About this file
This document is a Sole Source Procurement Authorization form from the Arizona Department of Administration, State Procurement Office, specifically for the Arizona Department of Child Safety (ADCS). The procurement involves ACTION for Child Protection, a company located in Charlotte, NC, as the sole source vendor for the Family Connections Ongoing Implementation program.
The contract is for a four-year term from 7/10/2025 to 7/09/2029, with a total estimated cost of $2 million ($500,000 per year). ACTION for Child Protection is the sole source because they hold the trademark and copyright for the Family Connections program, and are considered the subject matter experts. ADCS conducted a Sole Source Procurement Notice (BPM006981) to verify no alternative sources existed, and determined that other potential vendors could not meet the specific requirements. The procurement is justified by ACTION's unique position as the only contractor able to provide technical assistance and e-learning licenses for implementing the Family Connections program in Arizona.

SECTION III - Justification
12. Rationale
13. Provide details of the procurement need, reason for the single source, and how the proposed procurement is advantageous to the State
The Family Connections program Developer is ACTION for Child Protection, ("ACTION") who are considered the subject matter experts. ACTION for Child Protection holds the trademark and copyright for the Family Connections program; which is implemented in Arizona, for families involved with ADCS. ACTION for Child Protection is the only contractor able to offer technical assistance and the required e-learning licenses in order to continue to implement the program for ADCS. No other provider has been found with this knowledge, experience, capability or authority to assist ADCS.
Based on the knowledge of the curriculum and requirements, and the experience of ACTION for Child Protection in implementation, it is in the best interest of the State to continue to utilize the existing, knowledgeable resource to facilitate the implementation and sustainability in ADCS.
‐ There is only a single source for the material(s) or service(s)

14. Describe the procurement process, efforts to locate other sources/evidence of one source, and determination that the price is fair and reasonable. Include the sole source notice and number (BPM00XXXX) and attach a copy to the determination.
15. A notice was posted in the State's eProcurement system to registered vendors with an invite to comment on the sole-source request for three
(3) working days, and it was determined that no reasonable alternative source exists for the procurement need. A copy of the notice is attached.
16. Signature 17. Date of Request
In accordance with the Procurement Rules, the Arizona Uniform Terms and Conditions must be made a part of all Contracts. If you will be required to sign a software licensing agreement or sign any other agreement containing terms and conditions, these will need additional review to ensure that the terms and conditions do not invalidate the Arizona Uniform Terms and Conditions. Approval of this request does not allow for agencies to exceed their dollar acquisition amount of delegated authority.
The current State contracted vendors for consultation services are unable to meet this need.
ADCS then issued a Sole Source Procurement Notice, BPM006981, on 6/4/2025 at 10:47AM to confirm that this is indeed a Sole Source procurement. Responses were due by 6/9/2025 by 12:00PM Arizona Time. ADCS specifically asked in APP "Can you meet and provide the stated requirements? If the answer is "Yes", please attach any supporting documentation of your ability to meet the State's requirements". All About Kids and QUINQUE LLC both submitted a response, indicating they could perform the requirements outlined in the Sole Source. Upon review, it was determined that both offerors could not meet the requirements, did not provide supporting documentation on if they were a recognized developer or subject matter expert from the Developers of Family Connections pursuant to the scope of work section 3.2 and did not demonstrate it is the sole proprietor of Family Connections by providing evidence that the Contractor holds the copyright or trademark, pursuant to scope of work section 3.3.
Based on the finding of the Sole Source Notice, ADCS proposes ACTION for Child Protection as the most qualified vendor to contract for this project.
ADCS will approach the vendor to outline a scope of work with time-based deliverables and negotiate a fair, equitable and reasonable price for services.
