ATTACHMENT D

This attachment identifies local clauses and requirements specific to Stennis Space Center (SSC) and are applicable to task orders issued under the MACC-II by SSC. Other SSC specific project requirements will be cited in full text in individual task order solicitations/orders. Necessary changes to the requirements in this attachment will also be cited in full text in individual task order solicitations/orders. Nothing contained in this Attachment shall relieve the Contractor from complying with other requirements of the MACC-II Solicitation / or Resultant Award.

“This attachment is the Model Request for Proposal for SSC. It identifies local clauses and requirements specific to the task order for SSC. All future projects issued by SSC will include either this listing or a similar listing of local clauses and requirements.”

All work shall be performed in accordance with the specifications and drawings and use the General Wage Determinations, as identified in the List of Attachments located in Section J of this document.

In accordance with the MACC-II contract the following contract clause information is applicable to this Task Order:

PART I - THE SCHEDULE

SECTION B - SUPPLIES OR SERVICES AND PRICE/COSTS

B.1 SUPPLIES AND/OR SERVICES TO BE PROVIDED

The Contractor shall provide all resources (except as may be expressly stated in the contract as furnished by the Government) necessary to deliver and perform the work in accordance with the Description/Specifications/Statement of Work and Drawings provided for this Task Order; your basic contract terms and conditions, drawings, and special conditions provided with this task order.

The work to be performed under this project consists of providing the labor, equipment, tools and materials necessary to complete the construction and/or repair and modify of electrical utility equipment at Building 2311 and equipment utility and control for lock gates at Building 2310. The work also includes the procurement and installation of equipment to be provided new by the contractor as indicated and required for the provision of fully function systems. The types of equipment include but are not limited to transformers, motor control enters, cables, switches, switchboard control systems, consoles, lights, valves, new ductbank, piping, electrical cabinets, concrete, pavement and demolition. Much of the work is in confined spaces. Contractors shall perform all partial construction as suggested on the drawings to ensure down time does not exceed the time frame as indicated on drawing E-002. All termination on main control board, consoles, and testing shall be performed by manufacturer's technicians.

B.2 BID SCHEDULE

CLIN 0001: “Electrical Repairs to Canal Lock Controls” The work consists of providing all labor, equipment, tools and materials necessary to complete the construction and/or repair and modify electrical utility equipment at Building 2311 and equipment utility and control for lock gates at Building 2310. The work shall be performed in accordance with the specifications and drawings and use the General Wage Determinations, as identified in the List of Attachments located in Section J of this document. $________________________

C.1 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

(FAR) (52.211-10) (APR 1984)

The Contractor shall be required to (a) commence work under this task order within ten

(10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later within 365 calendar days after receipt of the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

SSC-H.1 MISSISSIPPI CONSTRUCTION CONTRACT TAX (Applies to all Stennis Task Orders.)

Here is a brief summary of sales and use tax information for construction contractors. The Mississippi Sales Tax Law levies a three and one-half percent (3 1/2%) contractor's tax on all nonresidential construction activities wherein the total contract price or compensation received exceeds Ten Thousand Dollars ($10,000.00).

Prior to commencement of work on such activities, the prime contractor(s) are required to apply for a Material Purchase Certificate (MPC) to identify the contract. For those nonresidential contracts exceeding Seventy Five Thousand Dollars ($75,000.00), the contractor's tax, together with any use tax due, must be paid before work is begun unless a surety bond to guarantee payment of the taxes due is filed with the State Tax Commission.

All contractors without a physical location in Mississippi are required to prepay or bond their contracts over $10,000. Contractors with a physical location in Mississippi are required to bond or prepay their projects that are over $75,000.

The three and one-half percent (3 1/2%) contractor's tax is levied directly against the prime contractor and is due on all non-residential, commercial contracts as described above regardless of whether or not the owner is a governmental, exempt or non-profit entity. For example, a construction contract for the U.S. Government, the State of Mississippi, a nonprofit hospital, or a church is subject to the tax.

The three and one-half percent (3 1/2%) contractor's tax is levied upon the total contract amount or total compensation received. Applies to Stennis Space Center Task Orders Only.

SSC-H.2 ENVIRONMENTAL AND ENERGY CONSERVATION REQUIREMENTS

(Applies to Stennis Space Center Task Orders)

(a) The Contractor shall ensure that all work performed and equipment used to fulfill the requirements of this contract are in compliance with all Federal, state, and local regulations and public laws, and the following NASA SSC directives: SPR 8500.1 Environmental System Procedural Requirements and SPR 8500.2 Environmental Operations and Implementation Program. The Contractor shall provide data on affirmative procurement, waste reduction activity, energy efficient product procurement, and ozone depleting substances in accordance with project specifications.

(b) The Government remains the owner and operator of record for all environmental activities conducted at NASA owned properties unless otherwise documented in a signed agreement between NASA and the Contractor. The Contractor is advised that activities performed at SSC and associated facilities are subject to Federal, state and local regulatory agency inspections to review compliance with environmental laws and regulations. For on-site issues, SSC's Environmental Office will be the single point of contact with Federal and state regulatory agencies and their representatives unless otherwise directed by the Contracting Officer or the Environmental Office. The Contractor shall immediately notify the SSC Environmental Office when contacted by external regulatory agency representatives and shall cooperate fully. The Contractor shall complete, maintain, and make available to the Contracting Officer, SSC Environmental Office, SSC Energy Manager, or regulatory agency personnel all documentation relating to environmental compliance matters under applicable laws. The Contractor shall immediately notify the SSC Environmental Office upon issuance of a Notice of Violation or noncompliance to the Contractor.

(c) Should a Notice of Violation, Notice of Noncompliance, Notice of Deficiency, or similar regulatory notice be issued to the Government as a facility owner/operator on account of the actions or inactions of the Contractor or one of its subcontractors in the performance of work under this contract, the Contractor shall fully cooperate with the Government in correcting any problems and defending against regulatory assessment of any civil fines or penalties arising out of such actions or inactions.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014.

PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination.

08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
