Justification and Approval for Other than Full and Open Competition

1. Contracting Activity:

National Guard Bureau Operational Contracting Division (NGB-AQ-C) 43200 Maple, Bldg. 105, Room 36 Selfridge ANGB, MI 48045

2. Description of Action: A firm fixed price construction contract which includes “Brand name only” components listed below, which will be awarded using O&M ARNG funding.

3. Description of Supplies/Services: Renovation of Ground West and One West at Herbert. R.

Temple Army Readiness Center, (TARC) in support of the Army National Guard in Arlington, Virginia includes the one (1) “Brand Name” components below:

a. Assa-Abloy Lock Cores. These are the door hardware lock cores required to be utilized throughout TARC Building One in order to comply and integrate with the current system utilized. The use of a single lock core enables the systematic management of the lock system at TARC. Providing a single lock core for all doors within the facility allows for single keying, a tracking mechanism, an emergency response master key to work properly in emergency situations for both security forces and fire department, and reduced maintenance and training costs for the Facility Management Office over the lifecycle of the building. The current government estimated direct material cost of the brand name component listed is .

4. Authority Cited: The statutory authority permitting Other than Full and Open Competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. It is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

5. Reason for Authority Cited: Maintenance and repair for the lock cores within TARC is brand name specific, and it is necessary to integrate the new doors into the building standard. If multiple brands were to be utilized, the end user of the facility would need to carry around multiple keys for each door and emergency responses could be delayed. The costs over the lifecycle of the facility would also be increased for maintenance as inventory would need to include all brand names.

6. Efforts to Obtain Competition: The solicitation is being issued as a total small business set aside construction contract. The brand name components represent a small portion (.001%) of the overall construction project that is being competed.

7. Actions to Increase Competition: None.

8. Market Research: The following market research techniques (FAR Part 10) were conducted within the previous 12 months:

The Technical Representative contacted knowledgeable individuals in the Government, including the Facility Manager, contractors currently supporting building operations, including facility maintenance, repair, and renovation individuals, and industry regarding the market capabilities to meet the requirements.

There are no known alternative systems that are fully compatible with the current lock system. This is based on lessons learned from previous similar construction projects, expert judgement by subject matter experts, and the experience of the ARNG staff.

9. Interested Sources: To date, no other sources have written to express an interest. There are no known alternative systems that are fully compatible with the aforementioned systems based upon lessons learned, expert judgement by the subject matter experts, and experience of the National Guard Bureau, and Army.

10. Other Facts: The selection of these systems has been used on all previous construction contracts accomplished at TARC for the ARNG. Consistency of the systems is required to:

a. Ensure facility security on the installation

b. Reduce maintenance costs over the lifecycle of the facility

c. Reduce response time in emergency situations

d. Reduce spare parts stock costs for ARNG
