SUMMARY OF CHANGES

The following have been added by full text:

REQUESTS FOR INFORMATION AND GOVERNMENT RESPONSES

1) When does the Government anticipate to issue the Notice to Proceed?

RESPONSE: The NTP is typically issued after Bonds are approved and the conclusion of the pre-construction conference, which is typically between 2-3 weeks after the award of the contract.

2) How long after the RFP due date does the Government anticipate to issue project Award?

RESPONSE: The Government intends to make a contract award prior to 30 September 2017.

However, this is not a guaranteed date.

3) Clause 52.236-4 is missing weather condition and transportation facility information.

Please revise the contractual documents if this information has been excluded in error.

RESPONSE: These elements were purposefully omitted as they are not applicable to this type of work.

4) Section 01 22 00, clause 1.4 states “the cost for installing a Type II turbidity curtain shall be included in the cost of dredging.”

a. Please specify the turbidity curtain details (dimensions, type, etc.) referenced in the above-quoted phrase.

RESPONSE: See Section 01 57 20, Section 2.1, as updated in Amendment 0004

b. Please specify if the Contractor is to procure turbidity curtain referenced in the above-quoted phrase.

RESPONSE: All costs for procuring to include the labor, equipment, and materials for installation and maintenance of the new turbidity curtain is to be captured in Bid Item No.

0001. Section 01 22 00, paragraph 1.4b, delete the sentence, “The cost for installing a Type II turbidity curtain shall be included in the cost of dredging.” Please see Amendment 0005 Specification Change Summary.

c. If the Contractor is to procure turbidity curtain referenced in the above-quoted phrase, please provide procurement quantities and turbidity curtain details.

RESPONSE: See Section 01 57 20.

5) Is the Contractor or the Government responsible for procuring the turbidity curtain referenced in Bid Items 0003AA and 0003AB?

RESPONSE: If the options are exercised, the Contractor is responsible for labor, equipment, and materials for installation and maintenance of the replacement turbidity curtain.

6) Are there any areas within the contractual documents, other than Bid Item 0003, in which the Contractor is to purchase turbidity curtain for replacement of the turbidity curtain that currently surrounds the Phase 1 and Phase II EPA CAD Cell disposal areas?

RESPONSE: Section 01 22 00, Paragraph 1.4a (Bid Item 0001) and 1.4d (0003AA and 0003AB) are the only bid items associated with the turbidity curtain that surrounds the EPA CAD Cell. Section 01 22 00, paragraph 1.4b was revised in Amendment 0004 to remove references to the turbidity curtain.

7) Section 01 22 00, clause 1.4a describes maintenance of the turbidity curtain, please provide examples of anticipated turbidity curtain maintenance so the Contractor can accurately provide pricing.

RESPONSE: Examples include but are not limited to adjusting the curtain to maintain straightness; making minor repairs to the floats, inspecting the curtain after a high wind or weather or ice event, documenting any damage to the curtain, and keeping the curtains tied and secured to the piles. However, it should be noted that the Contractor is responsible for ALL maintenance of the curtain.

8) Section 01 22 00, clause 1.4a states “all costs for labor, equipment, and materials for installation and maintenance of the turbidity curtain as defined in Section 01 57 20 ENVIRONMENTAL PROTECTION” Please confirm whether the Contractor will be responsible for removing the existing, in-place, turbidity curtain prior to installation of the turbidity curtain used under this Contract?

RESPONSE: The Contractor will not be responsible for removal of the existing turbidity curtain.

9) Section 01 57 20, clause 3.4.3c specifies that “all noises at commercial establishments located in principally residential neighborhoods that menace health, interrupt or disturb sleep of residents between the hours of 10:00 pm and 7:00am are hereby prohibited.” Are dredging activities allowed to be conducted by the Contractor between the hours of 10:00 pm and 7:00am?

RESPONSE: Yes.

10) Section 35 20 23, clause 1.8.3 describes existing adjacent property and structures and states “the Contractor shall conduct the dredging operations such that it does not undermine, weaken or otherwise impair existing structures located in or near the areas to be dredged.”

Is the offset distance between structures within dredge areas to be determined by the Contractor? If not, what is the dredging offset distance relative to structures within dredge areas?

RESPONSE: There is no offset distance from structures other than the existing piles

11) Section 35 20 23, clause 3.1.1 states that “each dredge area must be dredged as a whole before proceeding to the next area, to the extent practicable with regard to harbor activity and tides, to facilitate dredging to depth and completing surveys.” Should the dredging contractor expect to have at least two active dredge areas at any given time to accommodate dredging to depth, survey completion, and the Government’s anticipated survey timeline as defined in Section 01 72 30, clause 3.2.1?

RESPONSE: The Contractor is responsible for developing the order of work for completing the dredge areas in accordance with this requirement. The Government acknowledges that at some point in the progress of work, dredging in more than one dredge area at a time may be required.

12) Section 35 20 23, clause 3.1.1 states “periodically, after the decant water settles in the fixed bottom scow, the water shall be pumped through a water treatment system and discharged within the turbidity curtain that surrounds the EPA CAD Cell.”

a. Please define the meaning and intent of the word “periodically” in the above-quoted phrase.

RESPONSE: The Government anticipates that water will be required to be pumped through a water treatment system periodically. The frequency and how much water will be required to be pumped through the treatment system is dependent upon the amount of water generated by the Contractor during the dredging operation and the size of the Contractor’s water treatment equipment.

b. Must all of the “decanted water”, as used in the above phrase, be pumped through a water treatment system?

13) Section 35 20 23, clause 3.1.6 discusses EPA CAD Cell disposal conditions.

a. Has the Government taken material bulking into account when they designed and verified that the required dredging material could be placed in the EPA Cad Cell with the conditions as specified in Section 35 20 23, clause 3.1.6?

RESPONSE: See Amendment 0004 response to RFI number 18.

b. What is the material bulking rate the Government used when designing the disposal capacity and disposal conditions as defined in Section 35 20 23?

RESPONSE: See Amendment 0004, response to RFI number 18.

14) Section 01 22 00, clause 1.4b describes that payment for dredge material will be paid via volume computations conducted from survey of the dredge areas. Section 35 20 23, clause 3.1.6.1 states “any dredge material placed above the elevations shown in the contract drawing will not be paid for until it is relocated within the EPA CAD Cell to a suitable elevation.” Please clarify payment calculation criteria for Bid Item 0002?

RESPONSE: The Government will not provide payment for the volume of sediments that is placed above the maximum fill elevations, until the Contractor has relocated the sediments below the maximum fill elevation.

15) Section 01 11 00, clause 1.3.2 states “the City of New Bedford may also be using the Phase 1 or Phase 2 portion of the CAD cell to dispose of 27,000 cubic yards of sediment from another area in the harbor.” Further reductions in available EPA CAD Cell disposal quantity and available navigable depth will result in reduced Contractor efficiency.

a. Please specify the quantity of sediment the City of New Bedford will be disposing in Phase 1 of the EPA CAD Cell.

RESPONSE: At this time, the City of New Bedford does not have any dredging projects that require use of the CAD cell. If, during the course of this contract, the City of New Bedford has a project that will be disposing in the CAD cell, the City is allowed to dispose of 27,000 cubic yards of sediment in either Phase 1 or Phase 2 CAD Cell.

b. Please specify the quantity of sediment the City of New Bedford will be disposing in Phase 2 of the EPA CAD Cell.

RESPONSE: See Amendment 0005, response to RFI 15a.

16) Section 01 11 00, clause 1.4.1 states “the contractor will be allowed to perform dredging operations 24 hours per day and may initiate sediment disposal from 6:00 AM to 10:00 PM, Monday – Saturday, excluding holidays, for the entire performance period.” Is dredging allowed on Sundays?

RESPONSE: No dredging is allowed on Sundays.

17) Please define the vibracore soil testing methodology used to collect the soil cores provided in Attachment C of the Specification.

RESPONSE: Sediment cores were collected using either a push-core sampling device or a pneumatic vibracore and a 4-inch inner diameter clear polycarbonate core barrel. The collection mechanism is defined on the core log. Most of the cores were collected using the vibracore method.

18) The Contractor has received bore logs in Attachment C of the Specifications. Please provide any and all associated soil testing information including sieve curves, Atterburg limits, pictures of soil cores, blow count, etc.

RESPONSE: The sediment cores were sampled for PCB testing only. None of the cores were analyzed for geotechnical parameters. Photos of the sediment cores are provided under this Amendment 0005.

19) Section 00 32 00, clause 1.1 states “failure of the Contractor to anticipate or be prepared for the varying subsurface conditions that exist within the Harbor shall not be cause for a claim of change in conditions of any kind.” This quoted statement conflicts with the general conditions found in FAR 52.233-3 Differing Site Conditions, which is included in section 00700 of the contractual documents. If the Government places the burden of risk on the Contractor for variation in anticipated sediment, Contractor’s will have no choice but to add significant cost in anticipation of the unknown soils risk into their pricing. This pricing of risk will result in the Government paying potentially unnecessary costs which may never be realized. Therefore, we request the Government remove the following phrase from the contractual documents found in Section 00 32 00, clause 1.1: “failure of the Contractor to anticipate or be prepared for the varying subsurface conditions that exist within the Harbor shall not be cause for a claim of a change in conditions of any kind.”

RESPONSE: Section 00 32 00, paragraph 1.1 is revised to state, “failure of the Contractor to anticipate or be prepared for the varying subsurface conditions such as typical debris found in an active harbor, minor variations in the bathymetric surface, or other conditions as described herein that exist within the Harbor shall not be cause for a claim of change in conditions of any kind.”, Please see Amendment 0005 Specification Change Summary.

20) Section 35 20 23, clause 1.8.5.2 states that existing utility lines shall be protected from damage during dredging.

a. Is it the contactor’s responsibility to protect existing utility lines during dredging?

RESPONSE: Section 35 20 23, paragraph 1.8.5.2 is revised to state, “that existing utility lines shall not be damaged during dredging.” Please see Amendment 0005, Specification Change Summary.

b. What are the anticipated utility line protection methods anticipated to be used on this project?

RESPONSE: The contractor shall not damage the existing utility lines. The contractor may take measures to protect the existing utility lines if the contractor deems protective measures to be necessary.

21) Clause 52.211-10 states the Contractor is to “commence dredging and disposal operations no later than 60 calendar days after notice to proceed”. If Bid Option 0003AA and/ or 0003AAB is awarded:

a. Is the Contractor expected to shut down or delay dredge operations while the turbidity curtain is being replaced?

RESPONSE: Bid Option No. 0003 is for replacement of portions of the turbidity curtains installed by the Contractor at the beginning of the project that need replacement during the course of the dredging. See the Bidding Schedule’s note 2 which adds calendar days to the performance period when the respective options are exercised.

b. Has the duration to install the turbidity curtain and the Contractor’s inability to conduct disposal operations been taken into account when determining that the Contractor is to commence dredging and disposal operations no later than 60 calendar days after notice to proceed?

22) If the government has conducted a more recent bathymetric survey than shown in the contract drawings, can the Government supply the latest survey information?

RESPONSE: A recent bathymetric survey was included with Amendment No. 0004.

23) To allow for the Government to answer the above queries and queries raised during the prebid meeting, and to allow time for the Contractor to implement the Government’s answers into their pricing, this Contractor respectfully requests that the RFP submission deadline is extended to March 27, 2017.

RESPONSE: The RFP submission date is revised in Amendment 0005.

24) Section 35 20 23, clause 3.1.6.4 states “maximum elevation of material placed within the EPA CAD Cell shall not exceed the elevations shown in as-built drawing (Attachment F).”

“The volume to be removed under this contract is less than the total capacity of the CAD Cell and the finished grades shown are only for general guidance while placing material in the cell.”

Please provide the max fill level allowed under this contract? This information is essential for determining the equipment selected for disposal / towing operations.

RESPONSE: The maximum fill level of the CAD Cell is indicated in the bid drawings, Sheet Reference Number G-107.

25) Section 01 54 50, 1.3 states that offerors are required to provide a water treatment system to treat decant water from the bottom dump scows with filtration and carbon absorption. Offeror has not identified any water quality samples related to the chemical components of the discharge water.

a. What water quality standards are required for water discharging from the water treatment system?

RESPONSE: See SECTION 35 20 23, paragraph 3.1.5 Water Quality and Sampling.

b. Is there a NPDES permit for this project? If so, please provide.

RESPONSE: No.

26) With less than 10 calendars remaining before the proposal due date, offeror requests a two week extension to Tuesday, March 13.

RESPONSE: The Proposal due date is extended in Amendment No. 0005.

27) Section 01 11 00, clause 1.1.1 states that “overdepth volume is generated when dredging extends more than 6 inches below the required dredge depth for any location in a dredge area. Offsite disposal of the remainder of the sediment may be triggered at the discretion of the Contracting Officer if at any point the dredge verification survey shows the Estimated Total Volume with 6” Allowable Overdepth (cubic yards)’ is exceeded for any of the Dredge Areas listed in the table below, and upon such exceedance, the contractor shall prepare a Corrective Action Plan within two calendar days of notification by the Contracting Officer.”

The uncertainty and risk associated with the potential for offsite disposal for sediment removed more than 6 inches below the required dredge depth will result in significant cost contingencies to be included in Contractor’s bids. Because it is ambiguous from the specification whether the Contracting Officer will or will not direct off-site disposal for the exceedance material, Contractor’s are unable to bid on a definitive specification and thus will not be offering comparable prices for evaluation by the Government.

RESPONSE: The requirements of Section 01 11 00, paragraph 1.1.1 is unchanged.

28) Please define the term “remainder of the sediment” that the Contracting Officer may direct for off-site disposal. Please confirm that quantity directed for off-site disposal will be limited to the total amount of material that exceeds “the Total Volume with 6” Allowable Overdepth (cubic yards)” in the table? (e.g.

the amount over 169,043 cubic yards).

RESPONSE: See Amendment 0001, response to RFI No. 1A.

29) Please provide definitive criteria under which the Contractor Officer will or will not direct such upland disposal. If the capacity of the CAD cell Is greater than the total amount of material dug by the contractor, will the Contractor be allowed to continue placement of the “overdepth volume” in the CAD cell?

RESPONSE: See Amendment 0001, response to RFI No. 1A.

30) Section 01 72 30, clause 1.10 states that “In addition, the average sounding from each 3x3 Box will be saved in its actual location. This "3x3 minimum XYZ file" will be used as the basis for determining if the project depth has been achieved.”

Please confirm that the Minimum sounding from each 3’x3’ box will be used as the Basis for determining if the project depth has been achieved, rather than the Average sounding.

RESPONSE: See Amendment 0004, response to RFI No. 27.

31) Due to the variance between Minimum and Average bathymetric data sets when Calculating volumes, can the Government confirm that the volume calculation methodology used for determining the quantity of dredged sediments exceeding the 6” allowable overdepth will be the same method used as the basis for determining if the project depth has been achieved (e.g. 3’x3’minimum soundings)?

RESPONSE: See Amendment 0004, response to RFI No. 27.

32) Section 01 22 00 Measurement and Payment, Page 3, Part 1.4a Item No. 0001 Mobilization and Demobilization for Dredging Operations states: “All costs for labor, equipment, and materials for installation and maintenance of the turbidity curtains….”.

Part 1.4b Item No. 0002 Mechanical Dredging and Disposal; Materials from Dredge Areas 33-37 states:

“This item shall include all cost for inspection, minor adjustments and minor repairs of the turbidity curtain and oil boom….”.

The same item (Item No. 0002) also states; “The cost for installing a Type II turbidity curtain shall be included in the cost of dredging.”

In addition, Part 1.4d Item Nos. 0003AA and 0003AB Replacement of Turbidity Curtain states: “The contract price for the replacement of sections of the turbidity curtain will include acquisition, installation and maintenance of a new sections as needed and as specified in Attachment H.”

The items appear to be redundant with, at a minimum, maintenance and installation being required in all three bid items. We respectfully request that USACE clarify exactly what is being requested for each bid item with regard to purchase, installation, maintenance, inspection, minor adjustments and minor repairs.

RESPONSE: See Amendment 0005 response to RFI Nos. 4b and 5.

33) Please confirm that spudding will not be allowed within the EPA CAD Cell Phase I & II.

RESPONSE: See Amendment No. 0004, response to RFI No. 1.

34) Please provide the coordinates for the mooring piles located within the CAD Cells.

RESPONSE: The coordinates of the piles are provided in an attachment to Amendment 0005.

35) Will sloughing side slope volume be counted towards the unpaid overdepth exceedance and possible required corrective action?

RESPONSE: Yes, if there is excessive side slope sloughing which results in the contractor exceeding the overall disposal quantity, it would be considered an unpaid overdepth exceedance that could trigger a corrective action or offsite disposal at the contractor's expense. Sloughing should be minimized if the contractor follows the work sequences in Section 01 11 00 , paragraph 1.4.2.1.

36) After review of the Q&A section of addendum 4, could you please clarify the Government's answers to questions 14 and 20, relating to specific environmentally sealed bucket requirements? It would appear in question 14 that the Government will not allow a cable actuated bucket regardless of whether it is environmentally sealed or not. However, in the Government's response to question 20, the answer states that "…it was determined that mechanical dredging operation using a sealed environmental bucket (not a 'hydraulic bucket', as cited in the question) was necessary..." These two answers appear to be at odds with each other as it appears that neither a cable nor hydraulic bucket is permitted. This makes it unclear as to how the Government would like the contractor to interpret the bucket requirements.

If the contractor were able to provide a solution which involved a fully sealed environmental bucket which adhered to the requirements of the specifications but was cable actuated and suspended from a crane, would the Government accept this? At the deeper depths of this project, much greater accuracy both vertically and horizontally is attainable with a cable actuated environmentally sealed bucket suspended from a crane.

RESPONSE: See Section 01 54 50, Paragraph 1.3, and the responses to questions 14 and 20 in Amendment 0004. A cable actuated bucket suspended by a crane does not comply with the specifications.

37) In regards to Amendment #4 for the New Bedford project, RFI response #1 states; “the Government has installed additional piles from what is shown in the Specification’s Attachment H.” “The general location of the additional piles are shown on the attached drawing (released under this Amendment No.

0004)”.

The drawing titled “Phase_2_CAD_Cell_20170206_20FT_SMOOTH_SHEET-actual.pdf” does not show the general location of any piles. Is there an additional drawing that shows the locations that was not included with this Amendment?

RESPONSE: The coordinates for the piles are posted with Amendment 0005.

AMEND 0005 SPEC CHANGE

Specification Change Summary

1.1 CHANGES TO SPECIFICATIONS

1.1.1 Revised and Reissued Specification Sections

All costs for labor, equipment and materials for Item No. 0002 "Mechanical Dredging and Disposal; Material from Dredge Areas 33,34,35, and 37"(see table in Section 01 11 00, 1.1.1), shall include all cost for removal and disposal of dredged sediment, including suitable debris, from the designated dredge areas, as shown on the contract drawings and as specified in Section 35 20 23 DREDGING and other appropriate sections of the specifications.

This item shall include all cost for inspection, minor adjustments and minor repairs of the turbidity curtain and oil boom as defined in Section 01 57 20

ENVIRONMENTAL PROTECTION.

The amount of material removed under the contract for this item, will be measured as cubic yards in place. The volume will be determined by calculating the difference between the pre-dredge and post-dredge bathymetric survey, not to exceed the target depths represented on the plans.

The contract price for dredging for this item shall include the cost of removal and disposal of all materials as specified herein or indicated on the contract drawings, except ledge rock, large boulders, and other unclassified materials, which cannot be removed by the plant specified in the accepted bid. Should ledge rock or other material which cannot be removed by the plant specified in the accepted bid, or its equivalent be encountered the Contractor shall remove therefrom all overlying material which in the judgment of the Contracting Officer can be removed by the use of plant so specified or its equivalent. Removal and containerization of floating debris and treatment of decanted water from the scows, as discussed in later sections, shall be included in this price.

The contract drawings referenced in the Special Contract Requirements (Section 00 80 00), Paragraph "Contract Drawings, Maps and Specifications" are believed to accurately represent conditions existing on the date of the last bathymetric survey shown on the drawings, but the depths and the specific areas to be dredged shown thereon will be verified and corrected by a new survey taken by the Government within 6 months before dredging.

Existing conditions of material to be dredged are presented in Section 00 32 00.

A post-dredge bathymetric survey will be conducted within 10 days of being notified by the contractor that an area will be completed and ready for the final survey. The post dredge survey will be performed by an independent Government contractor under a separate contract at no cost to the Contractor. Determination of quantities removed after having once been made by the Contracting Officer, will not be reopened, except on evidence of collusion, fraud, or obvious error. The cost of preparing for and attending meetings shall be included in the cost of dredging. See Section 01 11 00, 1.8 for scope of meeting preparation.

2. Section 35 20 23, paragraph 1.8.5.2

The Contractor shall not damage existing utility lines that are shown on the drawings or the locations of which are made known to the Contractor prior to dredging, and that are to be retained.

If damaged, shall be satisfactorily repaired by the Contractor at no additional cost to the Government. Prior to commencement of dredging, the Contractor shall coordinate with the Contracting Officer and the applicable utility company to mark the exact locations of existing utilities, and establish in detail the proposed method of protecting the existing utilities. In the event that the Contractor damages any existing utility lines that are not shown on the drawings or the locations of which are not known to the Contractor, report thereof shall be made immediately to the Contracting Officer. If the Contracting Officer determines that repairs shall be made by the Contractor, such repairs will be ordered under the Contract Clause entitled "DIFFERING SITE

CONDITIONS.

3. Section 00 32 00, paragraph 1.1

The subsurface conditions in the dredge areas indicated in the specifications are the result of laboratory testing of samples from different reaches of the harbor. Attachment A is included as an attachment to these specifications. Attachment A includes data collected for the characterization of the lower harbor. Sample locations are presented on the contract drawings. The Contractor is responsible for reviewing the information contained in above documentation. Information is made available to Contractor for information purposes only and shall not be taken as warranty of site conditions. The materials that exist in New Bedford / Fairhaven Harbor include both marine sediments and sediments and soils related to the last glacial period of the regions history and material related to the last post-glacial period of the regions history. As such, materials that exist in the harbor include:

o Marine Sediments (upper layer);

o Post-glacial sediments and soils (underlying the marine sediments);

and o Glacial sediments and soils, which could include glacio-fluvial deposits as well as glacial till(deepest layers).

The materials to be dredged in the lower harbor are predominantly soft marine sediments consisting of organic silts (dark to light colored);

inorganic silts, clay, and some sand, pebbles, and cobbles. These sediments are contaminated with Toxic Substances Control Act (TSCA) level PCBs (50 ppm or greater). The deeper underlying sediments contain gravels, cobbles (75-305 millimeters), boulders (greater than

305 millimeters), and stiff, hard, gravely clays, which are not likely to be encountered.

An independent government contractor has conducted debris removal, however some debris may remain at or below the bottom of the harbor.

The contractor shall be prepared to excavate the full range of materials possible, including any remaining debris. Failure of the Contractor to anticipate or be prepared for the varying subsurface conditions such as typical debris found in an active harbor, minor variations in the bathymetric surface, or other conditions described herein that exist within the Harbor shall not be cause for a claim of change in conditions of any kind .
