PART 1 GENERAL

1.1 SUMMARY

The subsurface conditions in the dredge areas indicated in the specifications are the result of laboratory testing of samples from different reaches of the harbor. Attachment A is included as an attachment to these specifications. Attachment A includes data collected for the characterization of the lower harbor. Sample locations are presented on the contract drawings. The Contractor is responsible for reviewing the information contained in above documentation. Information is made available to Contractor for information purposes only and shall not be taken as warranty of site conditions.

The materials that exist in New Bedford / Fairhaven Harbor include both marine sediments and sediments and soils related to the last glacial period of the regions history and material related to the last post-glacial period of the regions history. As such, materials that exist in the harbor include:

o Marine Sediments (upper layer);

o Post-glacial sediments and soils (underlying the marine sediments); and o Glacial sediments and soils, which could include glacio-fluvial deposits as well as glacial till(deepest layers).

The materials to be dredged in the lower harbor are predominantly soft marine sediments consisting of organic silts (dark to light colored);

inorganic silts, clay, and some sand, pebbles, and cobbles. These sediments are contaminated with Toxic Substances Control Act (TSCA) level PCBs (50 ppm or greater). The deeper underlying sediments contain gravels, cobbles (75-305 millimeters), boulders (greater than 305 millimeters), and stiff, hard, gravely clays, which are not likely to be encountered.

An independent government contractor has conducted debris removal , however some debris may remain at or below the bottom of the harbor.

The contractor shall be prepared to excavate the full range of materials possible, including any remaining debris. Failure of the contractor to anticipate or be prepared for the varying subsurface conditions that exist within the Harbor shall not be cause for a claim of change in conditions of any kind.

1.2 SOIL CLASSIFICATION

The soil classification of the soil samples were performed by visual observation (ASTM D2488, Unified Soil Classification System). Core logs are provided in Attachment C.

1.3 INTERPRETATION

Subsurface investigation data are provided only for information purposes

DOCUMENT 00 32 00 Page 2 and for the convenience of the Contractor. No assurance is given that these conditions are representative of conditions in the dredge areas or areas adjacent thereto. The responsibility lies with the Contractor to interpret subsurface conditions that may affect his work.

1.4 LABORATORY TESTS

Laboratory tests of the samples were generally performed in accordance with the following test methods:

PCBs: SW846 8082A PCBs: Immunoassay (on-site lab analysis)

Note: Immunoassay was used for all samples collected since April 2014.

Approximately 10-20% of the samples were submitted to an off-site lab for verification.

SUMMARY OF WORK

11/12

PART 1 GENERAL

1.1 WORK COVERED BY CONTRACT DOCUMENTS

The general description below is given to indicate the approximate scope of this project only. It does not limit the work required under the project drawings and specifications.

Major work features include environmental dredging of polychlorinated biphenyl (PCB)-contaminated sediment (and metals, and hydrogen sulfide may be present in the sediment), transportation of sediment, and disposal of the sediment into an existing Confined Aquatic Disposal (CAD) cell. The cell was constructed in two phases as shown on the contract drawings. The Phase 2 portion of the cell will be used for this contract. Optional work items include the removal and disposal of the existing turbidity curtain at the CAD cell.

The work of this project consists of environmental dredging of the Lower Harbor of the New Bedford Harbor/Acushnet River in New Bedford, Massachusetts. Dredging in the Harbor shall be performed in portions of Dredge Areas 33, 34, 35, and 37, which have been subdivided into smaller areas as shown on the contract drawings. Expected dredged materials are described in section 00 32 00. Objects that cannot be removed with the environmental bucket shall be left in place and their position documented on Record Drawings. The government has completed debris removal (see Attachment E); however, some debris may still be present. It is the responsibility of the contractor to remove all debris encountered which can be removed with the environmental bucket. Typical debris encountered by the government in the lower harbor includes rocks, timbers, tires, anchors, concrete blocks, and steel pieces. Dredging will be conducted as outlined in Section 35 20 23. Dredge equipment requirements are detailed in Section 01 54 50.

The work includes temporary storage of dredged material in bottom-dump scows, transportation of the scows to the EPA CAD cell, decanting and carbon-filtering of standing water prior to discharge into the harbor, and placement of dredge material within the EPA CAD Cell, as outlined in Section 35 20 23. The Contractor must not allow the sediment in the scows to dry out, thus preventing an airborn dust problem.

The contractor shall conduct daily bathymetric surveys to confirm all target elevations have been met and to update the DBPS matrix file and will report to the government the amount of required material removed, overdepth material removed, and material removed below the allowable overdepth shown on the contract drawings in CY. No sounding information will be gathered from underneath existing structures (i.e. piers, wharfs). An independent government contractor will be conducting final acceptance surveys and payment surveys within ten days of the Contractor notification that an area will be completed.

See paragraph "1.3" in SECTION 00 80 00 - SPECIAL CONTRACT REQUIREMENTS for details regarding project schedule. The time stated for completion

SECTION 01 11 00 Page 2 shall include demobilaztion. See Paragraph "Work Sequence" in Section

01 11 00 SUMMARY OF WORK

Capping or other backfilling of the CAD cell is not included in this contract.

1.1.1 Quantity Determination and Breakdown

Volumes of material to be removed for each dredge area to reach the required dredge depths and the estimated total volume with 6" allowable overdepth volume are provided in the table below. This breakdown is furnished only to show the approximate distribution of material to be removed. The actual volume of dredge material removed will be calculated by comparing the pre-dredge bathymetric survey to the final post-dredge bathymetric survey. Contractor will be allowed to place the removed material and allowable overdepth volume in the CAD cell within the limitations spelled out in this subsection.

Dredge Verification Surveys will be performed by the Government to determine the accuracy of the contractor's dredging including the required dredge depth, allowable 6" overdepth, and dredging below the allowable overdepth.

Overdepth volume is generated when dredging extends more than 6 inches below the required dredge depth for any location in a dredge area.

Off-site disposal of the remainder of the sediment may be triggered at the discretion of the Contracting Officer if at any point the dredge verification survey shows the "Estimated Total Voume with 6" Allowable Overdepth (cubic yards)" is exceeded for any of the Dredge Areas listed in the table below, and upon such exceedance, the contractor shall prepare a Corrective Action Plan within two calendar days of notification by the Contracting Officer.

The Corrective Action Plan shall include proposed changes to operations required to remedy future over-depth dredging. The Contracting Officer may require the contractor to stop work at no expense to the Government if the plan is not submitted within one week or the plan is determined to be incomplete or unacceptable to the Government.

An Offsite Disposal Plan is included in the list of Preconstruction Submittals, Section 01 33 00. Details of the plan are addressed in Section 35 20 23, 1.5, SD-01 Preconstruction Submittals. Any plan that includes the use of contractor owned treatment facilities at the NBHSS site or Government property shall be approved in advance by the Government.

The following table lists estimated dredge volumes for each area based on cut depth. The volume quantities in the table below include both the required volume and a total allowable volume including six inches of overdepth volume for each of the dredge areas. A slope of 3H:1V has been assumed for overdepth transitions between differing elevations within a dredge area, based on observations from prior dredging in the harbor.

1.3 PROJECT/SITE CONDITIONS

1.3.1 Physical Data

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor. Additional detail on the site history, site conditions, and project activities are referenced in Section 01 42 00 (Foster Wheeler- 1990, 2002; Jacobs- 2015; EPA-2015)

a. Site Conditions: The indication of physical conditions on the contract drawings and in the specifications are the result of site investigations and surveys. The conditions represented prevailed at the time the investigations and surveys were made. A pre-dredge bathymetric survey will be performed by the Government prior to the start of Contractor dredging operations at the site. Before commencing work at the site, the Contractor shall verify the existing conditions indicated on the drawings and in the specifications. See CONTRACT CLAUSE entitled "SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK".

b. Tide Conditions: The Acushnet River is oriented north-south. The river is tidally influenced and the mean range of tide for the Acushnet River is 1.2 meters (3.9 feet) MLW to MHW. The site of the work is largely protected from wind and wave attack. The maximum current in New Bedford Harbor during flood and ebb is approximately 3.5 knots.

c. Conditions of Federal Channel: The Government will not restrict vessels from the existing channel, except to the extent specified in the specifications and to the extent of such regulations, if any, as may be prescribed by the Secretary of the Army, in accordance with the provisions of Section 7 of the River and Harbor Act approved 8 August 1917. The Contractor will be required to conduct the work in such a manner as to obstruct navigation as little as possible. In those instances where the Contractor's plant so obstructs the channel as to make difficult or endanger the passage of vessels, said plant shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage. Upon the completion of the work the Contractor shall promptly remove his plant, including ranges, buoys, piles, and other marks placed by him under the contract in navigable water or on the shore.

d. Channel Traffic: The traffic in New Bedford Harbor and through the barrier and bridges consists of pleasure boats, passenger and dry cargo vessels, tankers, motor vessels and fishing vessels. This traffic is not expected to cause unreasonable interference with the work.

e. Weather Conditions: The Contractor shall expect sub-freezing temperatures, adverse weather conditions at times during the performance period, and ice formations on the river in areas to be dredged. The contractor will be expected to break up any skim ice.

f. Turbidity Curtain Piles: The new turbidity curtain shall be anchored to the existing 12" wood Greenheart piles which are spaced

SECTION 01 11 00 Page 5 approximately 100' apart.

g. Debris removal has been performed by the government, however some debris may remain at the site (see Attachment E).

h. A double wall HDPE pipeline is routed at the surface from the Upper Harbor to the west side of the 195 bridge where it becomes submerged and anchored to the harbor bottom. The pipeline is 12-inch Schedule 80 SDR 13.5 HDPE x 18-inch Schedule 40 SDR 26 HDPE. The majority of this pipeline was permanently anchored to the bottom of the Harbor using a dual anchor system (one anchor on each side of the pipe connected by a nylon strap) at 42 foot spacing. ) The pipeline is located on the east side of the dredge work and crosses under the dredge work perpendicular to the navigation channel near the north end of the channel as shown on the contract drawings. The target sediment in the crossing of the work area shown on the drawings will be removed in the fall of 2016 by the Remedial Action Contract (RAC)contractor and the pipeline subsequently buried below final target elevation. The Contractor will not be impeded by the pipeline which will be in use by the (RAC) contractor working in the Upper Harbor. The P&S Contractor must not damage the pipeline under the pipeline corridor or the floating sections of the pipeline located to the east of the work area, see contract drawings.

i. Utilities in the harbor include water, sewer, gas, electric, and telecom. Available record information and utility drawings are provided in Attachment D.

j. Hardwood piles are used to anchor the turbidity curtain that surrounds the CAD Cell. Ten of these piles are inside of dredge area 35C which will require dredging around the piles, as described in Section 35 20 23, 3.1.2.

1.3.2 Coordination with Other Work

The Contractor for this work shall coordinate his construction activities with the other private entities conducting business operations in or adjacent to the harbor See Attachment B point-of-contact list for private entities and refer to contract drawings showing locations of private entities. The major ongoing activities by private businesses include scow island and the associated working docks owned by Tisbury Towing, docking of fishing vessels at Area D and along property south of Area D (Eastern Fisheries and Seawatch International), and any others. Scow Island consists of two derelict scows filled with junk and debris, located in the middle of the harbor just north of the phase 2 CAD Cell. The integrity of the scows is unknown; however, one of the scows does appear compromised as it lists to one side. Both scows have live vegetation growing on them. These scows will need to be moved in order to dredge the material beneath them. Area D is the dewatering facility used by the government to remove water from hydraulically dredged sediment from the upper Harbor, which is located opposite Dredge Area 35E. The City of New Bedford may also be using the Phase 1 or Phase 2 portion of the CAD cell to dispose of 27,000 cubic yards of sediment from another area in the harbor. Local government contacts are provided in 1.6.2 below.

The government will initiate coordination measures with the local governments regarding areas with ongoing activities that could interfere

SECTION 01 11 00 Page 6 with dredging, such as moorings (local harbor masters) and work on Route 6 (MassDOT). In case of dispute regarding work operations or the use of work areas, resolution will be by the Contracting Officer and his decision shall be final. No direct or extra compensation will be allowed on account of the coordination or cooperation required (see CONTRACT CLAUSE entitled

"OTHER CONTRACTS").

The Route 6 New Bedford-Fairhaven Bridge is a swing bridge that opens for traffic hailing VHF Ch. 13. The bridge opens daily at the top of the hour from 6:00 AM to 10:00AM and 15 minutes after the hour from 11:15 AM to 6:15 PM. After 6:15 PM the bridge is opened only on demand.

1.4 SEQUENCING AND SCHEDULING

1.4.1 Hours of Operations

The Contractor will be allowed to perform dredging operations 24 hours per day and may initiate sediment disposal from 6:00 AM to 10:00 PM , Monday - Saturday, excluding holidays, for the entire performance period.

Maintanence activities will be permitted on Sundays.

Work will not be performed on December 31 or July 4 as the harbor will be closed due to the holiday celebrations.

The exclusion of work on legal holidays has been considered in computing the performance of time in this contract. The following legal holidays are observed:

When one of the above designated legal holidays falls on a Sunday, the following Monday will be observed as the legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Requests to perform work during holidays shall be made in writing to the Contracting Officer. Work cannot be performed on December 31 or July 4 as the Harbor will be closed for the holiday celebrations.

1.4.2 Work Sequence

1.4.2.1 General

There are certain essential criteria relative to the preparation of a work sequence and time schedule which the Contractor will be required to implement and follow during the prosecution of the work. See Section 35 20 23 DREDGING for the required order of work. The Contractor shall dredge from higher elevation and progress toward the lower elevations in order to avoid sloughing into previously dredged areas. Isolated elevation peaks of a few inches or feet do not need to be dredged first. The high-to-low approach is intended to ensure dredging is progressing down the slopes rather than up the slopes. Dredging from top of slope down is intended as a residuals management practice. Some variations to this

SECTION 01 11 00 Page 7 top-down approach are acceptable depending on water depths, depth of cut, and number of passes.

Minor variations in the sequence of the items of work as approved may be made by the Contractor, provided such variations do not conflict with critical elements of the schedule. Proposed minor variations shall be noted on the progress charts submittal required by CONTRACT CLAUSE entitled "SCHEDULES FOR CONSTRUCTION CONTRACTS." Variations shall be approved by the Contracting Officer prior to implementation.

1.4.2.2 Progress Schedule

The initial project schedule shall be in the form of a chart graphically indicating the sequence proposed to accomplish each work feature or operation. The chart shall be prepared to show the starting and completion dates of all work features on a linear horizontal time scale beginning with date of Notice to Proceed and indicating calendar days to completion. The Contractor shall indicate on the chart the important work features or operations that are critical to the timely overall completion of the project. Key dates for such important work features and portions of work features are milestone dates and shall be so indicated on the chart. This schedule will be the medium through which the timeliness of the Contractor's construction effort is appraised.

1.4.2.3 Periodic Schedule Updates

An updated schedule showing actual progress shall be submitted monthly or with each pay request. Changes to the base-line schedule shall be outlined in a narrative describing the reason for the change.

1.4.3 Organization at the Site

1.4.3.1 General

The Contractor shall employ ample personnel and sufficient equipment to accomplish the work of this contract in the least amount of time, within the prosecution period specified in SPECIAL CONTRACT REQUIREMENTS, Paragraph 1.

1.4.3.2 Rate of Dredging Progress

Should the Contractor fail to maintain an average rate of 20,000 in-situ cubic yards per month, the Contracting Officer may require that additional personnel and equipment be placed on the job, in order that the work be brought up to schedule and maintained.

1.5 CONTRACTOR USE OF PREMISES

1.5.1 Work Limits

The limits of work consist of the Dredge Areas and CAD cell and any onshore staging areas procured by the Contractor as needed, as shown on the contract drawings and the navigable waters.

1.6.3 Archaelogy

1.6.3.1 Archaelogical and Paleontological Salvage

A. The Contractor's attention is directed to the United States Department of Transportation, Federal Highway Administration, Federal Aid Highway Program Manual, Volume 7, Chapter 7, Section 4, subject "Archaeological and Paleontological Salvage", incorporating Policy and Procedure Memorandum 20-7, dated March 31, 1979, and to the Commonwealth of Massachusetts, Acts of 1973, Chapter 1155.

B. In compliance with these procedures and legislation, the Contractor shall exercise special care during his operations to avoid injury to underground prehistoric and historic archaeological remains or paleontological remains. Should any archaeological or paleontological remains be encountered during any phase of construction, the Contractor shall immediately suspend all work in the area and shall notify the Contracting Officer. The Contracting Officer shall immediately notify the State Archaeologist and the Massachusetts Historical Commission. All construction work in that area will be temporarily delayed while the State Archaeologist and representatives of Massachusetts Historical Commission inspect the site to determine the importance of the discovery. Areas of prehistorical, historical, or paleontological significance shall be carefully protected in accordance with the above referenced manual and shall not be disturbed by the Contractor until so directed by the Contracting Officer. The Government has conducted prior archeological surveys in the harbor to clear the area prior to dredging, however the potential always exists to encounter artifacts

C. Contractor shall receive no extra compensation for such special care, unless said compensation is authorized in writing by the Contracting Officer as provided for in Article 7.04. Material from such areas shall be carefully protected, and if necessary to remove specimens, the Contractor shall do so only at the Engineer's direction, and after an authorized agent has witness or otherwise referenced their locations.

1.6.3.2 Salvaged Item

All items removed in order to perform the work, which are not considered archaeologically or paleontologically significant and not required to be replaced, shall, unless otherwise specified, be disposed in the CAD Cell or in a TSCA landfill as described in Section 00 80 00.

1.6.4 Aids to Navigation

Aids to navigation (beacons, buoys, markers, etc.) have been placed by the USCG in the vicinity of the project area. The Contractor shall not interfere with these aids to navigation. This does not relieve the Contractor from the obligation to furnish material conforming to the plans and specifications; will not prevent the Contracting Officer from requiring removal and replacement of nonconforming material incorporated in the work;

and does not relieve the Contractor of the requirement to furnish samples for testing by the Government laboratory or for check testing by the Government in those instances where the technical specifications so prescribe.

1.8 VARIATIONS

Variations from contract requirements require both Designer of Record (DOR) and Government approval pursuant to contract Clause FAR 52.236-21 and will be considered where advantageous to Government.

1.8.1 Considering Variations

Discussion with Contracting Officer prior to submission, after consulting with the DOR, will help ensure functional and quality requirements are met and minimize rejections and re-submittals. When contemplating a variation which results in lower cost, consider submission of the variation as a Value Engineering Change Proposal (VECP).

Specifically point out variations from contract requirements in transmittal letters. Failure to point out deviations may result in the Government requiring rejection and removal of such work at no additional cost to the Government.

1.8.2 Proposing Variations

When proposing variation, deliver written request to the Contracting Officer, with documentation of the nature and features of the variation and why the variation is desirable and beneficial to Government, including the DOR's written analysis and approval.
