, and Point Bravo. Work shall be defined in individual Task Orders (TO) and may consist of multiple disciplines in general construction categories. It may involve design services for all aspects of general construction including construction, modifications, and renovations of existing facilities.

Work may include but is not limited to maintenance, repair, alteration, mechanical, electrical, heating/air conditioning, demolition, painting, asbestos remediation, paving and earthen work for industrial/office buildings and/or infrastructure. The Contractor shall furnish all design, labor, equipment, materials, manufactured articles, transportation, supervision, and all else necessary to accomplish the design and/or repair/construction of each TO written under this SABER for all work that is defined for each project. These TOs will be completed in accordance with this SABER Statement of Work, all applicable SABER specifications, referenced documents, and any provided TO specific documents.

1.1.2 Definitions:

1.1.2.1 Addendum Statement of Objectives (SOO) Request: A requested change made by 99 CES to be included and priced by the SABER Contractor for an existing task order prior to receipt of proposal. A contract modification shall be issued by 99 CONS to formally integrate the Addendum into the task order contract.

1.1.2.2 Addendum Statement of Work (SOW) Request: A modification request made by 99 CES to be priced by the SABER Contractor for an existing task order after receipt of proposal.

Once an addendum proposal is finalized and funded by the Government, a contract modification may be issued by 99 CONS to formally integrate the change into the task order contract.

1.1.2.3 As-Built Drawings: Drawings prepared by the Contractor that are in sufficient detail, in accordance with this SOW, and accurately reflect the project as it was constructed. Drawings shall be complete with all changes, modifications, and deletions from the original awarded drawings. The final as-built drawings include modifications during construction, field requested changes, shop drawing modifications, and contractor designs. (See Section 1.28).

1.1.2.4 As-Constructed Drawings: These are As-Built Drawings for Civil Works Projects.

The term As-Built used in this document is synonymous.

1.1.2.5 Calendar Day (CD): Each day of the calendar year including workdays (WD), Holidays, and Weekends (including Saturdays and Sundays). Unless otherwise specified, all references to “days” will be considered as calendar days.

1.1.2.6 Coefficient: A Coefficient is the Contractor’s pricing factor which is multiplied against the standard unit prices in calculating proposed task order (TO) prices. It is proposed by the Contractor as a percentage increase (e.g., 1.10) to the current edition of the Construction Task Catalog® (CTC). See Section 1.5.9.1.

1.1.2.7 Congested Area: any area with less than 3' vertical or horizontal clearance and includes areas such as crawl spaces, ceiling plenums where the ceiling grid is not removed, narrow piping tunnels, and equipment rooms where the space to install the new work is congested as a result of equipment and piping placement that meet these dimensional restrictions.

1.1.2.8 Contract Clauses: Terms and conditions that clearly define and outline a specific part of the contract. Particularly, privileges, rights and duties relevant to the contract.

1.1.2.9 Contractor: The term Contractor refers to the general contractor. The general contractor is responsible for all subcontractors, suppliers, and consultants under their employ.

1.1.2.10 Contractor Mark-ups (Redlines): Drawings that are marked with changes and revisions and accurately annotated to show the project as-built by the contractor. They are part of the working as-built set.

1.1.2.11 Contracting Officer: The Contracting Officer refers to a person with the authority to enter into, administer, change and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the Contracting Officer acting within the limits of their authority as delegated by the contracting officer.

1.1.2.12 Controlled Area: Area of performance on Government property with heightened security requirements within which the Contractor is not allowed free access to the work site, cannot enter and exit freely, and will be required to be under escort at all times during performance of the project. This may include all the areas on and adjacent to airfield features, within a flightline perimeter fence, the flightline side of facilities, or as otherwise defined in specific project documents.

1.1.2.13 Cost Proposal: A computerized, “detailed report” of the cost proposal using eGordian, organized into the SABER Construction Task Catalog CSI format listing quantities, CSI number, unit price, total price, and a description of all items required by a Statement of Work as well as drawings for which a price exists in the SABER Construction Task Catalog® (CTC).

1.1.2.14 Designer of Record (DOR): The individual accountable for specific portions of the design documents. Where professional certification is required for the design, the DOR would be the individual providing certification for that portion of the design. Where professional certification is not required, the DOR would typically be the individual who provided the design or specifications for a particular aspect of the project (i.e.: architectural, civil, structural, mechanical, fire, telecommunications or electrical).

1.1.2.15 Drawings: Graphical representations in accordance with this SOW documenting the work required for each Government project. (See Section 1.28)

1.1.2.16 Facility: A separate building or structure.

1.1.2.17 Final Inspection: The final examination/inspection held by the Government to verify that all work requirements (including clean-up) have been satisfactorily accomplished by the Contractor.

1.1.2.18 Government-Furnished Property: Items (e.g., equipment, facilities, materials, services, etc.) provided by the Government to the Contractor for use in performance of this contract, including issued task orders.

1.1.2.19 Match Existing: A term used to describe the exactness to which the Government requires a new and old product to match. “Match existing” requires that a thorough and/or an exhaustive effort be made, on the part of the Contractor, to match as close as possible an existing finish, product, color, texture, sheen, etc. This may mean the use of custom matching of colors or providing manufacturers “non-standard” material selections during the submittal process.

1.1.2.20 Negotiations: Communications between the Government and the Contractor aimed at reaching an agreement on all aspects, including pricing, technical requirements, and the performance time required for each identified construction project.

1.1.2.21 Non-Pre-Priced Line Items (NPI): Items of work not contained in the SABER CTC.

See Section 1.13.2.

1.1.2.22 Notice to Proceed (NTP): A contract document issued by the Contracting Officer, after receipt of bonding, which gives the Contractor written notice to commence work and/or order materials.

1.1.2.23 Phase-in Period: A time period made available to the contractor to mobilize, acquire equipment, manpower, and all else necessary to become fully operational and begin executing work as ordered. See paragraph 1.3.7.

1.1.2.24 Phase-out Period: The period of time available to the contractor, after the completion of the final Task Order, to demobilize from the installation, and return any utilized utilities and property to its original configuration.

1.1.2.25 Pre-Construction Conference: A meeting attended by designated representatives of the Government and the Contractor after project award but before the start of work to discuss all aspects of the required work for a specific project.

1.1.2.26 Pre-Final Inspection: The quality control examination held by the Contractor to identify all work and discrepancies to be corrected prior to requesting a final inspection by the Government. It is encouraged to have Government representation on-site during the Pre-Final Inspection.

1.1.2.27 Pre-Priced Line Items (PI): Items of work contained in the SABER CTC. See Section 1.13.2.

1.1.2.28 Professional Certification: The process of affixing a seal or statement to a drawing or design document to indicate that the work to which it is affixed has been performed by a person licensed as a professional, in that area of expertise, in the state of Nevada.

1.1.2.29 Progress Meeting: A meeting attended by designated representatives of the Government and the Contractor to discuss the progress on existing SABER projects as well as the basic contract performance.

1.1.2.30 Restricted Work Area: Area of performance on Government property with increased security requirements within which the Contractor is not allowed free access to the work site.

The Contractor shall be escorted to and from the work site by a Government representative.

Contractor provided escorts are not allowed. Restricted Work Areas are marked by warning signs, contain priority resources and all personnel must obtain specific written permission to enter. Personnel and equipment entry may be subject to delays due to security processing.

1.1.2.31 SABER: Simplified Acquisition of Base Engineering Requirements generally means a fixed-price, indefinite-delivery/indefinite-quantity (ID/IQ) contract which orders are placed.

Each order includes detailed task specifications which encompass most types of real property maintenance, repair, and construction work.

1.1.2.32 SABER Construction Task Catalog® (CTC): A comprehensive listing of construction related tasks together with a specific unit of measure and a published Unit Price.

1.1.2.33 Scoping Meetings: Meetings attended by designated representatives of the Government and the Contractor to discuss and define the work requirements of potential projects in sufficient detail to allow the Contractor to prepare a Statement of Work (SOW), required drawings, material submittal forms, and all else necessary to successfully complete the project.

Meetings may be requested/held before the design task order is issued.

1.1.2.34 Site Visit: An investigative visit to a location at which work has been proposed by the Government to be done by the Contractor. The purpose of the visit is for the Contractor along with their subcontractors as necessary to gather enough information to prepare the Statement of Work, drawings, and project estimate.

1.1.2.35 Statement of Objectives (SOO): The initial document, with drawings where applicable, provided to the Contractor stating the Government’s overall objectives of the work to be completed. It is used when the Government intends to provide maximum flexibility to the Contractor to propose an innovative approach.

1.1.2.36 Statement of Work (SOW): Written descriptions (in the quality, detail, and professionalism identified in the Contractor’s technical proposal) documenting work required by each Government task order, prepared by the Contractor from the Statement of Objectives provided by the Government.

1.1.2.37 Task Order (TO): An order placed against an established contract, which may contain the general requirements and parameters of a proposed project. Included with the TO may be a Statement of Work or Statement of Objectives that define specific technical requirements for the project. May also include information such as budget limitations, design certifications and drawings required to be prepared by the contractor.

1.1.2.38 Technical Specifications – The written requirements for materials, equipment, systems, standards and workmanship for the Work, and performance of related services.

1.1.2.39

1.1.2.40 True Ceiling: The location/point where the wall and the solid ceiling or roof deck adjoins/touches. This is in reference to “wall and true ceiling”. This is not the point where the wall and grid/drop ceiling adjoins/touch.

1.1.2.41 True Floor: The location/point where the wall and the solid floor or finish floor adjoins/touches. This is in reference to “wall and true floor”. This is not the point where the wall and a raise/false floor adjoins/touch.

1.3.1 Minimum/Maximum Contract Amounts: The only work authorized under the SABER is as described in individual Task Orders (TOs). A minimum of $50,000.00 is guaranteed for the IDIQ contract awarded. Individual TOs shall have an estimated magnitude of $15,000.00 to $4,000,000.00. The Government makes no representation as to the number of TOs or actual amount of work to be ordered in excess of the minimum guarantee specified herein. The aggregate amount of the SABER program shall not exceed $185,000,000.00.

1.3.2 Commencement Of Work: No construction work under this contract shall commence until such a time as the Contracting Officer issues a written TO and a Notice to Proceed (NTP) under the TO as described in section 1.7 “Notice to Proceed.” The Contracting Officer reserves the right to determine the issue date of any NTP.

1.3.3 Task Order Performance Period: FAR 52.211-10, Commencement, Prosecution, and Completion of Work shall be incorporated into each TO identifying the construction schedule.

The Government reserves the right to negotiate a performance period or impose a performance period for each TO.

1.3.4 Performance Evaluations: At the conclusion of each ordering period, the Contractor will be evaluated in the Contractor Performance Assessment Reporting System (CPARS). The evaluations will take into account all aspects of the contractor’s performance on all issued TOs.

Furthermore, performance evaluations may be completed at any time the Contractor’s performance is considered less than satisfactory. Contractors will be provided with an opportunity to provide input into the evaluation. The performance evaluations may have an impact on the award of future TOs.

1.3.5 Gordian's SABER System License: Nellis AFB selected The Gordian Group’s (Gordian) Task Order Contracting Solution for their SABER program. The Gordian SABER Solution™ includes Gordian’s proprietary SABER Information Management System SABER Applications, construction cost data, and Construction Task Catalog® which shall be used by the Contractor solely for the purpose of fulfilling its obligations under this Contract, including the preparation and submission of Task Order Proposals, Cost proposals, subcontractor lists, and other requirements specified by the Government. The Contractor shall be required to execute Gordian’s SaaS Terms of Use and pay a SABER System License Fee to obtain access to the Gordian SABER Solution™. Gordian’s SABER System License purchased by the contractor shall include user licenses for access to eGordian, CTC, Technical Specifications, and annual training for Nellis AFB and contractor staff. The SABER System License Fee applies to all Task Orders issued to the Contractor under the terms of the Contract.

1.3.6 Task Order Issuance Procedures

1.3.6.1 Work under the SABER will be ordered by written TO issued on a DD Form 1155 (Order for Supplies or Services) to the contractor by the Contracting Officer.

1.3.6.2 The individual TOs will be placed in a progressive numbering system, which relate back to the contractor’s basic SABER.

1.3.6.3 The Government will not be obligated to reimburse the contractor for work performed, items delivered, or any costs incurred, nor shall the contractor be obligated to perform, deliver, or otherwise incur costs except as authorized by a duly executed TOs.

1.3.6.4 TOs will be firm fixed price and clearly define the specific services to be performed or the performance desired. Each TO will be subject to the terms and conditions of the SABER IDIQ. In the event of a conflict between the TO and the SABER IDIQ, the TO shall take precedence.

1.3.7 Phase-In Period: The Contractor shall be allowed an initial 30 calendar day “start-up” period following SABER IDIQ contract award. However, limited performance may be required during the “start -up” period (see Table 1 below). The Contractor shall have all equipment and personnel in place and available to fully execute all requirements of this contract following the 30-calendar day “start-up” period. The Contractor may be notified of potential projects within the phase-in period and, if capable of performing, may begin work earlier than shown in Table 1 below.

1.4 PROJECT ESTIMATING/DESIGN ORDERING PROCEDURE

1.4.1 Intent of Design/Estimating: It is not the Government’s intent to have the Contractor provide an estimating service for projects that have no SABER construction consideration.

However, the Government is not obligated to issue a task order for the construction work described in the completed project estimate.

1.4.2 Notice of Requirement: As the need exists for design and/or project estimating under the terms of this contract, the CO will notify the Contractor of the requirement by issuing a task order for the work.

1.4.2.1 When ordering design and or cost proposal services, such notification will include a project number, project title, statement of objectives, general scope of work, magnitude of project, any statutory limitations, special instructions, and conditions that may exist with respect to the work. The Contractor shall be responsible for preparing a detailed proposal by identifying tasks required, conducting an asbestos/lead-based paint (LBP) survey as necessary, preparing drawings, developing performance times, and furnishing the finalized design to the CO for approval. The Contractor shall prepare a detailed cost proposal in the specified format by listing quantities of individual work elements needed, specify non-priced line items, and submit to the CO for evaluation/negotiation. The applicable design/estimating CLIN fee shall cover the costs for this effort.

1.4.3 Revised Design Task Orders and Government-Requested Redesign

1.4.3.1 If within the initial three task periods (Tasks and their respective performance periods are depicted in Table 3, Period Performance Time), the Government may inform the contractor of the intent to provide a revised SOO without incurring a redesign fee. The task order shall be suspended until the Government provides the revised SOO package, at which time Task 4 will begin.

1.4.3.2 Once the first three task periods have been completed and Task 4 has commenced (see Table 3: Period Performance Time for the task descriptions) and the Government wishes to revise the SOO, the contractor may request a redesign fee. The task order shall be suspended until the Government provides the revised SOO package, at which time Task 4 and its respective performance period will restart.

1.4.3.3 The redesign fee will only apply to government requested significant scope changes, not for errors in contractor design.

1.4.3.4 The Government's acceptance of the design does not relieve the contractor or their Designers of Record from flaws, deficiencies, or violations within the design. Additionally, any requirement to correct the design, or any related construction, shall be at no cost to the Government.

1.4.4 Magnitude of Project

1.4.4.1 The Contractor shall promptly advise the CO and provide a rationale and Rough Order of Magnitude if the project being designed is or is likely to exceed the specified project magnitude.

1.4.4.2 The project magnitude ranges shall be defined as shown below in Table 2:

1.4.7 Request for Information: The Contractor shall ensure the scope of work is fully defined and a thorough review of all Government as-builts is accomplished if available. It is the sole responsibility of the Contractor to request in writing to the Contracting Officer specific drawings or technical documents to review. All available as-builts will be provided to the Contractor. The Contractor shall field verify all provided as-builts as well as existing field conditions prior to accomplishing any design work. Contractor shall submit requests for information to utilize proposed alternative means of accomplishing the project. The Contractor has five (5) business days after the site visit to notify the Government of any additional information needed for the submission of proposals.

1.4.8 Environmental Survey: The Contractor shall accomplish an exhaustive asbestos/LBP survey, as necessary based on project scope, through a certified environmental consultant. The Contractor shall accomplish all work in compliance with all applicable Federal, State, and local regulations. All environmental survey tests shall be included in the Contractor’s design fee based on each individual task order. No additional compensation shall be paid to the Contractor for asbestos or lead based paint testing; this will be covered under the appropriate design/estimating CLIN.

1.4.9 Construction Cost Proposal: Upon completion of the refined scope of the individual requirement, including the finalized drawings and Statement of Work, whether Contractor or Government generated, the Contractor shall prepare a detailed cost proposal by identifying tasks, preparing drawings, refining quantities of both pre-priced and non-pre-priced items (NPI), pricing NPIs, developing performance times, and preparing a completed proposal document for submission to the Contracting Officer.

1.4.9.1 Contractor’s Coefficient: The purpose of the Contractor’s coefficient is to capture most common, recurring project costs within a single figure in order to simplify and reduce repetitiveness in cost proposals. All cost proposals submitted will reflect the coefficient factor in effect at the time of submission. The Contractor’s Coefficient includes common, recurring project costs as outlined below.

1.4.9.1.1 COEFFICIENT: A numerical factor that represents costs (generally indirect costs) not considered to be included in Construction Task Catalog (CTC) unit prices, e.g. general and administrative and other overhead costs, insurance costs, bonding and alternative payment protection costs, protective clothing, sales tax and compliance with tax laws and contractor’s and subcontractor’s profit. Contingent costs, such as labor rate changes and inflation in future years are also covered in the coefficient. Coefficients proposed by offerors are multiplied by the Government-established unit prices in the Construction Task Catalog (Commonly referred to as a Unit Price Book) to price a job or project on individual task orders. The Coefficient(s) proposed by the offeror and accepted by the Government are incorporated in SABER. The contractor’s price coefficient must include the following:

• Contractor’s overhead and profit

• Subcontractors’ overhead and profit

• Insurance

• All costs associated with bonding (specifically including bond premiums)

• Employee payroll taxes, insurance, and fringe benefits

• All taxes, contributions, memberships, corporate headquarters support (legal, financial, etc.)

• Sales tax on material and equipment costs

• All waste and excess material

• Daily clean up

• Mobilization and close out for the total contract and each task order

• Compliance with environmental laws (overhead [indirect] costs associated with performing work in compliance with EPA/OSHA regulations, including obtaining any necessary licenses and permits, reporting requirements, etc.)

• Quality control

• Office management and equipment

• Office and management personnel

• Office space

• Office supplies

• Employee transportation

• Project trailer

• Project Equipment & Supplies

• Portable toilets for Contractor’s Use

• Construction vehicles

• Personnel safety equipment

• Depreciation of mobile office(s)

• Interest associated with funding of equipment and payroll

• Cost of financing the work

• Preparation and modification of sketches, drawings, submittals, as-built drawings, and other project records.

• Permits, licenses, and fees, including Services required to obtain any filings and permits.

• Include testing, calibration, balancing and the like required to ensure proper installation, construction and performance.

1.4.9.1.2 “The Big Note” of the CTC shall be construed as guidance for the proper use and applications of Unit Price line items used for the Cost proposal.

1.4.9.1.3 Material costs in the CTC include an allowance for waste. Quantities used on individual task order proposals shall be taken from field measurements or design plans, as appropriate, without allowance for any waste.

1.4.9.1.4 Large vehicular construction equipment associated costs are excluded from the contractor’s coefficient.

1.4.9.1.5 Traffic control measures such as flaggers, steel plates, etc. are excluded from the contractor’s coefficient.

1.4.9.1.6 Security fencing and related expenses for secure construction sites are excluded from the contractor's coefficient.

1.4.9.1.7 Cost differences due to location: Due to the remote locations of Creech AFB, Range 63, and Point Bravo, an increase in labor, transportation and other costs is expected. In order to account for these price differences, the Contractor shall use location-specific design fees and coefficients. One set of design fees and coefficients shall be used exclusively for projects at Nellis AFB, and another set of design fees and coefficients shall be used exclusively for projects at Creech AFB, Range 63, and Point Bravo.

1.4.9.1.8 Non-Standard Working Hours: Defined as the period outside of Standard Work Hours and Government holidays. Only work specified by the CO, prior to issuance of a TO, or subsequent modification that identifies work requiring non-standard work hours, shall be multiplied by the nonstandard coefficient. See Section 1.8 for more information.

1.4.9.2 Project Price Adjustment: At the beginning of each Ordering Period all previously negotiated, unawarded project pricing shall be adjusted by the Contractor based on the newly revised CTC, to include the Contractor’s coefficient. The adjusted project pricing will be forwarded for each such project to the Contracting Officer not later than the first day Ordering Period. The adjusted price will be held until the next update or until award of that Task Order, whichever comes first.

1.4.10 Format of the Proposal: The Contractor’s design proposal shall be submitted electronically via e-mail in the requested Project Estimating Software format described in Section 1.13 (with any applicable Word or Excel documents), to include an Adobe (.pdf) version for the Contracting Office and the technical review electronic version from the Project Estimating Software for 99 CES/CEN. Any associated files or AutoCAD drawings too large to transmit via email shall be submitted using DoD SAFE. The Contractor shall make a DoD SAFE drop-off request for file transfer from the Contracting Office when proposals are ready to submit. In addition, up to two 11” x 17” paper copies of drawings per submission may be requested on specific Task Orders and shall be sent to the Contracting Officer concurrently with electronic submission. Each proposal shall include, at a minimum, the following:

1.4.10.1 Statement of Work (SOW): Written descriptions (in the quality, detail, and professionalism identified in the Contractor’s technical proposal) documenting work required by each Government task order, prepared by the Contractor from the Statement of Objectives provided by the Government.
