Yuma Proving Grounds, AZ July 15, 2013

Question and Answer Amendment 0008

1. Are there any site surveys or topography maps available for these sites?

Answer: No.

2. Is there geo technical data for these sites or from the surrounding area? Such as the new Free fall building.

Answer: There is no geotechnical data available for any of the sites.

3. The proposed fuel facility maps that we were given identify the locations of the sites in a yellow box but do not go up to the adjacent roads. Is it the contractors’ responsibility or the Bases to bring entrance and exit roads to the sites?

Answer: The contractor will only be responsible for the infrastructure inside the leased land area.

4. Can you tell us from which direction will the tracked vehicles enter our facilities?

Answer: At KFR site, the tracked vehicles will enter/exit from eastside. At YTC site, the tracked vehicles will enter/exit from Westside.

5. What are the spacing requirements for our perimeter chain link fencing and bulk tank fencing?

Answer: The cantonment fence at the bulk site will be moved prior to contract award at a distance 50 foot from the leased land property line to bring the leased land into the cantonment area. The contractor should use the leased land property line for the facility fencing.

6. Will the base provide a location to obtain water for construction?

Answer: Yes.

7. Can the contractor utilize the hydrants at each site once they are complete for construction?

Answer: No.

8. Can we stage materials and equipment beyond our property boundary during construction?

Answer: This site will need to be reviewed by Master Planning Real Property and Environmental Divs. Please provide required area requirements and materials to be staged upon award.

9. Will contractors have unescorted access to the sites during construction?

Answer: YPG’s security policy is:

Contractor personnel and property shall be subject to search and seizure upon entering the confines of the installation, while on the installation, and upon leaving the confines of the installation.

1 Installation Access.

1.1 The contractor shall be responsible for assuring all contractor personnel authorized to perform work under this contract obtain installation access as follows:

Ten (10) days prior to commencing work, the company shall provide to address below, a listing of all personnel employed that will be on-site at YPG.

2 Any changes in personnel information furnished on the above visit request resulting from hiring, discharge, termination or employee action or other personnel changes shall be reported immediately in writing to the above address.

3 Site Security The Contractor shall be responsible for the security of all supplies, material, equipment, and facilities. The Contractor shall secure work areas and protect the public from hazards that may be caused by jobsite conditions.

4 Vehicle Registration and YPG Security Badge.

4.1 All personnel who live or work on Yuma Proving Ground, or often use the facilities are required to register their vehicle in accordance with the Motor Vehicle Registration Policy as outlined in AR 190-5, Motor Vehicle Traffic Supervision. A DoD Form 220, “Department of Defense Registered Vehicle” decal will be issued and affixed to the vehicle windshield as prescribed by Chapter 3, AR 190-5. IAW AR190-5, Chapter 3, the DoD Form 220 “Department of Defense Registered Vehicle is an accountable item and will be issued and turned into the issuing agency when no longer needed, superseded, or upon expiration or termination of employment at YPG. All individual TDY, temporary employed, permanent party or work on the Yuma Proving Ground are required to possess a “YPG Security Badge” which will identify areas on YPG, into which he/she will be allowed unescorted access IAW YPG Physical Security.

4.2 The Contractor shall ensure all Contractor employees return security photographic identification cards, permits, government driver’s licenses/permits, Government property, keys, photo passes, and range passes. An employee/installation clearance form will be developed by the Contractor to certify that an employee has returned all required badges, permits and other accountable items.

5 Security Range Passes.

Contractor employees working in the KOFA Firing Range (KFR), Cibola, and North Cibola ranges, shall be issued passes. Visitors and contractor employees who do not work on the ranges, may be required, on an occasional basis, to obtain a range pass. Employees with issued passes shall not permit others to use their passes, nor shall they be used for personal identification outside YPG. Anyone found allowing this to happen could be subject to disciplinary action that may result in termination. The Contractor shall be held accountable for all passes issued to their personnel, to inventory the passes, and to maintain a record for inspection purposes. If a pass is lost, a report shall be filed immediately with the Pass & ID, Physical Security Division, Law Enforcement and Security Directorate. All passes shall be returned to Pass & ID at the completion of the contract, when employees are terminated, or when date of expiration on the pass has expired. Failure to comply with this requirement shall result in final payment being withheld until the Contractor accounts for all passes. All contractor personnel working on a range will view the Range Safety Video.

6 Protection and Privacy of Information.

Information submitted such as that addressed in the Installation Access Requirements (i.e., visit request) shall be protected from unauthorized disclosure.

7 Security Inspections.

The Contractor shall be subject to announced and unannounced security inspections conducted by Physical Security, AIS Security, Industrial Security, etc. Inspection reports shall be provided through the COR to the Contractor for action.

10. Will deliveries such as concrete need to be escorted? If so by who?

Answer: Yes, by the contractor. See question 9

11. Are capital expenses to be recouped during the first period of the contract or spread over the life of the contract?

Answer: These should be recouped during the Base Performance Period (first 5 years).

12. Can you provide the geotechnical investigation reports for the 3 sites?

Answer: There is no geotechnical investigation report available for any of the 3 sites.

13. Can you provide location and distance from YPG to all delivery sites listed in appendix E under Contractor Provided Test Area Support Refueling?

Answer: Refer to document in solicitation Amendment 0003 “Field delivery locations.”

14. Can the current fuel delivery contractor fuel consumption data be provided for cost estimates?

Answer: This consumption data is not available due to the amounts being lumped in with all government usage and is not currently being paid by the contractor.

15. Can the government provide vehicle specifications for those vehicles expected to use site location refueling to aid in refueling pad design?

Answer: See updated PWS in solicitation Amendment 0006.

16. Can the government provide topographical maps for all three locations?

Answer: Topographical maps are not available for the sites.

17. Can you provide anticipated traffic approach patterns anticipated at each site for design layout?

Answer: Refer to Amendment 0008 access instructions to “YTC and Kofa Tank crossing” documents for estimated traffic entry and exit map. Anticipated Traffic approach patters needs to be finalized during design phase for each site.

18. Does the government have a specific AST tank design requirement such as single wall or double wall UL 142 tanks or UL-2085 or is this a contractor option?

Answer: Contractor option.

19. Does the government require offload pump systems for each type/grade of fuel at each location? If so is there a minimum gpm requirement? Or is off load tanker truck PTO with over spill an option?

Answer: Yes, offload pumps are required. GPM requirements shall be determined by the contractor to meet their system design/needs.

20. Is the monitoring system and over fill protection required to be electronic or veeder-root mechanical?

Answer: Monitoring system shall be electronic.

21. Are 12,000 gallon tanks an option or are 15,000 gallon tanks required?

Answer: See updated PWS Appendix E for specifics in solicitation Amendment 0006.

22. Is security lighting required for tanks? Is lighting required at all retail site pump stations? Is there a required light pole height or restrictions to height?

Answer: The installation does not have a requirement for security lighting at the tanks. All retail site pump stations require lighting for safety. Pole height restriction applies to the site at the Airfield. Designs will be reviewed to ensure pole heights do not exceed airfield clearances. Refer to UFC 3-250-1 and AR 95-2 which are available online.

23. Are Conex systems acceptable at site locations for equipment storage and is air conditioning required for equipment cooling?

Answer: Is this a permanent or interim solution? Since these are contractor-owned connexes, as long as the connex is within the approved site, there should be no issues.

24. Is a card reader or chip key currently used at YPG? Who supplies vehicle cards or chip keys?

Answer: VIL keys are currently being utilized at YPG. The Contractor will be provided the database to upload into the COCO system for use. This will allow the currently valid keys to be utilized without re-issue. The contractor will obtain additional and spare VIL keys from DLA Energy IAW the ordering procedures in DLA Energy policy P-5.

25. Does the government have a specific requirement for spill containment to be catch basic or knock down tank or is this contractor preference?

Answer: It is the Contractor's choice but needs to be in compliance with 40 CFR 112.

26. Who will provide power transformers at sites, government or contractor? What size transformers?

Answer: Contractor will provide transformers. Size of transformers will be determined by design requirements.

27. Are electrical power meters and water meters required? If so, who is responsible for cost? Who is the billing company and what are the current rates?

Answer: Yes, electrical power meters and water meters are required and shall be provided by the contractor. Per the Memorandum of Agreement between the Garrison and DLA Energy, the installation provides utilities at no charge. However, the contractor must use every effort to conserve where possible.

Water Meter -Badger Type like the Bronze NSF-61 Lead Free, Badger Recordall 170EL with a Meter Strainer.

Electric Meter - Honeywell: Class 500 advanced KWh/DEMAND Meter or equal like EMON Type.

28.. The chart on page 23 of the PWS states that refueler trucks should be able to refuel up to 5,000 gallons and defuel 1,000 gallons simultaneously. Is it the intension of the Government that the trucks actually be able to perform both functions simultaneously or that the trucks be capable to perform both functions?

Answer: The contractor should be able to provide dedicated refueling and defueling operations at the same time but not with the same truck. See updated PWS in Amendment 0006.

29. PWS (C.5.1.1) does the current contract for receipt require the tank trucks to have pumps?

Answer: If this is pertaining to the tank trucks that will be delivered to the COCO from Davis Monthan, they are not required to have pumps and the COCO location will need to have receipt pump capability.

30. PWS (C.5.1.2.2) Additives: What type and how many additives are anticipated to be added? Does this statement imply a requirement to include an additive injection capability into the facility design?

Answer: See updated PWS in Amendment 0006.

31. Appendix E; YTC Retail Service Station JP8 receipt numbers are low when compared to annual throughput in gallons. What are the correct average numbers of receipts per month?

Answer: See updated PWS in Amendment 0006.

32. Please Validate Largest Vehicle is 50 Feet long and 60 tons as a max weight.

Answer: See updated PWS in Amendment 0006.

33. Appendix E; Kofa Range Retail Service Station GUR receipt numbers are low when compared to Annual Throughput in gallons. What are the correct average numbers of Receipts per month?

Answer: See updated PWS in Amendment 0006.

34. Please Validate Largest Vehicle is 50 Feet long and 60 tons as a max weight.

Answer: See updated PWS in Amendment 0006.

35. Request information as to exactly how track vehicles will enter the facility?

Answer: See updated PWS in Amendment 0006.

36. Appendix E; Laguna AAF Bulk Fuel Facility JP8: Does the Directed Minimum Storage Requirements take in consideration of Un-obtainables?

Answer: Yes

37. Where will new JAA Additives be injected? DFSP or Laguna AAF?

Answer: DLA Energy Intermediate Terminal

38. From what Terminal do we receive from? What is the Company Name? How far away?

Answer: Davis Mothan AFB, AZ which is approximately 260 miles away.

39. How many receipt trucks are typically sent at any given time?

Answer: One

40. Is contractor required to escort Fuel Receipt Trucks?

Answer: Yes

41. It was briefed that there is Aircraft Refueling on Dirt Runways? What type of aircraft are to be refueled there?

Answer: Yes, no fixed wing will be serviced at these locations, only helicopters. (UH-1, UH-60, LUH-72)

42. Please Provide List of All Refueling Vehicles Types, by grade of product.

Answer: Please clarify. All refueling Vehicles are to be provided by the Contractor and the contractor determines this.

43. How many Motorola Radios will be provided? How many additional batteries?

Answer: 4 radios with 6 batteries.

44. Who is the government Provider of Cell Phone Service? Of internet Service? Of Cable Service?

Answer: Verizon, The NEC is obviously the government service provider and can provide basic services according to the C4IM Service List 3.0 (some would be at no cost, others may have a fee, requirements needed to assess which is which). Commercial Internet is available anywhere connectivity to the network is available. However, Army users (including contractors) on an Army contract would not normally be allowed to use the commercial Internet without a waiver due to the requirements of Army Regulation 25-2. Options on cable (Time/Warner, Dish, DirecTV). Time/Warner sites are limited.

45. Any limitations or Radio/Cell Phone “Black out’ areas of the YPG?

Answer: There are parts of the range that do not have cell phone and radio coverage. However, those areas will not impact the COCO fuel points.

46. Who is COCO responsible to for fuel Quality? APC? DLA-Energy?

Answer: DLA Energy

47. Where is full specification testing accomplished?

Answer: Army Lab, New Cumberland, PA

48. Are we subject to Army Inspection or HHQ Inspections Teams?

Answer: Yes, subject to Army, State (ADEQ) and Federal (EPA) inspection, reporting, and oversight.

49. How will receipt trucks enter the base? Are there designated Entry/Exits?

Answer: Any manned entrance gates.

50. Is standby limited to day-shift hours only?

Answer: Please Clarify. The required hours of operation are in the PWS. Occasional overtime will be needed on a 24/7 basis but will need to be approved through DLA Energy prior to performing. Overtime will only be approved when funded by the requesting agency; at no time shall it be used during the normal hours of operations.

51. Please confirm that the Government will provide adequate water, communications (phone, internet access and fiber optic) and electricity to each project site and locate on the property where the government will terminate each utility.

Answer: The Government will only provide water, electricity and copper cables for phone lines up to the real estate border of each site and sewer service for the airfield site. The contractor will extend water and sewer services from each retail fueling station to the provided utility demarcation points near each site and terminate. The Contractor also will extend power and telephone service lines from each retail fueling station to the demarcation points near each site and the Government will only make the final connections. Internet connections will need to be obtained by the contractor through a commercial vendor with the costs being included in the MUCC Clin.

52. The government personnel at the site visit indicated that the tank fuel storage capacities may change. Please provide the final fuel storage capacities desired for each type of fuel at each site.

Answer: See updated PWS Appendix E of Amendment 0006

53. Please provide a copy of Yuma Proving Grounds Base architectural standards so that we can make sure our proposed design complies with those standards.

Answer: Refer to Amendment 0006 for access instructions to YPG’s Installation Design Guide (IDG).

54. Our representative at the site visit was told that the bidders are to assume there will be no costs involved to: a) preserve or relocate, etc. any archaeological artifacts or protect or; b) protect, relocate, etc. any endangered species (plant or animal). Please verify this.

Answer: The government assumes all costs to excavate, relocate, and preserve archaeological specimens. If human remains or archaeological remains eligible for the National Register of Historic Places are found, this could cause project delays. The contractor should be aware of this possibility, although remote.

55. We request that the government make available to the contractors the following: a) all record drawings for all site improvements on the proposed building sites, if any; b) all topographic and or plane survey information available for the sites; c) all sub-surface geotechnical information at or near each of the sites; information regarding any possible contaminated or hazardous soils at the sites.

Answer:

a) There are no site improvements record drawings available.

b) If needed, General topographic maps of the areas can be provided from nearby locations.

c) There is no sub-surface geotechnical information available at the sites. Also we’re not aware of any contaminated or hazardous soils at the sites.

56. If no topographic information is available at each of the sites, would the contractor be allowed to have his own surveyor obtain topographic information at each site?

Answer: Yes, after award, the contractor would be allowed to have his own surveyor obtain topographical information at each site.

57. We are requesting that the government provide GPS coordinates for the boundaries at each of the proposed sites.

58. The two each, 50,000 gallon JP-8 fuel tanks appear to be short of capacity because of the RFP requirement that a 14-day supply be maintained at all times. Are the two tanks a minimum requirement or exactly what the Government desires? Government minimum requirement.

Answer: See updated PWS Appendix E of Amendment 0006. This is the requirement.

59. Please advise if the contractors be allowed to waste excess soil on each of the sites. If not, does the YPG have a designated waste / borrow site? If so, please provide location of the waste / borrow site.

Answer: The contractors are not allowed to waste excess soil on site. All waste material shall be hauled off YPG property.

60. The Buy-American Act (BAA) was referenced in the RFP. There are many versions of the BAA. Please provide the exact version of the BAA that will apply to this solicitation.

Answer: It is not included as this is a service contract, not a supply contract.

61. The wage rates included in the RFP appear to be for maintenance or service only and not for new construction. Please verify if current, local, Davis-Bacon wage rates apply to this solicitation.

Answer: Davis Bacon rates do not apply as this contract is subject to the Service Contract Act of 1965.

62. Please provide a “typical” delivery schedule with fuel type, quantity, location, frequency, etc., so we can evaluate the overall manpower, equipment needs and fuel expenses for this part of the requirement.

Answer: Refer to document located in solicitation Amendment 0003 “Fuel deliveries and locations.”

63. Please provide site schematics showing where the Contractor is to expect the utility points of connection.

Answer: Please refer to Amendment 0008 for “Spill Containment and Countermeasures Plan” (SPCC)

64. Are utility meters required? If so, please confirm that the meters are for monitoring and reporting usage only and the MOA between DLA & YPG provides all utilities at no charge to the contractor for the term of the contract.

Answer: Utility meters are required and will be provided by the contractor. YPG provides all utilities at no cost. However, the contractor must implement conservation techniques throughout the term of the contract. See question #27 for specifics.

65. If Contractor is to provide the meters, please provide the manufacturer and model numbers/sizes of the power and water meters that YPG wants installed.

Answer: Meters will be provided by the contractor. See question #27 for specifics.

66. Please confirm the incoming power to each property boundary (i.e., 208/230 volt, 3-phase).

Answer: 12,800 HV- The contractor will provide a step down transformer power to the COCO depending on design requirements.

67. Request you state the number telephone lines the government is providing per site. Typically an unmanned site will require 2 or 3 lines, one for FMU, one for call box wall telephone mounted outside for customer use, and possibly one for the fire alarm system. If DLA plans for FMD Operate, then an additional line is needed from the Veeder Root to the main-site computer. A manned site requires an additional line; one FMU, one wall-mounted telephone, (possibly one for the fire system) and one for Post-only business use in office.

Answer: See Amendment 0006 (PWS Appendix E for each location)

68. Please clarify that the government has allowances on the telephone cable for 2-or-3 additional copper lines to be leased for commercial telephone and/or Internet.

Answer: The NEC will provide a 6 pair copper cable to each location.

69. Please identify the manufacturer and model we need for the fire alarm, and whether it is wired (copper telecom) or wireless, in order to mesh with the existing system.

Answer: Wireless Monaco, the Fire Alarm Panel can be any UL listed, (FireLite is preferred). The TRANSMITTER must be Monaco, BT-XF.

70. Request confirmation of to/from locations that delivery tanker trucks must be escorted.

Answer: Gates at YTC / KOFA/ Airfield

71. PWS C.5.1.3.1.2 states “The government shall be responsible for issuing and revoking keys as requested in writing from the customers.” Please verify this is still valid.

Answer: See Amendment 0006 (PWS Paragraph C.5.1.3.1.2)

72. Is the government supplying all of the VIL-keys (at no cost to the Contractor), both initially and as- required thereafter?

Answer: See Amendment 0006 (PWS Paragraph C.5.1.3.1.2)

73. Please confirm that 7-foot high fencing is required around all facilities per UFC 3-460-01 Design: Petroleum Fuel Facilities paragraph 2-6.2.

Answer: Infrastructure will be constructed IAW UFC 3-460-01

74. Are there any government requirements as to the age or other minimum factors for the contractor- provided fuel trucks?

Answer: There are no government requirements. However, the Service provider is responsible for meeting all requirements including when aged equipment is undergoing maintenance.

75. During the site visits it was mentioned that canopies are required at every facility; please verify.

Answer: See Amendment 0006 (PWS Appendix E for each location)

76. If the Contractor makes a scheduled delivery to a site and no one is there to sign for the fuel, how and when is custody transfer determined?

Answer: DLA Policy will be followed during the duration of this contract. All fuel must be signed for when issued or the fuel will not be issued.

77. Previous COCO solicitations have required the facilities to have their own emergency power systems, yet it was not required for this particular one. Please verify if this is still the case.

Answer: All facilities are required to have emergency power backup systems.

78. Will the government allow (or actually perform) recovery and turn-in of waste fuel and/or contaminated water disposal such as from filter/separator drawoffs, drain captures of spills, etc? Even though it is waste, it is government-owned product.

Answer: The Contractor is responsible for disposal of waste IAW Federal, State and Local laws and procedures.

79. Will the Contractor be expected to comply with the DLA policy P-10 Segregation of Duties for establishing manning needs for this location? If yes, this does not align with the purpose of Best Commercial Practices. It is possible that a contractor could perform the services listed in this policy with fewer personnel.

Answer: All applicable DLA Policies and instructions will be followed throughout the contract.

80. During the Pre-Proposal Conference, the government indicated that the process Reverse Auction as outlined in Clause 52.215-9023 will be used for this solicitation. Please explain how this process can be used on a “Best Value” award and where price is to be considered significantly less important than all other factors? COCO projects have to be Best Value as a Contractor has no ability to compare another bidder’s price to his own due to differences in design, materials & quantities, experience, and past performance. In Section M, 52.212-2 Evaluation it states “the non- price factors (Technical/Management, Past Performance, and Socioeconomic/Subcontracting) are significantly more important than price.” A Reverse Auction seems to now move price to the 1st factor following technical evaluation and discussions. The bid submitted should have already been the lowest practicable price at which the Contractor can build his uniquely-designed facility, and then staff it for O&M. This process appears to result in the exact opposite, given that the government is displaying the lowest offerors price.

Answer: The award decision will be made in accordance with the evaluation factors as set forth in the solicitation. The reverse on-line auction will be used as a pricing technique during discussions to establish the final offered prices from each offeror. These prices will be used in conjunction with the evaluation factors stated elsewhere in the solicitation in order to make the award decision in accordance with the basis for award stated in the solicitation.

81. Is any geotechnical information available for the actual COCO property (i.e., boring data on-site, specific soils type, any water levels, etc)?

Answer: There is no geotechnical information available for any of the sites.

82. Is there a disposal location (Post landfill or spoil site) available to the Contractor for top-soiled organics, and also any excess clean spoil? If so, where is it located and what are the permit requirements (if any) to use the site?

Answer: The contractors are not allowed to waste excess soil on site. All waste material shall be hauled off YPG property.

83. Is there a borrow site on Post that the Contractor may use to haul in clean fill if needed, and if so what are the details on its’ use?

Answer: Yes, a location can be designated/coordinated upon award with the local installation.

84. Does the Post do its’ own utility locate/markout, and if so is a commercial One-Call also required?

Answer: Yes, Contact the DOL through the COR.

85. Will the power be at all sites prior to Contractor mobilization so that temporary power is available for use during construction and before the final connections to Service Power?

Answer: All utilities will be routed to the locations prior to contract award.

86. Are there any fees associated with the connection of utilities to the COCO?

Answer: Permit fees etc. information for the COCO leased land locations may be found at the following website: http://www.azdeq.gov/environ/water/permits/

87. Reference Appendix D to PWS (especially Notes 1 & 2) and Offeror Submission Package Attachment II, B000-1 (B34.01). The Base Period monthly price as requested is a single amount, but unlike the Option Periods it is actually composed of two amounts - the Contractor’s capital investment (CI) recovery amount for the capital equipment and the installation of the facilities, as well as the Operations & Maintenance (O&M) charge. Per Notes 1 and 2 of Appendix D, each month the billed amount can be reduced or increased by an amount TBD. However, the CI portion should not be subject to evaluation as it is a fixed cost to the Contractor for the facility, represents a very large initial cost outlay already loaded with risk and extended recovery, and it is not related to the actual O&M performance. As a Services Contract, only the performance of those services should be evaluated for deduction or reward, and not the Contractor’s design & materials; these were evaluated during the selection stage and upon award have already been determined to be at least acceptable, with any repair or replacement for the Contractor’s account.

As a comparison, failing to achieve one of the standards in month 60 will amount to a very large deduction when the CI is included, but the very same performance in the next month (61) will be a much smaller deduction since the CI is no longer included after month 60. Similarly, exceeding the standard and receiving a 2%-5% credit during the months 1 thru 60 will be a very large amount compared to months 61 thru 240 (and a much larger cost to the Government).

There is precedent with the previous COCO contracts with Performance Standards, incorporating deductions or credits, of separating these amounts so that only the O&M amount is subject to performance risk; also there are cases of dropping the deduction/credit amount entirely to correct the potential inequity. Request that the Capital Investment portion be identified and removed from the performance requirement for the first period, or (as in previous solicitations) that the penalties and credits (Notes 1 & 2) be removed entirely from the evaluation.

Answer: Notes 1 & 2 have been removed. Refer to updated PWS July 8 in Amendment 0008.

88. What are the Contractor’s responsibilities for placing and disposal of spill materials at each of the COCO locations; i.e., is the contractor required to provide 24/7 available materials to the customer, or is the contractor only responsible for spills and materials caused by the Contractor?

Answer: The contractor is required to provide 24/7 spill kits at each location and in each refueler to provide immediate use in case of any type of spill at any of the servicing locations no matter who caused the spill.

89. If the contractor is to place spill materials outside and readily available at all manned/unmanned facilities, who is responsible for pilferage and/or used materials?

Answer: The contractor is responsible to provide the spill materials and determine a way to prevent pilferage.

90. During the pre-proposal conference mention was made of tasks that would be considered as overtime reimbursable work, including Saturday fuel deliveries downrange from KOFA. Please clarify what times/tasks this covers and what process is required by DLA to request/approve and invoice for such overtime. This has been a source of confusion many times in the past as some Contracting Specialists do not allow reimbursable overtime unless preapproval has been made in advance of performing the work unless it was a valid “emergency” request.

Answer: The required hours of operation are in the PWS. Occasional overtime will be needed on a 24/7/365 basis but will need to be approved through DLA Energy prior to performing. Overtime will only be approved when funded by the requesting agency; at no time shall it be used during the normal hours of operations.

91. Reference Solicitation page 116 – B. TECHNICAL/MANAGEMENT PROPOSAL (1): “The complete technical proposal, excluding cover letter, table of contents, and any equipment sale/lease agreements, will not exceed 50 pages.” Since this proposal must cover three separate facilities as well as other operations, request that also any drawings, plot plans, and other graphics be excluded from the page count.

Answer: The solicitation is amended to remove drawings, plot plans, and graphics from the page limit.

92. Two of the sites are about 2.5 acres in size and during construction workspace is needed at each location for materials, equipment parking, maneuver space, etc. Is any temporary workspace available for the construction period, which will then be turned back over to YPG upon completion of the facilities?

Answer: This site will need to be reviewed by Master Planning Real Property and Environmental. Please provide required area requirements and materials to be staged after award for review.

93. Is there any information available about which directions to-from the facilities we should expect the tactical equipment, especially the heavy vehicles?

Answer: At KFR site, the tracked vehicles will enter/exit from eastside. At YTC site, the tracked vehicles will enter/exit from Westside.

94. Given the remoteness of the locations, will DLA authorize the contractor to use a Fuel Purchase Agreement (FPA) and utilize the fuel points on the installation for all contractor-operated equipment? The contractor understands this will be a monthly invoice that must be paid promptly. Without this agreement, vehicles will travel long distances to fuel on a regular need.

Answer: See Amendment 0006 (PWS C.6.4.1.1)

95. Reference the figures provided for each site with the utilities annotated. Are the water lines noted at each location supporting of a facility fire water loop and hydrants? What size are these water lines?

Answer: Yes, a 4 inch line will support the facility loop and the specified fire hydrants per site. The installation plans to install a minimum of 4” pipe necking down to a 2”meter.

96. Is the sewer line for the Laguna Army Airfield (manned) site a gravity or force main?

Answer: Septic system and dependent on the design if it is gravity or force main.

97. For areas with sewer access, does YPG allow use of an oil/water separator (OWS) with the outflow piped into the sanitary sewer system?

Answer: Yes.

98. Reference revised PWS (12 June 2013), page 10, paragraph C.6.1.4 Safety Plan: states “The Plan shall be provided to the Government initially as a part of the offeror’s technical proposal IAW the solicitation.” The actual Safety Plan should not be written until after award and following a meeting with YPG personnel such as at the Post-Award Conference to receive much more specific Safety information, and then upon completing detailed design. Also there is already a 50 page limit in which to complete the technical for three separate sites. It appears all other plans except the Safety Plan and Aircraft Refueling Plan are due within 60 days after contract award. Request the same for the Safety Plan itself.

Answer: The safety plan shall be provided initially that includes all applicable references during the building phase of the infrastructure. After award, the plan shall be updated to include information that can’t be obtained until the Post-Award Conference.

99. Reference revised PWS (12 June 2013), pages 11 & 12, paragraph C.6.1.10 Aviation Refueling Plan: states “The Plan shall be provided to the Government initially as a part of the offeror’s technical proposal IAW the solicitation.” This plan also should not be written at this stage until after award and following a meeting with YPG personnel such as at the Post-Award Conference to receive much more specific and Flightline and other procedural/safety information. Also this again impacts the 50 page limit. Request this plan also be due within 60 days after award.

Answer: An Aviation Refueling Plan shall be provided initially. The plan shall identify operational, staffing, and equipment requirements to successfully meet the requirements (normal and surge) for Laguna Army Airfield as stated in Appendix E. After award the plan shall be updated to include information that can’t be obtained until the Post-Award Conference.

100. Reference solicitation, page 115, paragraph A. (2), second paragraph: “The relevant experience of key personnel (corporate or Terminal Manager/Asst Terminal Manager) may also be considered for this factor and included in the five references.” Please clarify this statement. Is this strictly referring to the TM resume at one of the past performance contracts or is it referring to this solicitation?

Answer: This section refers to submission of the demonstrated relevant experience of bidders’ proposed key personnel as one of the five required past performance references. Key personnel past performance experience is considered relevant if the submitted resume documents experience and qualifications relevant to the same or similar work required under this contract.

101. Reference revised PWS (12 June 2013), page 12, paragraph C.6.1.11 & C.6.1.12 Phase –In/Phase-Out Plans: Please explain how these plans are relevant to this contract? Phase-In Plan would be a shell at best since the clear cut-in would be the day DLA places the COCO on revenue and it is up to the current operations to determine how they plan to deplete their current inventory. Phase-Out Plan is over 20 years away and it is likely that nothing stated in this plan would hold factual 20 years later other than assistance from the SP in turning over the facility. There is no GFE other than fuel.

Answer: The Phase-in plan shall be provided detailing the SP’s assumption of the current GOGO responsibilities. The phase out plan can be an outline until the facilities have been accepted, then the SP shall review the Phase-out plan throughout the contract and submit changes to DLA energy for concurrence.

102. Reference revised PWS (12 June 2013) Plans: Request DLA clearly state when each plan is due to DLA for each plan required under this solicitation.

Answer: See updated PWS in Amendment 0006

103. Please confirm that all bulk issues are by bottom-loading.

Answer: Yes

104. Are there specific requirements for the tires on the aircraft refueler trucks; i.e., airfield-only or standard?

Answer: Standard

105. Previous COCO PWS for retail facilities typically has a statement to the effect “facilities shall be equipped to provide air and water for vehicle servicing” but that was not found in this document; is that a requirement?

Answer: This is not a requirement.

106. PWS paragraph C.6.4.2 refers to the YPG Technical Design Guide, and paragraphs C.6.1.7 & C.6.4.14 refer to the Installation Design Guide. Are these the same document? And neither seems to be available on the YPG website as was mentioned in the Conference so could we please be directed to the proper document(s)?

Answer: Yes, the two guides are one and the same. Please email the contract specialist for a copy of the YPG Installation design guide if not already received.

107. PWS Appendix E: Please confirm the Average # of Receipts Per Month with the Total Annual Throughput in Gallons columns for the three sites, as these don’t match. For example, at KOFA Range for GUR there is an average of one (1) receipt per month. At a maximum of 8,000 GL per delivery this is ~ 96,000 gallons/year. Yet the Annual Throughput column shows 400,000 so it appears dispensing if four times receiving. For manpower and equipment utilization, please confirm which is the more correct column for us to use.

108. Will this solicitation require the Terminal Manager (TM) attend the government provided Terminal Manager training on-site in Atlanta GA or be provided on station? Who pays for the cost of this training; i.e., travel & per diem?

Answer: Yes, the TM must attend or have attended the TM course. See updated PWS in Amendment 0006

109. Will this solicitation require the COCO send anyone to the 3 week Accounting Training course in Atlanta GA, and who pays for the cost; i.e., travel & per diem?

Answer: Yes, the accountant must attend or have attended the accounting course. See updated PWS in Amendment 0006

110. What is the SP responsibility for placement of spill kits at the retail locations and who is responsible for restocking and cleaning of used materials each day; i.e., obviously the SP is responsible for materials and spills caused by the SP, however how would one quantify what will be used by the customers and the disposal cost? Experience has shown that unattended spill kits quickly deplete and are used and left on the ground by the user.

Answer: The SP is responsible for placement, restocking, associated costs and cleaning of used spill kit materials each day. The SP shall determine an effective conservation/cleanup plan and provide instructions to the users to assist in maintaining a clean healthy environment.

111. Please clearly define the process of and responsibilities for request, approval and documentation of all emergency and non-emergency overtime requested by the government? Must approval come directly from the Contracting Officer prior to performing services, unless clearly stated as emergency request?

Answer: All overtime requests will be routed to the COR/ACOR. The information listed in the PWS paragraph C.6.3.4 Augmentation/over time request will be provided by the SP to the COR for each request. If the COR/ACOR concurs the overtime is required, the request will then be sent to the contract specialist for approval. Once approved by DLA the COR/ACOR will inform the SP of concurrence. Emergency situations may be requested verbally to DLA through the COR/ACOR with verbal approval from the Contracting Officer in return. All overtime must be approved by the Contracting Officer prior to performing services.

112. What is the largest required compartment (fuel capacity) on fuel trucks entering the facility so we can size containment basins accurately? Basically, can you be more specific on exactly what type (fuel capacity) of fueling trucks will be used?

Answer: Tank Trucks for receipts are 8,000 gallon capacity and should be the largest entering the facility. Aircraft Refuelers should be able to refuel up to 5,000 gallons and defuel up to 1,000 gallons. Ground fuel delivery truck sizes are to be determined by the contractor.

113. Is there a base policy or will the base environmental people require us to install a liner under the tanks in the containment area? Same for the offload areas.

Answer: UFC3-460-01 is the requirement.

114. For clarity purposes, we are attaching the COCO Fuels Site Locations with Utility Lines document we received, which depicts the locations of the existing utilities in proximity to each construction site (leased property). Can you please tell us if the existing utilities shown (electric, comm., water and sewer) are actually brought to the property boundaries by the government or do we connect to these existing utilities at the distances shown on the sketches (various colored lines with distances) and then extend the utilities into the leased property boundaries? If we connect out past the property boundaries, are there utility manholes for making our connections into? If the government brings the utilities to each site, will you install a man hole once inside the property?

Answer: All utilities will be brought to the edge of the leased property by the installation prior to contract award. The service provider will only be responsible for construction within the boundaries of the leased land. Government manholes when applicable will be built where government run utilities end at the COCO leased land.

115. Reference Yuma Proving Ground, Environmental Assessment, dated November 2011. Paragraph 3.8.1, page 27, under “Environmental Consequences and Mitigation” states “that any subsequent lease agreements associated with the proposed action will incorporate design requirements that include appropriate storm water management structures and equipment; so that significant impacts to surface waters are not anticipated as a result of construction” (in summary). Our question is, does Yuma Proving Grounds have a Master Storm Water plan we need to comply with and design to in order to meet this requirement? If so, does it apply to the remote sites at YTC and KOFA or just at the Laguna site? Is a copy available if one exists?

Answer: YPG has only a basic Storm Water Plan. The contractor will coordinate storm water structures and equipment and plans with the ADEQ. http://www.azdeq.gov/environ/water/permits/

116. The SF-1449 states the due date for submission is 15:00 EST June 17, 2013 however, page 3 for the solicitation states “Your offer must be received in DLA Energy FESAB by 3:00 p.m. EST on June 10, 2013” Can you please clarify which date is correct?

Answer: Clarification is provided in Amendment 0001 and most recently updated in Amendment 0007.

117. Can you provide maps and/or photos of proposed sites?

Answer: Refer to Amendment 0004 for access instructions to prepoposal site photos. All maps and photos are provided in Amendments 0003, 0004, 0005 and 0006.

118. Have environmental assessments and/or environmental impact studies been completed for all sites and if so will they be made available for use by potential bidders? If they are not available, who will be responsible for surveys and associated costs?

Answer: The Environmental Assessment is provided in Amendment 0002; refer to Amendment 0002 for access instructions.

119. Ref: C.5.1.3.1 Automated Dispensing System Key Management and Release.

Question: What brand/type of key system is in place and will be required for integration with the government system?

Answer: VIL keys are currently being utilized for use in a FuelMaster® system that connects and operates with the Fuels Manager Defense (FMD) program.

120. Ref: C.5.2.3 states; The Service Provider shall follow the YPG Environmental Compliance and Spill Control Plan(s) for COCO operations. Will this plan be made available to potential bidders?

Answer: YPG has only a basic Spill Control and Countermeasures Plan (SPCC). Pertinent information is provided in the excerpt of the SPCC. Please see Amendment 0008 for document access instructions.

121. Can/will the aviation fuel vehicles that are currently in use at Laguna AAF be available for contractor use?

Answer: No, this is a Contractor Owned/Contractor Operated solicitation and the current refuelers will not be provided.

122. What, if any utilities are available at each site such as power, phone lines, water and sewer? If none are currently available will it be government or contractor responsibility to install and at who’s expense?

Answer: Utility photos for each facility location have been provided to all conference attendees. If you have not obtained these at this point, please contact the Contract Specialist. The contractor is only responsible for work inside the leased land boundaries. The installation will absorb the costs of running all utilities to the property boundary.

123. Are there any buildings available at any site suitable for contractor staff office, maintenance and storage? If none are currently available will it be government or contractor responsibility to install and at who’s expense?

Answer: No, this is a COCO solicitation no facilities will be provided, it is the Contractors’ responsibility/expense.

124. Is security perimeter fencing currently installed? If none are currently available will it be government or contractor responsibility to install and at who’s expense?

Answer: No fencing is installed for use at the COCO locations. It is the contractors’ responsibility/expense.

125. Are there any parking/fueling containment enclosures at all three sites? If none are currently available will it be government or contractor responsibility to install and at who’s expense?

Answer: This is a COCO solicitation and all construction on the leased land shall be provided by the contractor. All required equipment for performance shall also be provided by the contractor. All at the contractors expense.

126. Ref: Appendix E, Contractor Provided Test Area Support Refueling Can you please clarify what this requirement entails? Are these mobile refueling requirements?

a. Column 3 “Location” states: 8-10 daily YTC. Is YTC the delivery location or the sites, Please clarify.

b. Column 4 “Type Tank” states: Tank type is AST. Is this correct or is it mobile refueling?

c. Column 9 has no heading states: Y in each location. Please clarify

Answer: Yes, there are mobile refueling requirements.

a. YTC is Yuma Test Center which has 8-10 deliveries daily to various locations.

b. AST is above ground storage tanks. These tanks are required in addition to the mobile refueling requirement.

c. Column 9 has AFSS as a heading meaning “Automated Fuel Service Station”. Y=yes, N=No.

127. Other than a reference: E-0005 E36 INSPECTION on page 13 of the solicitation which states" No payment will be made for services performed or facilities provided prior to the start of the performance period" I can find no phase-in time frame specified.

After award notice is received, how long will the successful offerer have to purchase and install the required equipment prior to contract start, (Phase-in period)?

Answer: The offeror is to provide the phase in period as part of their proposal. It is normally six months.

128. Ref Draft lease agreement item 8 states: The Contractor/Lessee shall pay the cost, as determined by…
