87 PWS, Section 3.17 Are these position exempt employees that are not part of the bargaining unit or are they considered Lead positions covered by the CBA?

CBA is Attachment 9 to the RFP. It is not up to the government to interpret the CBA. Compliance is offeror's responsibility.

88 PWS, Section 1.1 Can you please provide how many make-up training weekends were required for the past three years? What are the operating hours for these weekends?

See PWS 1.1

89 PWS, Section 5.40.2 Does this include government owned storage tanks and pumping systems? Yes 90 PWS, Section 5.40.2 Is the contractor responsible for costs associated with spills that are not caused by the direct negligence of the contractor?

No

91 We are confused and concerned about the application of Article 8, Health Benefits in the CBA. The CBA does not have a H&W hourly rate paid to employees for hours worked, it mandates the company provide Medical coverage for what can be interpreted as ALL CBA personnel regardless if they have coverage through their spouse or retired military etc. The current costs of that medical coverage found in the CBA for a Family plan is more than $20K a year per person versus what would normally be say $6.00 an hour worked for 2080 hours a year or over $12k/year. Our concern is that ONLY the incumbent knows exactly how this health benefit is applied to the current workforce (Single, Family, Spouse etc.) and is a distinct advantage to the incumbent. An example is that for ALL other offerors we will have to guess what the percentage of single versus family members breakout there is of the workforce.

The difference between the costs per person for Family Coverage to Single coverage is more than $13K per person per year for a large workforce. That can be hundreds of thousands of dollars per year difference between the incumbents price and other offerors because of their knowledge of this Health Benefit and how it applies to the workforce. This is an unfair and distinct advantage to the Incumbent. Please answer if this Article 8 Health Benefit is applied and paid/priced for ALL CBA personnel regardless if they already have Health Coverage either through their spouse or retired military etc. Secondly, please provide the percentage for each category for Type of Coverage as it applies to the current workforce. We are not asking for the number of people, we are asking for the percentage of Type of Coverage i.e. Employee =7%, Employee/Spouse = 18%, Employee/Child(ren) = 34% and Employee/Family = 41%

These are the percentages for the current Contractor under the CBA: Employee only:

34.34%, Employee & Spouse: 23.93%, Employee & Family: 33.62%, Employee & Child(ren): 8.11%

92 CBA Holiday Question. Based on the PWS it is clear there are only 10 Holidays.

However the CBA has 12 holidays which includes New Years Eve day and Christmas Eve day which from what we understand are normal working days for Fort Rucker correct? If that is the case then the contractor with the CBA that is in place is getting paid Overtime for its employees who work on NYE day and CE day when it is a normal day of operations for the Government. Please confirm that our understanding of this is correct. How does a contractor take off for 2 more holidays than the Base or Installation it is working on? Please confirm that this means that the contractor will have to pay overtime for employees working New Years Eve day and Christmas Eve day as the CBA states for working a holiday employee gets paid overtime.

Compliance is up to the contractor. The current CBA is applicable for the first year of the contract IAW the Department of Labor regulations and currently ends August 2018, at which time the follow-on contractor would negotiate it's own, if applicable.
