C.1.0 INTRODUCTION: This Performance Work Statement (PWS) is the Government’s contracted requirement for fuel services at White Sands Missile Range, New Mexico (WSMR, NM).
Definitions, abbreviations, and acronyms lists are found in Appendices A through C, respectively.
C.2.0 BACKGROUND: WSMR is the largest military installation in the United States with 3,200 square miles of restricted land and 7,000 square miles of restricted air space. It is located in the Tularosa Basin of South Central New Mexico. The headquarters is 20 miles east of Las Cruces, New Mexico and 45 miles north of El Paso, Texas.
C.2.1 Terminal Statement: The primary mission is to conduct weapon system test and evaluation to include, but not limited to, rockets and missiles in support of all military branches. The three bulk retail fuel facilities were historically Government Owned and Government Operated (GOGO). WSMR provides support to all assigned and transient unit ground vehicles and aircraft.
C.2.2 Mission Statement: The Contractor shall provide Contractor-Owned, Contractor- Operated (COCO) bulk retail and alongside aircraft refueling services at WSMR. The Contractor shall also be responsible for Above Ground Storage Tanks (ASTs) and associated systems to all sites as determined by WSMR and assume operation and maintenance of these ASTs Specific requirements for each site are listed in Appendix E.
C.3.0 SCOPE: The Contractor shall perform services to include fuel operations, support operations, and management and administration pertaining to the receipt, storage and handling, and issue of DLA Energy fuel products.
C.3.1 Facility Goals: The Contractor shall provide all manpower, equipment, and material resources as necessary to provide these services. No DLA Energy facilities are available for use at this location.
All facilities, equipment or materials furnished by the Contractor shall be suitable for retail/bulk dispensing of military fuel Aviation Grade F24, commercial gasoline, and commercial diesel products.
The Contractor’s technical proposal will identify the type of material that will be used throughout the fuel distribution system. The services are required to be operational beginning six months after award of contract.
C.3.2 Tank Requirements: All tanks and facilities used to provide the services shall meet the requirements of the current American Petroleum Institute (API) Standards, United Facilities Code (UFC), National Fire Protection Association (NFPA) Codes, National Electric Codes, and all local, (to include WSMR Installation Design Guide), state, federal laws (including but not limited to 40 CFR 280, 281 and 112) and regulations applicable to tanks and facilities of the type utilized. These facilities shall meet best commercial standards with components and fixtures that allow proper service interface with military tactical and non-tactical vehicles and equipment. The Contractor shall be responsible for obtaining all permits necessary for operating, and constructing these facilities, including, but not limited to hot work permits, dig permits, tank registrations, air emission permits, erosion and sediment control, underground injection control or sanitary permits, storm water discharge, and aboveground storage tanks when required. The Contractor shall be responsible for obtaining all inspections by state and local authorities addressing fire and electrical codes prior to operation. A copy of all environmental permits when issued new or upon update will be provided to the White Sands Missile Range Directorate of Public Works, Environmental Division.
C.4.0 APPLICABLE DIRECTIVES: The Contractor shall comply with applicable statutory and regulatory requirements and validated best commercial practices. This requirement applies to all performance criteria and deliverables set forth in this document. Appendix C provides a list of directives and other guidance that are applicable to the performance of this contract. The list is not all inclusive. In the event of conflicting guidance, contact the Contracting Officer (CO) and/or the Contracting Officer’s Representative (COR) for clarification.
C.5.0 PERFORMANCE REQUIREMENTS: The performance requirements are organized into a Performance Requirements Summary Table and described as “tasks”, “performance standards” and related metrics Appendix D. The Contractor shall provide Fuel Operations, Support Operations, and Management and Administration as follows:
C.5.1 Fuel Operations: The Contractor shall safely receive, store and handle, and issue fuel. Fuel Operations shall be specific for WSMR, and shall include local operating instructions. During operations, fuel quality shall be maintained at all times. The fuel shall be accounted for by quantity received, stored, and issued according to directives and acceptable tolerance levels. The Contractor shall immediately notify the COR or designated office of any issues that impact the quality, quantity, or availability of fuel in storage.
C.5.1.1 Receive Fuel: The Contractor shall at all times safely receive product without causing delay, interruption, or demurrage. This applies to response times for duty hours, non-duty hours, and extended surge operations at WSMR, NM. Site-specific response times and duty hours are in Appendix E.
C.5.1.2 Issue Fuel: The Contractor shall at all-times safely issue fuel without causing delay, interruption or demurrage. This applies to response times for duty hours, non-duty hours and extended surge operations at WSMR. Site-specific response times and duty hours are in Appendix E. Except for scheduled maintenance, and other occurrences of which the DLA Energy has been notified, the Contractor shall maintain a tank in the ready-to-issue mode for bulk and retail dispensing 24/7. The Contractor shall coordinate bulk issues directly with receiving customers within duty hours outlined in Appendix E. The Contractor’s bid includes the Overtime cost and is not a reimbursable item under the terms of this contract. It is the Contractor’s responsibility to manage their employees schedule IOT meet the requirements detailed IAW the PWS. The notification to the Contracting Officer is only for informational purpose.
C.5.1.3 Product Receipts: The Contractor shall receive all fuel via commercial fuel tanker trucks without causing operational delays or traffic congestion. The Contractor will order fuel using the appropriate DLA system. The Contractor shall immediately notify the DLA Energy Region office of any inventory/quantity discrepancies or the DLA Energy Quality Assurance Representative (QAR) and Army Petroleum Center (APC) of any quality discrepancies. All incoming product shall be sampled in accordance with the most current version of MIL STD 3004. Quantity determination shall be performed as outlined in DLA Energy DoD Manual 4140.25 Interim Policy P-2 and API Manual of Petroleum Measurement Standards (MPMS).
The Contractor shall accomplish and submit all appropriate documentation to the DLA Energy Regional Office. The Contractor shall not receive or dispense fuel from the same truck simultaneously.
C.5.1.4 Ground Fuel Operations: The Contractor will perform all fuel operations, inventory management, quality surveillance, organizational level maintenance, training, safety and environmental protection functions at the ground fuel sites listed in Appendix E. The service stations will provide fuel support to authorized reimbursable Defense Working Capital Fund (DWCF) customers that have approved DLA –Energy purchase devices or have an assigned DODAAC, FEDAAC or "2A"
DODAAC.
C.5.1.5 Bulk Fuel Operations: The Contractor will perform all fuel operations, inventory management, quality surveillance, organizational level maintenance, training, safety, and environmental protection functions at bulk storage sites listed in Appendix E.
C.5.1.6 Aviation Fuel Operations: The Contractor shall support home station and transient aircraft with refueling and defueling operations. The Contractor shall post a list of contact numbers for emergencies and after hour's bulk top-offs. Contractor will issue fuel to US Aircraft using the aircraft’s AIR Card.
Non-US aircraft will be issued fuel using the organizations 2A-DoDAAC. In accordance with DLA Energy Interim Policy P-6 non U.S. government aircraft may be eligible for receiving fuel. Requests to issue fuel to these aircraft must be coordinated through the Contractor Officer Representative (COR).
1. The Contractor will provide sufficient numbers of mobile aircraft refueler/defuelers to support each AAF/AHP listed in Appendix E.
a. Vehicles must be serviceable and of such a condition as to be expected to perform successfully for the life of the contract, additionally vehicles will be in serviceable condition and capable of meeting host country and US operating procedures.
b. The Contractor will be responsible for all Contractor Furnished Equipment (CFE) vehicle maintenance for the life of the contract. Maintenance downtime for Contractor furnished vehicles does not relieve the Contractor of meeting the full requirements of this contract.
2. The Contractor shall comply with aircraft refueling procedures and requirements outlined in this document and applicable references listed in Appendix C. The Contractor shall ensure that the operational portion of their Airfield Operations Plan details instructions to complete aircraft fuel servicing. This includes the Contractor completing all necessary (grounding, bonding, fueling equipment, nozzle, etc.) connections for aircraft servicing. The only exception for the fueling equipment nozzle connection is when an authorized/trained crew member/customer requests only that the crew member make the nozzle connection. If there is a discrepancy between any references listed in Appendix C, the most stringent standard will apply and any noted discrepancies will be brought to the attention of the COR and/or the Contracting Officer immediately for resolution.
3. As outlined in Appendix E, Operating hours, the Contractor shall be capable of providing fuel services to station and transient aircraft 24 hours a day. Each request for fuel services shall result in the dispatch and arrival of a fuel servicing truck/operator to the aircraft identified by the requester within 20 minutes. If a request for services is for multiple aircraft, the Contractor shall respond to any subsequent requests for refueling in the order prioritized by the Airfield operations center (AIROPS). Upon receiving a request from the Airfield operations center to service additional aircraft while the Contractor is responding to an earlier service request, the Contractor is required to affirmatively request clarification of service priorities from the AIROPS. In response to pre-scheduled services, the Contractor shall be physically present on site at the time the aircraft to be serviced arrives at the designated refueling pit. Driver and operators shall not interrupt the flow of work, i.e., service aircraft to which they are not directed, without approval by the dispatch center, nor shall they interrupt servicing operations for rest or meal breaks without proper relief or explicit approval of the fuel dispatch center. On arriving at an aircraft, operators shall take all steps and precautions necessary to service the aircraft in accordance with WSMR Manual [please correct if needed]. Service response times in excess of this requirement shall be fully and accurately recorded and explained in the dispatch pass down log and management reports.
Truck refueling shall have the capability to meet a 20 minute response time in support of all aircraft outlined in Appendix E. Refueling vehicles shall be capable of both over-wing and under-wing refueling. Refueling and defueling shall not be conducted with the same vehicle as the Contractor must have a dedicated defueling capability. The Contractor will conduct Aqua- Glo testing daily as part of pre-operational checks for refuelers used in the execution of along-side aircraft refueling. Each airfield will require, on average, 10 non-aircraft fuel servicing sales of F24 (50-300 gallons each) monthly for supporting operations (i.e. - test engine, AGPU, etc.)
that are only to be conducted on improved surfaces within the airfield boundary and within DLA Energy Policies and Procedures.
4. The Contractor’s proposal and follow-on aviation refueling plan shall address which publication within Appendix C is to be followed for aircraft refueling procedures. For example, when detailing number of personnel required for cold aircraft refueling, FM 10-67-1 details that two personnel are required for each refuel operation; one to tend the pump and one to tend the nozzle. However, NFPA 407 only requires one person (Contractor) to be present from a tank vehicle when an operational dead man control is in use. Regardless of publication chosen, Contractor will apply grounding procedures as stated in FM 10-67-1 for parking of all tank vehicles and for all aviation refueling operations. Refueling operations are not permitted without an aircrew member who is familiar with refueling procedures for the aircraft being serviced present.
C.5.1.7 Issue Fuel (F24) to Aircraft: Alongside aircraft refueling services for Department of Defense (DoD) transient helicopter and small fixed-wing aircraft is required during the designated issue hours and days outlined in Appendix E. The “Main Post” and “Stallion Range Center (SRC)”, with one Contractor provided aircraft refueling vehicle stationed at each location.
a. Aircraft refueling vehicles shall be a minimum of 2,000 US Gallon capacities with single point and over wing (hand dispensing nozzle) issue capability. The vehicles shall comply with commercial, federal and state Department of Transportation (DoT) standards for transport and issue of aviation petroleum products.
b. Aircraft refueling services shall include connection of the single point nozzle to the aircraft
(or operating the over wing hand dispensing nozzle), disconnection of the nozzle after the refueling operation, and completion of fuel issue documentation (DD-1898, Aviation Fuels Into-Plane Sales Slip). Refueling services shall be performed in accordance with commercial standards, aircraft type servicing manual, and airfield operations procedures. Servicing shall not include aircraft handling operations such as ground taxi, parking, chocking, etc.
c. Main Post and SRC averages 30 aircraft issues per month with average issue of 125 gallons
(estimated less than 5,000 US Gallon total issued per month).
C.5.1.8 Custody and Risk of Loss: Custody and risk of loss is as stated unless otherwise agreed upon.
a. Transport Truck Receipts: Custody and risk of loss shall pass from the carrier to the Contractor when the product passes from the truck discharge hoses into the Contractor receiving facility.
b. Custody of loss and risk of loss shall pass from the Contractor to the customer when the issue nozzle is removed from the pump by the customer to initiate fuel flow.
c. Remote Refueling: Contractor will provide saddle tanks, pods and or 6x6 trucks to support outside exercises. Contractor will supply/transport fuel from main post bulk facility to Rhodes Canyon as needed due to remoteness of site. Pods need the ability to dispense retail fuel.
Currently there are 11 -15 (500 USG) pods in operation on any normal business day at WSMR. Pods need the ability to dispense retail fuel.
C.5.1.9 Store and Handle Fuel: The Contractor shall at all times safely maintain product quantity, quality, and availability to meet its intended use. The Contractor shall maintain the product storage facilities, as well as maintain product stock levels required to support the mission and planning requirements, within allowable limits.
C.5.1.10 Transfers: When directed by the DLA Energy Contracting Officer or as required for normal operations, the Contractor shall transfer product between tanks to consolidate types or grades. The responsibility for preventing commingling or contamination rests with the Contractor.
C.5.1.11 Additives: When directed by [ the Contracting Officer as an in-scope change to the contract], the Contractor shall purchase, store, maintain, and inject fuel additives in accordance with the contract requirements.
[The contractor shall submit a request for equitable adjustment in accordance with Clause 52.212-4 of the contract.] All procedures for systems operation, storage, maintenance, and injection of additives shall be in accordance with the Contractor Product Quality Control Plan (PQCP).
C.5.1.12 Automated Dispensing System Key Management (Fuel Master®): The WSMR COR shall provide the Contractor with a complete data list of vehicles and equipment that is authorized key access to automated fuel dispensing facilities. The list shall include all information required for the Contractor input to the Fuel Master database. The Automated facility shall consist of latest version of DOD standard source data collection equipment (Fuel Master) and shall be designed to interface all receipts, retail issues and accounting transactions to Fuels Manager Defense (FMD).
a. The Contractor shall be responsible for receiving, maintaining, issuing, reprogramming and revoking keys as requested in writing from the WSMR COR and in accordance with DLA Energy P-5. The Contractor shall issue replacement keys within two working days after receiving the written request from the COR, and the same day for emergencies as directed by the COR. Request for replacement keys shall be verified by signature of the COR. Additional keys shall be provided to the Contractor in accordance with the ordering instruction listed in DLA Energy P-5.
b. The Contractor shall maintain databases as necessary to provide all reports required by the contract, including but not limited to, customer account numbers, responsible office for key/card holders, key/card serial numbers, and other key/card information. The Contractor shall provide required reports as prescribed by the Contracting Officer.
C.5.1.13 Billing: Unless otherwise directed, the Contractor shall process all transactions IAW DoD 4140.25-M and other applicable guidance into the Fuels Automated System or other approved DLA Energy system on a daily basis as outlined in the hours of operation set forth in Appendix E.
Transactions from weekends or holidays will be processed the next normal duty day.
C.5.1.14 Fuel Quality: The Contractor shall at all times safely ensure product quality according to applicable product specifications, MIL-STD 3004 and the Product Quality Control Plan (PQCP).
Quality control will be performed in accordance with the most current version of MIL STD 3004 and those additional tests listed in paragraph C.5.1.4.2. No petroleum product shall be received or issued until product quality determinations have confirmed conformance with specifications. The Contractor shall ship those requiring analysis to the Army fuels laboratory in New Cumberland, PA. Samples shall be shipped within 72 hours of being drawn.
C.5.1.15 Additional Samples: The Contractor shall provide to a certified lab, the following representative samples of any product being stored, shipped, or received under the contract, at the request of, and in the manner designated by the QAR or COR. These samples shall be provided in addition to samples required elsewhere in the contract and referenced in the PQCP. The packing, marking, shipping, and the associated costs, shall be the responsibility of the Contractor, except that direct shipping costs are eligible for reimbursement from the DLA Energy Contracting Officer.

The COR, APC and DLA Energy QAR shall be notified immediately of any suspected fuel quality issues prior to fuel receipts, transfers or issues. Product will be re-circulated daily through dispensing system to ensure lines are flushed. The Contractor shall take retention samples when directed by the Contract Officer. Samples representing receipts of capitalized products shall be properly marked by the Contractor as to product, source, and date taken for retention as determined by the COR/QAR.
C.5.1.16 Account for Fuel: The Contractor shall account for fuel according to DoD 4140.25-M “Management of Bulk Petroleum Products, Natural Gas, and Coal, and other applicable policies and procedures. Physical inventory management shall include:
a. Documenting each order, receipt, transfer, sale, loss, credit, gain, and adjustment,
b. Maintaining auditable product document control files,
c. Using inventory measurement practices that support product accountability and auditability.
C.5.1.17 Inventory: The Contractor shall account for fuel according to DLA Energy Instruction INT I119.04, DoD Manual 4140.25-M “Management of Bulk Petroleum Products, Natural Gas, and Coal,” the, and other applicable DLA Energy policies and procedures. a. The Contractor shall be responsible for and perform all fuels inventory, accounting and administrative functions using Fuels Manager Defense® (FMD) and BSM-E software provided by the DLA Energy. The Contractor will provide computer hardware in compliance with INT I119.04.
Internet service will be provided by the Contractor. The Contractor will reconcile all inventory transactions monthly within 2 days after the last day of the month. The Contractor shall process the required documentation for server access as well as meet all WSMR requirements for access to the DoD server.
b. The Contractor shall be responsible for determining reorder cycles and ensuring that adequate stocks are on hand to fully support mission requirements. The Contractor will coordinate with the Army Petroleum Center and DLA Energy-AME Americas West Region Office to re-order fuel as needed using the appropriate DLA system, as required. The Contractor shall be prepared to convert to a process of re-ordering fuel supplies through the Enterprise External Business Portal (EEBP) once this system is fully implemented. The Contractor will coordinate with the DLA Energy Region Office for issues involving inventory and accountability.

C-5.1.18 Hours of Operations: See Appendix E for base specific requirements. The Contractor shall conduct fuel operations during the stated hours of operation at the fuel facilities. All services required outside of the normal hours of operation without prior coordination/notification shall be met within two
(2) hours as measured from the time the Contractor is notified by the COR until the operator is in position to perform the service required.
It is the Contractor’s responsibility to ensure that customers continue to receive uninterrupted service/support during all Federal holidays.. At no time during the performance of this contract will there be a lapse in customer service.
The Contractor will provide the COR with a listing of individuals on call, contact information (telephone numbers) and base locations of employees identified to work the holiday schedule no later than 1700 hours on the day prior to a holiday. If support is required during any holiday period, it should be communicated to the Contractor 24 hours in advance in order to ensure that adequate coverage can be scheduled.
C-5.1.19 Communication: Mobile Cellular telephones serves as the best method of communication between the Base station and employees while conducting refueling operations. The Contractor shall provide Hand Held Radios or Mobile Cellular Telephones.
C.5.2 Support Operations: The Contractor shall provide safety, security, environmental compliance, maintenance, and automation at WSMR. The Contractor shall promptly report to the US DLA Energy Representative the receipt of any Notice of Violations (NOVs) or other notifications for alleged noncompliance with any environmental, safety, security, labor laws or regulations. Support Operations are further defined as follows:
C.5.2.1 Safety: The Contractor shall ensure safety in all operations according to the Safety Plan. The safety of the workforce, facilities, equipment, and practices shall be preserved while supporting the customer mission requirements.
C.5.2.2 Security: The Contractor shall provide access control for DLA Energy property (fuel products, facilities, equipment, and information systems) according to the Security Plan.
C.5.2.3 Environmental Compliance: The Contractor shall follow the WSMR Environmental Compliance and Spill Control Plan(s) for COCO operations. The Contractor’s work under this contract shall conform with all operational controls identified in the White Sands Missile Range Environmental Management Systems (EMS) and provide monitoring and measurement information necessary for the DLA Energy to address environmental performance relative to the goals of the EMS.
C.5.2.4 Maintenance: The Contractor shall maintain the COCO fuel systems, e.g., facilities and equipment according to manufacturer specifications, best commercial practices, and the Maintenance Plan.
C.5.2.5 Automation: The Contractor shall connect to and use the DoD System of Record for fuels inventory, accounting, and administrative functions according to DoD 4140.25-M and other applicable guidance, unless otherwise agreed upon. The Contractor shall provide appropriate internet connectivity to process transactions as required for accounting purposes.
C.5.2.6 Notification of Correspondence and Visits: The Contractor shall immediately provide the CO and COR copies of all correspondence and notification of any visits relating to federal, state, or local officials or agencies and other personnel or Contractors that visit the retail fuel facility.
C.5.2.7 Uniforms, Clothing, and Safety Equipment: All contract personnel, including site managers, shall wear a professional, distinctive, company uniform in performance of their duties. The Contractor will provide any required safety equipment for their employees; such as, but not limited to, eye protection, gloves, and required PPE as required by the applicable regulations and directives.
C.5.3 Management and Administration: The Contractor shall provide the plans, quality of service data management, training, and property management for the operating systems at WSMR.
Management and Administration is defined as follows:
C.5.3.1 Plans: The Contractor shall have plans that meet applicable statutory and regulatory requirements. Other accredited documentation, as agreed to by DLA Energy, to assess fuel operations and support capabilities (e.g., certifications, certificates or licenses to operate) is authorized. The plans and other documentation must be acceptable and approved by DLA Energy. At a minimum, the plans must include:
a. Operations and Staffing
b. Contract Quality Assurance
c. Product Quality Control
d. Safety
e. Security
f. Environmental Compliance and Spill Control
g. Maintenance
h. Training
i. Property Management
C.5.3.2 Data Management Related to Quality of Service: Unless exempted by law, the Contractor, when requested by DLA Energy, shall promptly provide all records (electronic and otherwise) related to operations and staffing, contract quality assurance, fuel quality control, safety, security, environmental compliance and spill control, maintenance, training, and property management.
C.5.3.3 Train Employees: The Contractor shall ensure that each employee in the fuel operations workforce successfully completes job specific and mandatory training required by statutory and regulatory requirements, and each employee receives the requisite certifications or licenses.
C.5.3.4 AT Level I Training Requirements: The Contractor shall comply with Department of Defense Instruction (DODI) 2000.16, "DoD Antiterrorism (AT) Standards," paragraph E3.18. DoD STANDARD 18: AT Measures for Logistics and Other Contracting, subparagraph E3.18.6 and Table E3.T2. Minimum Level I AT Awareness Training Requirements.
C.5.3.5 DLA Energy Furnished Equipment (GFE) Management: When DLA Energy equipment is provided; the Contractor will provide management, accountability and reasonable care for it according to conditions listed in the solicitation and the Contractor’s Property Management Plan. The Contractor will afford DLA Energy access to DLA Energy equipment for inspection and accountability as specified in the solicitation.
C.6.0 DELIVERABLES
C.6.0 Contractor Plans: The description of the plans below is provided for guidance only and is not an inclusive description of the required elements of the plans. Plans will comply with applicable guidance and regulatory requirements. Other accredited documentation, as agreed to by DLA Energy, to assess fuel operations and support capabilities (e.g., international certifications, certificates or licenses to operate) is authorized. Prior to operational start date/receipt of DLA Energy product, or as otherwise specified, the Contractor shall provide to DLA Energy the following plans or other accredited documents for review and acceptance.
C.6.0.2 Operations and Staffing Plan: The plan shall include the procedures covering all requirements specified in C.5.1.
C.6.0.3 Contract Quality Assurance Plan (CQAP): The plan shall include an inspection system acceptable to the DLA Energy for monitoring overall contract performance. It shall specifically state all the work requiring inspection by the DLA Energy and the place and manner of that inspection.
DLA Energy may either prepare the CQAP or require the Contractor to submit a proposed CQAP for DLA Energy’s consideration in development of the DLA Energy’s plan.
C.6.0.4 Product Quality Control Plan (PQCP): The plan shall describe how the Contractor intends to perform the required services in order to ensure that all products meet specification requirements during the performance of the contract. The plan shall include procedures for the following operations, as they affect quality control, and an organizational chart that identifies responsible parties for these operations:
a. Receiving
b. Blending
c. Sampling
d. Testing
e. Calibration
f. Storage and Handling
g. Loading and Shipping
h. Quantity Determination
i. Records and Reports
j. Corrective Action
C.6.0.5 Safety Plan: The plan shall describe how the Contractor intends to perform the required services listed below, but not limited to the following areas:
a. Confined space entry
b. Disaster preparedness
c. Fire prevention and protection
d. Personal protective equipment
e. Hazardous waste operations
f. Emergency response
g. Safety and health standards
h. Hazardous communications
i. Lockout/tagout and fuel handling operations
j. Placards for tank cars and trucks
C.6.0.6 Security Plan: The plan shall identify the staffing and procedures necessary to maintain access control. The plan will address at a minimum the following areas:
a. The means to deter unauthorized access
b. The method for visitor and entry control with a way to account for each visitor,
c. The facility internal self-powered communication system to link all critical points.
d. The method to safeguard and protect FOR OFFICIAL USE ONLY documents.
e. Procedures established to train personnel on Threat Awareness/Reporting and Operations
Security (OPSEC).
f. Range fuel delivery procedures on WSMR outside Main Post.
The Contractor shall submit the security plan to the CO for review and approval within 60 days after contract award
C.6.0.7 Environmental Compliance and Spill Control Plans: The Contractor shall prepare and implement a Spill Control and Countermeasures Plan in accordance with 40 CFR 112 and provide a copy to WSMR Garrison Environmental Division. The SPCC must be approved by a New Mexico state certified Professional Engineer.
Spill Reporting: In the event of a reportable spill, the Contractor shall report to the Contracting Officer, DLA Energy and the COR. The spill response is required immediately by telephone and an email in accordance with requirements in DLA Energy Policy P-40. In addition to DLA Energy formal requirements for the reporting of fuel spills, the Contractor shall provide a simplified report of all spills involving the Contractor, its personnel, equipment and systems for which it is responsible. All reports shall be immediate (same day) written (email) accounts of the circumstances surrounding the spill, the estimated amount of the spill, and actions taken to remediate the spill.
Spill Response: In the event of a spill, the contractor will follow the Installation Facilities Response Plan (FRP) which includes tasks such as, but not limited to, the following:
- Contractor will respond to spill and leaks; including, but not limited to, notifications to emergency personnel and, to the maximum extent practical until directed to cease the spill, evacuating personnel, and eliminating ignition sources. Emergency services provided by White Sands Missile Range.
-Containment and clean up associated with the discovery of a spill.
-Maintaining clean up and control equipment/systems and all materials required to respond to a spill.
-Disposal services for waste, both hazardous and non-hazardous, for spill materials used.
-Spill Response Supplies: The Contractor shall be responsible for the care and upkeep of all spill containment and clean up kits; supplies and equipment under CLIN 0001, which are required in accordance with the FRP.
- Contractor is fully responsible, at its own cost, for any response required to respond to and cleanup any fuel or chemical spill resulting from the contractor's actions or omissions in compliance with applicable installation, DoD, federal, state and local requirements.
C.6.0.8 Environmental Compliance Plan: The environmental compliance portion of the plan will describe how the Contractor will comply with all applicable Federal, State, and local environmental guidance, policies, and consent orders.
C.6.0.9 Spill Control Plan: The spill control portion of the plan will describe measures the Contractor will take to address the following areas:
a. The plan shall include facilities, equipment, and system components. The plan shall identify the frequencies, methods, and procedures for accomplishing the maintenance objectives.
The plan shall be developed according to applicable directives, manufacturer’s recommendations, best commercial practices and industry standards. As built drawings and system modification diagrams shall be provided for any new or upgraded facility.
b. Oil spills and contingencies, including any spilling, leaking, pumping, pouring, emitting, emptying or dumping into or onto any land or water,
c. Spill prevention control and countermeasures,
d. Creation of an oil pollution operations manual,
e. Contractor response to containment, cleanup, and disposal,
f. Spill reporting procedures,
g. Telephone notification procedures to the QAR, Defense Energy Region/Office, COR/COTR, and appropriate Federal and State officials.
C.6.0.10 Training Plan: The plan shall identify length of training, training sources, and a brief description of courses, such as safety, environmental protection and job qualification training.
C.6.0.11 Personnel Qualifications: The Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet minimum performance requirements and comply with all applicable laws and regulations. They shall be able to read and understand English to the extent of reading and understanding printed regulations, detailed written orders and operating procedures, training instructions and materials, and shall be able to compose reports which convey complete information.
Alcohol and drug testing is required for all Contractor personnel.
C.6.0.12 Property Management Plan: The plan shall identify real, expendable and non- expendable property receipt, storage, inventory, records, and disposition instructions for Contractor and GFE. It will address the following areas concerning protecting DLA Energy property from damage and/or contamination:
a. Management practices for using and maintaining existing buildings, equipment, asphalt pavement, soil, or vegetation (such as trees, shrubs, and grass) on the DLA Energy installation
b. Snow and ice removal in order to maintain continuous operations during inclement weather, and reconciliation in the event of damage or contamination.
C.6.0.13 Aviation Refueling Plan: The plan shall identify operational, staffing, and equipment requirements to successfully meet the requirements (normal and surge) for WSMR as stated in Appendix E. The Plan shall be provided to DLA Energy initially as a part of the offeror’s technical proposal IAW the solicitation.
C.6.0.14 Phase-In Plan: To ensure a smooth transition in the change of work effort, the Contractor shall develop a Phase-In Plan. The Contractor’s Phase-In Plan shall describe in detail the transition between outgoing and incoming Contractor and how responsibility for services changes over with no interruption in services. The Phase-In process will be ten (10) working days.
C.6.0.15 Phase-Out Plan: Upon expiration of this contract, a successor, either DLA Energy or another Contractor, may continue these services. The successor shall require assistance from the incumbent Contractor who shall give their best efforts and cooperation in order to effect an orderly and efficient transition. The Phase-Out Plan shall include provisions for incumbent Contractor actions to assist and coordinate with DLA Energy and the successor Contractor in the changeover of all functions on the contract performance start date. The plan shall be coordinated with all affected activities and managed to minimize any adverse impact on the flying training mission. The incumbent Contractor shall provide sufficient numbers of personnel to conduct a joint inventory of all (GFE) provided facilities, publications, accounts, records, etc., with the successor Contractor and DLA Energy representatives to ensure inventories/accounts are accurate and complete. The incumbent Contractor shall ensure shortages, equipment/tool condition issues, and other contract requirement issues are rectified prior to relinquishing (GFE) accounts to DLA Energy. The Phase-Out process will be ten (10) working days.
C.6.1 Specific Local Deliverables: All provider built facilities will have utility meters installed to track usage and to assist with reimbursement auditability if required.
a. Refer to Appendix E for other local deliverable details.
C.6.2 Labor Reporting: The Contractor shall report all Contractor labor hours (including Sub- Contractor labor hours) required for performance of services provided under this contract for the DLA via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil. Reporting inputs will be for the labor executed during the period of performance during each DLA Energy fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013. C.6.3 Facility Requirements: The Contractor will have the aboveground (both tank and piping) capability to store and distribute F24 (or F24 upon conversion) and DS2. The Facility will have the capability of bulk issues (truck bottom loading rack) for JP-8 and DS2. The Contractor shall perform all operations from the COCO facility to include Contractor’s utility vehicles operations and maintenance.
The installation will provide land free of contamination for the Contractor’s facility and utility stub out to the facility perimeter.
a. The Contractor shall provide all manpower, equipment, and material resources as necessary to provide these services. All facilities, equipment or materials furnished by the Contractor shall be suitable for the intended petroleum products. The Contractor’s technical proposal will identify the type of material that will be used throughout the fuel distribution system.
b. All tanks and facilities used to provide the services shall meet the requirements of the current American Petroleum Institute (API) Standards, National Fire Protection Association (NFPA) Codes, National Electric Codes, Unified Facilities Code (UFC), and all local, (to include WSMR Technical Design Guide), state, federal laws (including but not limited to 40 CFR 280, 281 and 112) and regulations applicable to tanks and facilities. These facilities shall meet best commercial standards with components and fixtures that allow proper service interface with military tactical and non-tactical vehicles and equipment.
c. The Contractor shall be responsible for obtaining all permits necessary for operating, and constructing these facilities, including, but not limited to hot work permits, dig permits, tank registrations, air emission permits, erosion and sediment control, underground injection control or sanitary permits, storm water discharge, and aboveground storage tanks when required. The Contractor shall be responsible for obtaining all inspections by state and local authorities addressing fire and electrical codes prior to operation. A copy of all environmental permits when issued new or upon update will be provided to the WSMR Directorate of Public Works, Environmental Division.
d. The Contractor will coordinate with state and local fire authorities to address fire and electrical codes. Fire Alarm and Suppression systems will be approved and accessible by the WSMR Fire Department.

e. The Retail dispensing pumps shall be equipped with in-line filters capable of sediment removal to 10 mg/1 or less and water removal to 10 ppm or less. Filters will be replaced in accordance with manufacturer’s recommendations and as needed.
f. Bulk dispensing of F24 (aviation) shall be equipped with filter separators that meets API 1581.
F24 shall be maintained to aviation quality standards in accordance with MIL STD 3004.
g. The bulk and retail pump dispensing areas shall be provided with a weather canopy and lighting. The retail/bulk dispensing area, canopy, and tarmac area lighting shall be configured with Energy Efficient Lighting for 24-hour operations.
h. The Contractor shall provide weekly project status reports during establishment of the facility to the Contracting Officer, DLA Energy Program Manager and COR throughout the establishment and prior to the start of performance.
i. The facility shall provide for safe access and exit and a safe and marked traffic pattern within the facility. Traffic flow pattern to and from the facility shall be provided by the installation during the pre- solicitation conference.
j. Contractor shall ensure all fuel control meters are calibrated annually or more often as needed.
k. Bulk stands shall be provided with a weather cover. Bottom bulk loading is required for JP-8 and diesel. As a minimum single bulk loading point for aviation grade JP-8 and single bulk loading point for Diesel. Bulk loading shall only be performed under the Contractor supervision. The facility must be capable of simultaneous loading.
l. The Contractor shall provide an auxiliary power source with automatic switch gear to enable the facility to be operational 24 hours per day during power outage and emergency situations. The power source will be tested monthly under full operating conditions.
m. Utility tie-in points will be provided by the installation near the perimeter of the proposed site. The installation will provide for utilities. The Contractor is responsible for installation of all utility infra-structure within the perimeter of the site.
n. The facility will have security fencing in accordance with the Installation Design Guide preventing access to the above ground tanks and pipeline manifolds. This will provide adequate anti-terrorism protection.
o. The Contractor shall ensure the fuel system has the capability to recover product used for sampling operations back into the usable inventory.
p. Rhodes Canyon: Facility does not require overhead canopy and will not have water provided per waiver form authority having jurisdiction.
q. Salinas Peak: The U.S. Department of Transportation, a Class 4 Road is defined as “unimproved roads which are generally passable only in fair weather and used mostly for local traffic.
Also included are driveways, regardless of construction. (DOI3)". Deliveries to this location will not be conducted by the contractor during inclement weather.
r. Stallion Range Complex: The contractor will support Kirtland Air Force Base with their
Alongside refueling mission:

C.7.0 MAINTENANCE
C.7.1: The Contractor shall maintain the fuel systems, e.g., facilities and equipment according to manufacturer specifications, best commercial practices, all state and federal guidelines and directives, and the Maintenance Plan at Contractor expense. The facility will be maintained in such a manner that it remains capable of providing all services required on this contract. This may include but not limited to API 653/STI inspections, API 570, API 510, etc. Grass and weeds will be maintained at less than 4 inches at all times. Housekeeping, signs, spot painting and grounds will be maintained to ensure a clean, well-kept, and esthetically pleasing appearance. The Contractor will be responsible for snow removal in order to maintain freedom of movement and access to retail and bulk dispensers.
The Acceptable Quality Level (AQL) is the Contractor shall provide the manpower, materials, tools, and equipment to establish and implement a maintenance program. The facilities and equipment in-commission rate shall be at 90% or better with mandatory preventive maintenance conducted in a timely manner and properly recorded. The “in- commission rate” shall be defined in the Maintenance Plan.
C.8.0 STORAGE TANKS CLEANING
C.8.1: The Contractor shall empty, inspect, and clean each bulk petroleum storage tank and dispose of all tank bottom waste for each tank covered under this contract. The Contractor shall transfer remaining product to alternate tanks during tank cleaning. The time for cleaning will be measured from the date of the last cleaning regardless of whether the tank was under contract with DLA Energy. Tanks requiring cleaning will be removed from revenue. Any samples that require testing cannot be completed without prior approval from the Contracting Officer. An equitable adjustment can only be authorized by the CO.
C-9.0 GENERAL CONTRACTING GUIDANCE
C.9.1 Contract Performance: The Contractor shall monitor performance and ensure contract compliance as prescribed by the Contract Compliance Plan submitted. The Contractor shall perform and achieve performance standards for each task in Section C-5.0. The Contractor shall, for certain tasks, submit performance based plans to ensure performance standards are met and comply with applicable regulations.
