About this file

This amendment modifies a solicitation for a dredging project to remove material from navigation channels in the Boston Harbor to authorized project depths. The project is being conducted by the US Army Corps of Engineers and involves removing material from the Main Ship Channel, Turning Basin, Reserved Channel, and President Roads Anchorage to depths of -49 feet or -42 feet mean lower low water as specified using drilling, blasting, and dredging methods. The amendment provides responses to bidder questions, updates the bidding schedule with revised pricing sheets, and references determination letters from the FAA regarding allowable work windows and durations for operating within restricted aviation zones. Bidders are advised that no additional compensation will be provided for impacts from aviation operations if work is not conducted in accordance with FAA restrictions, but that the specifications are revised to reference allowable work timeframes defined in the FAA letters.

SUMMARY OF CHANGES

AMENDMENT 0013 RFI’s

1. Per Amendment 4, RFI Answer no. 1 (attached) states: “Time allowed to award Option item 0006 will be reduced to 180 days. Note 6 is changed to update the number of calendar days from 365 to 180 days.” This is in reference to Note 6 on the bidding schedule.

I don’t believe we ever received an updated bidding schedule reflecting this change. Could you please advise if you will be including an amended bidding schedule in the forthcoming amendment, or advise if you would like us to modify Note 6 ourselves in our bid submittal?

GOVERNMENT RESPONSE: See attached updated Bidding Schedule.

2. The Government received a number of RFIs combined into one letter. The questions were extracted and the responses are listed below. The full letter can be found as Attachment 1 of this amendment.

After consideration of the information below, we strongly believe that the Corps will agree that it is neither fair nor in the Government’s interests to ask bidders to submit bid pricing until it has resolved the uncertainties created by the current IFB.

A. To remedy the issues detailed below, we request that the Corps (1) make available for bidders the historical data on the time associated with delays, disruptions, or stop work directions caused by aviation operations during performance of the Phase 2 Contract;

GOVERNMENT RESPONSE: USACE is in possession of daily dredge reports that indicate “Moving out of Way of Traffic,” which does not include air traffic; it is ship traffic only. Daily QA/QC reports may or may not include some description of air traffic considerations; however, USACE does not possess detailed information on historical time associated with air traffic considerations. Furthermore, they were not considered to be delays but rather a contract requirement for coordination.

B. (2) make available for bidders any data and information relating to differing site conditions encountered during the Phase 2 Contract (as reflected in a modification to that contract);

GOVERNMENT RESPONSE: No differing site conditions related to FAA Determination letters or Massport Aviation Operations coordination were reported by the Contractor during the Phase 2 contract.

C. (3) consider amending the IFB as follows (with the Corps to insert a reasonable and appropriate number of work stoppage days in lieu of the bracketed text in paragraph c):

GOVERNMENT RESPONSE: No work stoppage days will be inserted into the contract specifications.

D. (a) delete the following sentence from the Corps’ response to Q&A No. 4 in Amendment 0004: “There are no pre-determined allowable/approved timeframes and durations during which the contractor will be able to work uninterrupted within the Turning Basin and Massport Aviation zone”;

GOVERNMENT RESPONSE: USACE amends the response to read the following: “The Contractor shall refer to the FAA determination letters for reference to evaluate what pre-determined allowable/approved timeframes and durations exist during which the contractor will be able to work uninterrupted within the Turning Basin and Massport Aviation zone.”

E. (b) delete the following sentence in Section 01 11 00, Paragraph 1.7.4 (“Restricted Operations Associated with Logan Airport”): “Additional compensation will not be due to the Contractor for impacts to the work caused by Massport Aviation Operations;” and

(c) replace that sentence by adding the following sentences in the same location in Section 01 11 00, Paragraph 1.7.4: “Additional compensation will not be due to the Contractor for impacts to the work caused by Massport Aviation Operations where such impacts result from the Contractor’s failure to comply with conditions, restrictions, or limitations in the applicable FAA Determinations. If the Contractor is required to stop work due to any directions resulting from Logan Airport or Massport Aviation Operations, including instructions from BOS ATCT, and the cumulative amount of stop work time exceeds [X (reasonable and appropriate number)] stoppage days per piece of plant during the performance period, then the Government will issue a modification pursuant to the Changes clause at FAR 52.243-4 and issue an equitable adjustment to the price and performance period for any such impacts exceeding [X (reasonable and appropriate number)] stoppage days per piece of plant.”

GOVERNMENT RESPONSE: Specs will not be revised as suggested in the bidder’s comment. Please see clause 52.236-7 Permits and Responsibilities.
