About this file
This is a Surety Forms document issued by Ocean County, New Jersey, for use in connection with the Buildings & Grounds Warehouse #65 Exterior Renovations project. The document establishes mandatory surety bond requirements that all bidders must satisfy as a condition of bid submission. Bidders are required to submit a Consent of Surety and a Certificate of Surety Company completed by an authorized representative of the surety firm. The surety company must meet the requirements established under P.L. 1996, Chapter 384 (N.J.S.A. 2A:44-143) and must be authorized to issue Performance and Payment Bonds in compliance with state law. The failure to provide the required Certificate of Surety Company is identified as a non-waivable defect that will result in automatic bid rejection.
The Surety Disclosure Statement and Certification requires detailed financial and underwriting information from each surety participating in the bond issuance, including capital and surplus amounts certified by independent public accountants, federal certificates of authority with underwriting limitations (if applicable), and state-established underwriting limitations. If the bond amount exceeds total surety underwriting limitations, reinsurance contracts must be disclosed with details of reinsurers and participation amounts. All reinsurers must satisfy credit for reinsurance requirements under P.L. 1993, c. 243. An authorized certifying agent for each surety must sign the certificate under penalty of law, acknowledging that false statements will render the bond void. The County of Ocean reserves the right to rebid the project or award the contract to the next lowest responsible bidder if the successful bidder fails to deliver compliant Performance and Payment Bonds.
