Justification and Approval (J&A) for Other Than Full and Open Competition
I. Contracting Activity.
MARYLAND AIR NATIONAL GUARD - W912K6, 2701 EASTERN BLVD, MIDDLE RIVER, MD 21220
SOLICITATION W912K6-15-R-0002
II. Nature and/or description of the action being processed.
The 175th Wing Contracting Office intends to award a firm-fixed price contract. Under this contract, the Government is requires a sole-source to Advantor Systems for the intrusion detection system components for the new CYBER/ISR Facility. This portion of the construction effort will incorporate Advantor Systems access controls that are compatible with access controls already in place at the Maryland Air National Guard Base.
III. Description of supplies/services required to meet agency needs.
The Advantor Access Control System is the primary control system for base. This new project includes the removal and addition of several exterior doors which will require additional access control hardware. All of the Advantor premise control units and head end equipment will remain in place.
System Description Advantor will perform the following in conjunction with this project:
• Provide and install Automated Entry Control System Door hardware.
• Use existing Infraguard reader ports where available, or expand with new Infraguard panels as needed.
• Readers to be HSPD-12 compliant & CAC compatible HID RK.40 series readers.
• Locks to be suitable for door frame condition, to include rim strikes, electric strikes and/or electromagnetic locks.
• Egress devices and emergency bypass devices to be included as necessary.
• Provide and install HID RK 40 enrollment reader in SFS Pass and ID Office.
IV. Statutory authority permitting Other than Full and Open Competition.
10 U.S.C. 2304(c)(l)- Only one responsible source and no other supplies or services will satisfy agency requirements;
as implemented by Federal Acquisition Regulation 6.302-1. IA W FAR 8.405-6(a)(2), the award will be made for an item peculiar to one manufacturer and is essential to the Government's requirements, and market research indicates other companies' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
AFI 31-101 Integrated Defense Chap 6.3 Intrusion Detection Systems directs units to consider the compatibility of all new IDS with already installed equipment and the maintenance and operator training. Currently 100% of alarm monitoring and 70% of access control is via Advantor Systems Corporation. Advantor Systems Corporation installed the original security system, all upgrades and the current installation of IDS in ASA alert facility and maintains rights to ASN 5.0. The proprietary nature of this system (software/equipment) limits any other contractor from upgrading this system.
FAR 6.302-1 ( c) provides the use of brand name descriptions when the requirement can only be met by one brand name product. Advantor Systems is the company that has provided the system and installation of existing systems. Another manufacturers system would not compatible with the current Advantor system.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Solicitation from Advantor Systems Corporation is the only practical method due to the proprietary nature of the system.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
System upgrades at MD ANG as well as refurbishment of building and new construction that included Monaco systems were reviewed. In addition to the actions at MD ANG, several awards from other agencies were reviewed for the determination of fair and reasonable pricing for this action.
Justification and Approval (J&A) for Other Than Full and Open Competition
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was not conducted because of the following: AFI 31-10 I Integrated Defense Chap 6.3 Intrusion Detection Systems directs units to consider the compatibility of all new IDS with already installed equipment and the maintenance and operator training.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
Currently I 00% of alarm monitoring and 70% of access control is via Advantor Systems Corporation. Advantor Systems Corporation installed the original security system, all upgrades and the current installation of IDS in ASA alert facility and maintains rights to ASN 5.0. The proprietary nature of this system (software/equipment) limits any other contractor from upgrading this system.
X. List of sources, if any, that expressed interest in the acquisition.
Advantor Systems Corporation is the only known source for additional system integration and upgrade to the system that is presently in operation at the MD ANG.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
At this time, the 175th WG can take no action to overcome competition barriers due to the nature of the system (software/equipment) to be installed and the requirement that the warranty remain valid. If, in the future HQ AFSFC/SFXR selects alternate sources for approved fire systems and AFI compliance is maintained, the government will be in a better position to offer full and open competition for acquisitions of this nature.
It is the policy of this office to solicit for full an open competition to the fullest extent possible on all procurements.
The specific requirements for this acquisition can only be met by using other than full and open competition procedures.
