About this file
This is a Bid Bond Form for Napa County, California, establishing the required bonding instrument for contractors submitting bids on county projects. The form pertains to the Bella House Kitchen and Bathroom Rehab project, a mental health residential facility rehabilitation initiative. The scope of work includes demolition and replacement of kitchen and bathroom equipment, fixtures, casework, flooring finishes, interior painting, and LED lighting installation. The facility will remain occupied during construction, requiring contractors to coordinate activities with facility and county staff to minimize disruption to the 12 residents. A critical constraint limits construction activities to one restroom at a time to ensure continuous availability of facilities for residents. Contractors must not commence work prior to the official notice to proceed date as specified in the contract's Special Provisions.
The bid bond must be submitted on the Napa County form or an equivalent form from a licensed surety insurer and must equal ten percent (10%) of the total bid amount. The surety and principal are jointly and severally liable to Napa County in the penal sum specified, with the surety's liability capped at the stated amount. If the principal is awarded the contract and executes the required written contract and performance and payment bonds within the prescribed timeframe, the bid bond obligation becomes void. Should the county pursue legal action on the bond, the surety is responsible for all costs incurred by the county, including reasonable attorney's fees as determined by the court. All signatures for both principal and surety must be notarized before submission.
