SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been modified:

INSTRUCTIONS TO OFFERORS

General Instructions

a. The selection of a source shall be conducted using Lowest Price Technically Acceptable (LPTA) approach in accordance with Federal Acquisition Regulation (FAR) 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Offers will be evaluated using the criteria under Section M, “Evaluation Factors for Award.” Noncompliance with the Request for Proposal (RFP) requirements may hamper the Government's ability to properly evaluate the proposal and may result in elimination of the proposal from further consideration for contract award.

b. The Offer. The submission of the documentation specified below will constitute the offeror's acceptance of the terms and conditions of the RFP, concurrence with the Performance

Work Statement (PWS), and contract type.

c. It is the Government’s intention to award without discussions. Offerors are encouraged to present their best technical proposal and prices in their initial proposal submission. However, in accordance with FAR Part 15.306 (Exchanges with Offerors After Receipt of Proposals), should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and Offerors notified. The contracting officer may establish a competitive range if warranted in accordance with Department of Education regulations codified at Title 34, Code of Federal Regulations, 395.33 as implemented in AR 210- 25.

d. Instructions outlined below prescribe the format for the proposal and describe the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals.

e. If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the offeror shall immediately notify the KO in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

f. In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.

g. All referenced documents for this solicitation are available on the Federal Business Opportunities (FBO.GOV) website at https://www.fbo.gov . Potential offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.

h. Debriefings. The KO will promptly notify offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR 15.505. The KO will notify offerors who were in the competitive range of the source but were not selected for award in accordance with FAR 15.503(b). Upon such notification, unsuccessful offerors may request and receive a debriefing in accordance with the requirements of FAR 15.506.

i. NOTICE OF APPLICABILITY OF RANDOLPH SHEPPARD ACT

All Offerors are hereby advised that this solicitation is subject to the exercise of certain Defense preference policies regarding the Randolph-Sheppard Act (20 U.S.C. 107) (RSA) as related to Offerors of military food services. Present DoD and Army policy interpreting the RSA applies a selection preference to qualified nominees of SLAs for the Blind who represent clients seeking Defense contracts for so-called “military cafeteria-style food operations.”

https://www.fbo.gov/

This notice is not designed to discourage competition from any small business Offerors interested in this requirement. Rather, it merely represents notice regarding a mandatory priority for the SLA’s proposal in the event that an offer from such source is received.

The solicitation is a competitive 100% EDWOSB set-aside, but also permits the SLA, which may not be considered a Small Business concern, to participate in the procurement. The priority embodied in the RSA takes precedence over small business preferences. Therefore, once the SLA’s proposal is determined to be technically acceptable, in accordance with the RSA, the Government will award the contract to the SLA (subject to price negotiations, if appropriate, to establish “comparable cost”). The SLA will be required to provide a subcontracting plan to afford small business an opportunity to perform aspects of the requirement. It is the Government’s intent to award without discussions.

Proposal Submission, Preparation Instructions, and Content. The following instructions prescribe the format for the proposal and describe the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals.
