About this file
This is a Limited Phase II Environmental Site Assessment (ESA) prepared by Ravi Engineering & Land Surveying, P.C. for the Buffalo Outer Harbor Terminal B project, located at 901 Fuhrmann Boulevard in Buffalo, New York, and conducted for the Erie Canal Harbor Development Corporation (ECHDC) and Empire State Development (ESD). The assessment was completed on October 29, 2020, and involved a comprehensive soil investigation, radiological survey, and hazardous characterization. The investigation included monitoring of ten soil borings installed between August 27 and September 1, 2020, collection of eight soil samples for laboratory analysis, and a gamma walkover radiological survey to assess potential contamination from historically-generated slag waste containing technically enhanced naturally-occurring radioactive material (TENORM).
The soil investigation revealed that seven of eight boring locations contained soil samples that were largely innocuous, with only minor exceedances in cadmium levels at one location. However, soil boring SB10, sampled at depths of 10 to 14 feet below ground surface, exhibited severe contamination including petroleum compounds (ethylbenzene, xylenes, and toluene) and elevated metals, most significantly lead at 7,740 ppm against a cleanup objective of 400 ppm, which may classify the waste as hazardous. The radiological survey identified an area near SB10 with elevated gamma readings up to approximately 17,700 cpm, attributable to slag and slag-like material. The assessment recommends that the site owner report findings to the New York State Department of Environmental Conservation (NYSDEC), develop a delineation work plan to define the extent of contamination, perform toxicity characteristic leaching procedure (TCLP) analysis, submit a draft Remedial Action Plan for NYSDEC approval, and employ a radiation control technician during future subsurface disturbance to ensure proper waste management and disposal.

1.0 INTRODUCTION
Ravi Engineering & Land Surveying, P.C. (RE&LS) was retained by Bergmann to perform a Limited Phase II Environmental Site Assessment (ESA) for the Buffalo Outer Harbor – Terminal B project in the City of Buffalo, Erie County, New York (the “Site,” Figure 1). The investigation was conducted concurrently with a Geotechnical Investigation performed by Earth Dimensions Environmental Consultants and Contractors (Earth Dimensions).
The RE&LS investigation included:
Monitoring Earth Dimensions soil borings, Collecting soil samples for laboratory analysis, and Conducting a radiological survey.
Based on the intended use of the Site for active recreational use, soil samples results were compared to New York State Department of Environmental Conservation (NYSDEC) Part 375.6 Restricted Residential Soil Cleanup Objectives (SCOs).
2.0 NOVEMBER 2017 GEOTECHNICAL REVIEW
To familiarize ourselves with Site conditions, RE&LS first reviewed the Encorus Group (Encorus) November 2017 Geotechnical Investigation of the Site. Encorus installed two soil borings and described the following subsurface conditions:
Bedrock was encountered at 71.5 feet beneath ground surface (BGS).
The borings encountered random fill materials to depths of approximately 18 feet BGS.
The fill materials included slag, ash, concrete debris, and brick fragments.
Native soils were described as sand with a traces of silt and organic matter.
3.0 DISCUSSION
As indicated on Figure 2, Earth Dimensions conducted the geotechnical investigation from 8/27 to 9/01/2020 using rotary drilling equipment.
Based on the fill materials described by Encorus in 2017, RE&LS screened the borings for organic vapors with a photoionization detector (PID) meter. As indicated on Figure 3, RE&LS collected eight soil samples and submitted them to Paradigm Environmental Services, Inc.
(Paradigm) for laboratory analysis for:
Volatile organic compounds (VOCs) by USEPA Method 8260, Semivolatile organic compounds (SVOCs) by Method 8270, RCRA metals by Method 6010/7471, and Polychlorinated biphenyls (PCBs) by Method 8082.

3.1 Radiological Survey
Encorus indicated that there is slag present on the Site. Historically, technically-enhanced naturally-occurring radioactive material (TENORM) in the form of rocky slag waste was generated in large quantities in western New York. Radioactive TENORM is of potential concern on the Site.
RE&LS retained BE3 Corporation to conduct a radiological survey with a gamma system to determine if the buried slag has gamma readings indicative of radioactive levels of concern (Figure 4, Attachment B).
4.0 RESULTS
4.1 Soil Investigation
Earth Dimensions installed ten (10) soil borings as indicated on Figure 2; soils encountered during the investigation consisted of the following:
SB-1: fill consisting of gravel, silt, slag, and concrete debris to a depth of 21 feet BGS, native sand and clayey silt to a total depth of 27 feet BGS.
SB-2: fill consisting of gravel, sand, slag, and concrete debris to a depth of 21 feet BGS, native sand and clayey silt to a total depth of 22 feet BGS.
SB-3: fill consisting of gravel, silt, and slag to a total depth of 9.1 feet BGS.
SB-4: fill consisting of gravel, silt, and slag to a depth of 6 feet BGS, native silty sand to a total depth of 16 feet BGS.
SB-5: fill consisting of gravel, silt, and slag to a depth of 6 feet BGS, native silty sand to a total depth of 16 feet BGS, native silty sand and silty clay to bedrock refusal at 65.5 feet BGS.
SB-6: fill consisting of gravel, brick and glass fragments, wood fiber, and slag to a total depth of 14 feet BGS, native silty sand and silty clay to bedrock refusal at 66.4 feet BGS.
SB-7: fill consisting of gravel, silt, slag, and glass fragments to a depth of 6.4 feet BGS, native silty clay to a total depth of 16 feet BGS.
SB-8: fill consisting of gravel, silt, and slag to a depth of 4.5 feet BGS, silty sand and clay to a total depth of 16 feet BGS.
SB-9: fill consisting of gravel, silt, and slag to a depth of 2.3 feet BGS, native silty sand and silty clay to a total depth of 16 feet BGS.
SB-10: fill consisting of gravel, silt, paper fiber, brick fragments, and wood fiber to a depth of 14.1 feet BGS, silty sand to a total depth of 16 feet BGS.

4.2 Soil Results
With the exception of SB10, no significant evidence of impacted soils or elevated levels of organic vapors were noted. In SB10 from 12 to 14 feet BGS, 400 parts per million (ppm) of organic vapors were measured, and 185 ppm of organic vapors registered in SB10 from 14 to 16 feet BGS (Attachment C).
RE&LS collected eight soil samples for laboratory analysis; the results are tabulated below with comparisons to the Restricted Residential SCOs. The Earth Dimensions soil boring (SB) number is indicated along with the depth from which the sample was collected:

4.3 Hazardous Characteristics
Because of the elevated PID readings measured in SB10 at depths of 10-14 feet BGS this sample was also submitted for hazardous characterization which is required for landfill approval.
No PCBs were detected in soil sample SB10, 10-14’.
No detected herbicides, reactive cyanide, or reactive sulfide in soil sample SB10, 10-14’.
Corrosivity (as pH) = 7.26 @ 23.5 degrees Celsius for soil sample SB10, 10-14’.
Flash Point = 46.5 degrees Celsius for soil sample SB10, 10-14’.
5.0 RADIOLOGICAL SURVEY
BE3 conducted the gamma walkover and boring surveys with a gamma scintillation system linked to a global positioning system (GPS). The Site was traversed and discreet boring locations were scanned to collect gamma radiation readings that were located with a Trimble hand-held GPS.
The gamma radiation was recorded using a Ludlum model 44-10 probe coupled to a Ludlum model 2221 meter that stored values in counts per minute (cpm). The gamma readings and GPS coordinates were uploaded to a computer using mapping software and plotted on a color coordinated figure to illustrate the gamma radiation readings and trends throughout the site.
5.1 Survey Results
As indicated on Figure 4, an area in the vicinity of SB10 exhibits elevated gamma radiation readings, most likely due to the presence of slag and slag-like material.
While the majority of the Site is at background gamma radiation levels or less (i.e., 7,400 cpm), this area exhibited elevated gamma readings up to approximately 17,700 cpm in close proximity to SB10.
6.0 SUMMARY
Soil samples from seven of the eight borings appear to be innocuous, with only one minor exceedance of 6.09 ppm of cadmium in SB6 at depths ranging from 5 feet to 8 feet BGS; the Restricted-Residential Use SCO for cadmium is 4.3 ppm.
The soil sample from SB10 from depths ranging from 10 feet to 14 feet BGS is grossly contaminated.
Petroleum compounds ethylbenzene, mixed Xylenes, and toluene were all detected at concentrations greater than the NYSDEC Restricted Residential Use Soil Cleanup Objective (SCO). The site owner is obligated to report this finding to the NYSDEC.
Several metals were detected in exceedance of the SCO. The most problematic may be 7,740 parts per million (ppm) of lead; the SCO for lead is 400 ppm. This high of a concentration of lead may classify the waste as “hazardous.” A toxicity characteristic leaching procedure (TCLP) analysis will be required to determine whether the soil is “hazardous waste.”
As indicated on Figure 4, an area in the vicinity of SB10 exhibits elevated gamma radiation readings.
- 6 -
7.0 OPINION
A spill must be reported to NYSDEC relative to the contamination detected in BH10.
The spill must be delineated to define the aerial and vertical extent of contamination.
The delineation should include TCLP analysis of the soil to determine the hazardous classification.
The delineation should include sampling and laboratory analysis of the slag that exhibits elevated gamma readings. The slag analysis will be used to determine disposal requirements.
A draft Remedial Action Plan (RAP) must be submitted for NYSDEC approval to address the contamination around SB10.
The spill will require remediation to the extent that NYSDEC closes it with “no further action required.”
8.0 RECOMMENDATIONS
1. The Site owner (or owner’s representative) should report these findings to NYSDEC.
2. A Work Plan should be developed for NYSDEC approval to delineate the aerial and vertical extent of the spill that will require remediation.
3. Based on the delineation a draft Remedial Action Plan (RAP) must be developed to remediate the spill and obtain NYSDEC closure with “no further action required.”
4. For future subsurface disturbance during construction, the activities should be monitored with a radiation control technician (RCT) to maximize safety and waste management. Furthermore, if excess material is anticipated to be removed from the subsurface, then the RCT would allow for requisite sampling and analysis of the material to ensure proper disposal.
Sincerely, Peter S. Morton, P.G., C.P.G.

RE: Summary of Findings for Gamma Walkover Survey (GWS) – Terminal B Outer Harbor
Dear Jim, This letter presents a summary of findings for the GWS performed on August 27th through September 2nd, 2020. The survey was performed to assess whether the slag encountered at the site during a previous geotechnical investigation exhibits elevated gamma radiation, and if it does, then what is the significance of the radiation. In parallel with the GWS, additional borings were performed on-site, the material from which were also included in the gamma radiation surveys.
The approximately 10-acre area is located off Fuhrmann Blvd along the Outer Harbor in South Buffalo and consists mostly of open parking lot except for an approximately 100,000 SF building and a few small areas of greenscape (i.e., areas absent of asphalt, concrete, or other hard surface material). The focus area is a portion of a larger approximately 50-acre parcel listed as 901 Fuhrmann Blvd. The survey was performed using gamma scintillation system (GSS) equipped with GPS technology (i.e., Ludlum 2221/44-10 and Trimble Geo7X) to ensure that the results could be accurately mapped and illustrated clearly. The attached figures present the field data and its relation to background gamma radiation and statistical significance (e.g., mean, standard deviation, etc.). The following observations were noted:
• Source checks of the GSS were performed daily using a 1 µCi Cs-137 source. No issues were observed. The Trimble GPS worked without issue until some intermittent readings were observed on days 4 and 5. The communication issues did not affect the data.
• Background gamma radiation was performed daily on hardscape, soil, and gravel. No discernable fluctuations in readings were observed between the different media; therefore, the average site-wide background was calculated at 7400 counts per minute (cpm).
• The final gamma radiation statistics included a maximum of approximately 17,700 cpm, a…
