About this opportunity

The Erie Canal Harbor Development Corporation (ECHDC), a subsidiary of the New York State Urban Development Corporation d/b/a Empire State Development, is soliciting sealed bids for construction services to rehabilitate and improve public safety and accessibility at Terminal B in the Buffalo Outer Harbor at 901 Fuhrmann Boulevard, with bids due August 5, 2026 at 2:00 PM ET and a mandatory pre-submission site visit held July 8, 2026. The procurement is divided into two separate prime contracts, and prospective bidders may respond to either or both. A Service-Disabled Veteran-Owned Business (SDVOB) goal of 6 percent and a total Minority/Women Business Enterprise (MWBE) goal of 30 percent apply to both packages.

The scope encompasses pavement rehabilitation (milling and overlay with localized full-depth removal), installation of new guardrail systems adjacent to the quay wall, localized concrete repairs, site lighting upgrades with new electrical infrastructure, selective demolition, erosion and sediment control, and related work across approximately 8+02 stations of waterfront. Contract Package 1 covers Site Electrical and Lighting Upgrades; Contract Package 2 covers Site Construction and Structural Repairs. Both packages include unit prices for excavation and disposal of hazardous contaminated soil; a Phase II Environmental Site Assessment identified soil contamination including elevated lead and petroleum compounds in specific borings. Contract Package 1 includes one optional alternate (Feature Lighting System); Contract Package 2 includes two optional alternates (Site Furnishings and Knee Wall Rehabilitation).

The selected bidders will be responsible bidders submitting the lowest cost for each respective package. Per New York Public Buildings Law Section 8, contracts exceeding $5,000 may be awarded to a responsible and reliable NYS-certified MWBE provided the bid does not exceed $1.4 million and does not exceed the lowest bidder by more than 10 percent. Prevailing wages are required. The contractor must maintain commercial general liability insurance of $2 million per occurrence, $3 million umbrella/excess liability, and builder's risk coverage equal to the total contract cost, with ESD named as additional insured on a primary and non-contributory basis. Liquidated damages are set at $1,000 per calendar day. The anticipated contract start date is September 2026. No identical or substantially similar contract has been awarded within the past five years. Questions were due July 16, 2026, with ESD responses due July 28, 2026; Addendum II (Q&A), Addendum III (revisions to drawings and specifications), and Addendum IV (notice of public bid announcement) have been posted.
