About this file
This is a standardized Bid Bond form from the City of Edinburg, Texas, applicable to the Veterans Blvd. Drainage Improvements Phase II project. The bid bond document establishes the requirements for bidders to submit either an original bid bond or a copy of a cashier's check along with their bid submission. The form requires bidders to provide their full legal name, principal place of business address, and surety information, along with project details including the bid due date and the bond penal sum amount. Bidders and their sureties are jointly and severally bound by the bond, with default occurring if the bidder fails to deliver an executed agreement and any required performance and payment bonds within the timeframe specified in the bidding documents.
The bond's penal sum represents the extent of both the bidder's and surety's liability, with recovery of this amount constituting the owner's sole and exclusive remedy in case of default. The obligation becomes null and void if the owner accepts the bid and the bidder delivers the required executed agreement and bonds on time, if all bids are rejected, or if the owner fails to issue a Notice of Award within the specified timeframe or agreed extensions not to exceed 120 days without surety consent. Payment under the bond is due within 30 calendar days of written notice of default from the owner, and any legal action must be commenced no earlier than 30 calendar days after such notice and no later than one year after the bid due date. All notices must be sent in writing via personal delivery, commercial courier, or certified mail to the addresses provided on the bond face.
