Addendum II: Terminal B Safety Improvements—Questions and Answers

This document is an Addendum II Q&A matrix issued by the Erie Canal Harbor Development Corporation (ECHDC), a subsidiary of the New York State Urban Development Corporation/Empire State Development (ESD), for the Terminal B Safety Improvements project located at 901 Fuhrmann Boulevard in Buffalo, New York. The project consists of two prime contracts: Contract 1 (Site Electrical and Lighting Upgrades) and Contract 2 (Site Construction and Structural Repairs), encompassing pavement rehabilitation, guardrail installation, concrete repairs, and site lighting upgrades at the Terminal B waterfront. The addendum clarifies 25 critical questions from prospective bidders regarding scope boundaries, technical specifications, permit responsibilities, and operational constraints. Key clarifications include: asphalt milling and overlay procedures with full-depth removal at specific locations; no bid bonds required; electrical work responsibilities assigned exclusively to Contract 1; liquidated damages set at $1,000 per calendar day; SPDES/SWPPP permit compliance managed by the Contractor with temporary erosion and sediment control measures per specifications; approximately 5-7 blackout/limited-activity days during summer event periods; and specific welding, joint sealant, and guardrail installation details with allowances for minor field adjustments to maintain positive drainage.

The addendum addresses technical specifications for wall caps, asphalt thickness requirements, concrete grade beam details, and guardrail panel attachment methods, with provisions for zinc solder/hot stick repair of galvanized surfaces affected by welding. Additional operational requirements include mandatory wheel wash systems, contractor-provided water supply, construction joint specifications, and prevailing wage compliance per New York State Labor Law without union affiliation or Project Labor Agreement requirements. The project includes Minority/Women Business Enterprise (MWBE) contracting goals totaling 30 percent and Service-Disabled Veteran-Owned Business (SDVOB) goals at 6 percent. No construction budget figure is disclosed, plan holder lists are not maintained, and all addenda are posted on the NYS Contract Reporter and ESD websites.

Terminal B Safety Improvements Invitation To Bidders

Release Date: June 30, 2026

The following is a list of questions submitted by prospective respondents and respective answers provided by the originating team:

Q&A Matrix

No. Questions Answers

1 On drawing L301 Site Sections detail #1 Site Section at Waterfront calls for mill and overlay of the existing pavement.

When referencing detail #3 on L301 far right states asphalt walkway (Detail L502/4). Please clarify if the existing pavement is to mill & overlay or per the asphalt walkway detail. If asphalt walkway is required, please provide location.

Existing asphalt is to be milled and overlaid per Detail 1/L301, except full-depth removal and restoration at the curb line and at grade beam/topping slab installation at the guardrail; balance of pavement is milled per Sheet C101. Detail 4/L502 identifies the full-depth asphalt walkway areas; addendum drawings clarifying extents are being issued with this response.

Notify the Owner's Representative if the existing asphalt base is unsuitable or disturbed beyond the planting-bed limits before proceeding with additional removal.

2 Are bid bonds required?

No.

3 Does the site construction package #2 include trenching/backfill for new conduits and hand holes? Or should the EC include any required site work for electrical?

Contract 2 – Site Work does not include work associated with the electrical installations. All excavation, trenching, bedding, backfill, compaction, conduit installation, handholes, pull boxes, and restoration required for the electrical service and site-lighting work shall be included under Contract 1 – Site Lighting and Electrical Upgrades.

4 Liquidated Damages conflicting information $1,000/day Specification 00 04 00, Or $5,000/day Specification 00 03 00 3.1 (h). Please review.

Liquidated damages are $1,000 per calendar day, per Specification Section 000004. Section 000003, Article 3.1(h) is being corrected by Addendum to match; the $5,000/day figure does not apply.

5 Who obtains any SPEDES/SWPPP permits and NYSDEC approval? No permit within the specification names the Owner.

No SWPPP will be filed for this project. The project will comply with the substantive erosion and sediment control requirements of NYSDEC SPDES General Permit GP-0-25-001, implemented and maintained by the Contractor per the Drawings and Specification Section 312500, and inspected per Sheet G001 Stormwater Pollution Prevention Notes. No post-construction (permanent) stormwater management practice is required. The Owner's Representative will obtain any required NYSDEC approvals applicable to the Owner's project scope; the Contractor is responsible for implementing and maintaining all temporary erosion and sediment control measures shown on the Drawings and specified in Section 312500. Sheet G001 and Section 312500 are being revised by Addendum to remove SWPPP-filing-specific language accordingly.

6 Are there any dates or events on which the work or deliveries cannot progress daily?

Yes, for both CLL-1 and CLL-2. ECHDC's event vendor/operator programs public events at Terminal B that periodically restrict construction, mainly weekends during the summer season. Anticipate approximately 5-7 blackout/limited-activity days (no-noise and/or limited parking/site access). The 2027 calendar has not been released; ECHDC will issue specific dates to both Contractors once available.

7 Is a field office for the Owner representatives required?

No.

8 Sheet S302 details of the proposed Wall Cap does not detail any welding of the bare shim plate to the galvanized Wall Cap, are these 2 components welded together?

Yes, provide 3/16" fillet weld on both sides.

9 Does the proposed 6” x ½” cover plate for the Quay Wall cap (detail S302) have to be shimmed out for a uniform plane, or is it just welded to the existing irregular sheet surface?

Yes, it should be uniform.

10 If above is yes. Have calculations been made for welding a galvanized 15” x ½” plate to existing ZP-38 sheet piling. We have concerns that weld areas will not flash or burn galvanizing on top surface.

What is the acceptance galvanizing touch-up or repair required?

Yes, it may burn some of the galvanizing. If so, it should be repaired with hot stick/zinc solder repair.

Slight warping or visibility of the weld is expected.

11 Can A588 Weathering Steel be considered for the Wall Cap?

a. Eliminates issues with welding galvanized products.

b. Once weathered, the cap would have same appearance of the existing sheets.

Provide zinc solder/hot stick repair. A588 may not be considered.

12 Does the point of connection of the Grade Beam and new Asphalt require a Joint Sealant, or Hot Tar Seal?

Yes. Provide a hot-applied bituminous joint sealant at the interface between concrete pavements, including the concrete grade beam/topping slab and the new asphalt pavement. The sealant shall comply with ASTM D6690, Type II or Type III, and shall be installed in accordance with the manufacturer’s requirements.

Generic hot tar is not acceptable.

13 Sheet L102 SITE GRADING PLAN – The milling of 1 ½” of existing asphalt with the proposed grades does not work in many locations to meet proposed grade thicknesses.

Please see review of grades at an existing Mooring Block which shows only 3/8” thickness of proposed asphalt.

The 1-1/2" milling depth is nominal; mill to the depth required to maintain the specified top-course thickness and positive drainage per the spot elevations on Sheet L102, generally matching the existing sheet-drainage pattern toward Lake Erie. Minor field adjustments are acceptable provided positive drainage is maintained, no ponding or abrupt transitions result, and asphalt is not feathered below minimum thickness. Geotechnical data (e.g., Boring B-3) confirms sufficient existing pavement depth for localized deeper milling where needed; notify the Owner's Representative if unsuitable base is encountered.

14 A wheel wash system is specified, only excavation is for planting boxes, and all spoils material stays on-site, is this necessary?

The wheel wash system is a standard BSA erosion and sediment control requirement. Accordingly, the project’s E&SC compliance requires that a wheel wash system be included and maintained for the duration of construction, regardless of whether excavated material is exported from the site.

15 Is there a hydrant for water usages on site?

No, assume contractor to provide water.

16 Is there any expansion required around Decorative Railing posts cast into the topping concrete?

Paint noted in Typical Guardrail Section on S302 should be mastic paint to provide a barrier betweent the post base and concrete.

17 Are joints (construction, or expansion) required for the Grade Beam and Topping Slab?

Provide construction joints per guardrail anchorage details on S302.

18 Please define work area of Alternate #S2 – Knee Wall Rehabilitation.

Is the limit of work the west wall of the Terminal “B” shell?

West wall within CLL-2 limits, all exposed faces.

19 Drawing S102 calls out for a 2” solid border frame for guardrail panel w/ artwork, how do these panels get attached?

Panels are welded to posts with 3/16" fillet welds per Typical Guardrail Section on S301

20 Detail on S301 that states a 3/16” weld on both sides, but with this being shop assembled and welded, this rail will warp due to the heat process of HDG.(of the panel) Can it be fastened another way?

We feel the top rail should be rigid enough as a 3/8" bent plate, but we would consider local PWHT to mitigate potential warping. OR the rail may be field welded and then hot stick galvanized locally afterwards.
