This attachment is the request for proposal for the task order for repair, replacement, and rehabilitation of approximately 28,000 linear feet of the site wide sewer distribution system at NASA, Johnson Space Center in Houston, Texas which is included in the Stennis MACC-II solicitation. It includes JSC clauses and other locally developed requirements specific to the Johnson Space Center. It also provides fill-ins for Federal Acquisition Regulation (FAR) and NASA FAR provisions/clauses. Nothing contained in this attachment shall relieve the Contractor from complying with other requirements of the MACC-II.

This attachment is a model for future JSC task order solicitations to be issued under the MACC- II. Future JSC solicitations will include the same or similar listing of JSC specific requirements.

SECTION 1 – DESCRIPTION OF WORK AND TRANSACTIONS

This Task Order contains by reference all terms and conditions of the awardee’s base IDIQ contract.

This task order contains terms and conditions unique to NASA’s Johnson Space Center Houston, TX and base contract fill-in.

The Contractor shall provide all labor, materials, equipment and supervision necessary for the performance of general construction for the project entitled “Repair Sanitary Sewer System at Johnson Space Center” at Johnson Space Center. All work shall be accomplished in accordance with the Specifications, Drawings, Terms and Conditions of the Master Contract and this Task Order, Davis Bacon Wage Determination, and Approved Project Specific Safety and Health Plan.

BID SCHEDULE

CLIN 0002: Repair Sanitary Sewer System, The project involves repair, replacement, and rehabilitation of approximately 28,000 linear feet of the site wide sewer distribution system at NASA, Johnson Space Center in Houston, Texas. The system consists of 6-inch to 18-inch sanitary sewer pipe of various materials. The construction work will involve excavation up to 20’ depths to remove and replace segments as well as alternate methods to repair and rehabilitate the sanitary sewer system in place. These alternate methods for the required repair and rehabilitation effort include cured-in-place pipe, grease removal, root cleaning, pipe bursting, segment point repairs, and slip-lining. The construction options were selected to keep service interruption to a minimum and allow facilities to remain operational throughout the construction. In addition to the standard work items, the contractor shall determine the need for trench dewatering and by-pass pumping to complete a sanitary sewer line replacement or repair as identified on the contract drawings. The work to be performed under this task order shall consist of providing all labor, tools, equipment, and materials necessary to accomplish all work in accordance with Specification and drawings listed in Attachment J of this task order.

SECTION 2 - CONTRACT TERMS AND CONDITIONS

Firm Fixed Price (NFS) (1852.216-78) (DEC 1988)

The total firm fixed price of this Task Order is: $_ To be completed by the Government.

Note: In accordance with NFS 1852.236-71 If there are any Additive or Deductive Bid Items, All bids shall be evaluated on the basis of the same additive bid items.

ALLOWANCE FOR DELAYS

(a) Work at the Johnson Space Center is subject to frequent and extended delays due to mission simulations, and security requirements. In addition to more typical delays, certain construction activities such as excavation, transporting heavy equipment, and utility outages, may be prohibited during mission simulations. Furthermore, security delays are likely for as long as JSC is operating under heightened security conditions. The Contractor may experience delays caused by the Government and other factors beyond the Contractor’s control. Additional time is included in the project performance period to allow for a specified number of days of delay due to these causes. Normally, contract extensions will not be granted unless the contractor has:

(1) promptly notified the Contracting Officer of each delay as experienced with supporting evidence as necessary,

(2) demonstrated actual delay to its effort and not merely a restriction of work,

(3) demonstrated that the contractor was not experiencing other delays within its control, and was able and willing to perform the scheduled work which could not be performed solely due to the government delay,

(4) shown that the delay days allotted in the performance period have been exceeded, and

(5) met the conditions specified in the applicable contract terms and conditions relating to extensions of the contract performance period.

(b) The number of days allowed for Government delays is 30 days. No extension of time will be given until these days have been exceeded. Contractor should expect security delays of up to 45 minutes when entering the site and allow for those delays, as no contract extension will be granted for these delays.

COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

(NFS) (52.211-10) (APR 1984)

The Contractor shall be required to (a) commence work under this task order within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later within 600 calendar days after receipt of the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

PRINCIPAL PLACE OF PERFORMANCE

The effort required under this task order shall be performed at NASA-Johnson Space Center, Houston, Texas.

(b) The Offeror must list any hazardous material, as defined in paragraph (a) of this clause, to be delivered under this contract. The hazardous material shall be properly identified and include any applicable identification number, such as National Stock Number or Special Item Number.

This information shall also be included on the Material Safety Data Sheet submitted under this contract.

3) Technical Data:

The Contractor shall submit copies of all shop drawings, test reports, equipment data sheets, and any other technical data along with their transmittal sheet(s), JSC Form 262 (August 1, 1993). All samples shall be forwarded to the TMR and shall clearly indicate the Government assigned contract number and task order number. All copies and samples shall be submitted in accordance with Section 01 33 00 of the Specifications (See Section 3 - Attachment 3.3.1).

PROJECT SPECIFIC SAFETY AND HEALTH PLAN REQUIREMENTS

The awardee, as an addendum to its Safety and Health Plan in the basic contract, shall submit a Project Specific Safety and Health Plan to the JSC Contracting Officer prior to issuance of the Notice to Proceed. The Project Specific Safety and Health Plan shall be completed in accordance with this clause; Specification Section 01 41 00.00 80, Contractor Safety and Health Program; and JSC’s Safety and Health Handbook, JPR 1700.1, at http://jschandbook.jsc.nasa.gov/. Approval by the authorized NASA officials is required prior to the commencement of work.

(a) Reference NPR 8715.3, NASA Safety Manual, Appendices. The plan shall include a detailed discussion of the policies, procedures, and techniques that will be used to ensure the safety and occupational health of Contractor employees and to ensure the safety of all working conditions throughout the performance of the contract.

(b) When applicable, the plan shall address the policies, procedures, and techniques that will be used to ensure the safety and occupational health of the public, astronauts and pilots, the NASA workforce (including Contractor employees working on NASA contracts), and high- value equipment and property.

(c) The plan shall similarly address subcontractor employee safety and occupational health for those proposed subcontracts that contain one or more of the following conditions:

(1) The work will be conducted completely or partly on premises owned or controlled by the government.

(2) The work includes construction, alteration, or repair of facilities in excess of the simplified acquisition threshold.

(3) The work, regardless of place of performance, involves hazards that could endanger the public, astronauts and pilots, the NASA workforce (including Contractor employees working on NASA contracts), or high value equipment or property, and the hazards are not adequately addressed by Occupational Safety and Health Administration (OSHA) or Department of Transportation (DOT) regulations (if applicable).

(4) When the assessed risk and consequences of a failure to properly manage and control the hazards warrants use of the clause.

(d) This plan, as approved by the Contracting Officer, will be included in any resulting contract.

Work shall not begin until the Safety and Health Plan is approved by NASA’s Safety and Health Officials.

A letter from the Contractor stating compliance with these provisions is not acceptable.

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.)should be followed.

SECTION 4 – INSTRUCTIONS TO OFFERORS

52.222-5 DAVIS-BACON ACT—SECONDARY SITE OF THE WORK (MAY 2014)

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror’s request for a wage determination for a secondary site of the work.

52.232-18 AVAILABILITY OF FUNDS (APR 1984)

Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

52.233-2 SERVICE OF PROTEST (SEPT 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from

52.204-91 Security/Badging Requirements for Foreign National Visitors and Employees/Representatives of Foreign Contractors MAY 2013 (JSC Procurement Instruction)

(a) An employee of a domestic Johnson Space Center (JSC) contractor or its subcontractor who is not a U.S. citizen (foreign national) may not be admitted to the JSC site for purposes of performing work without special arrangements. In addition, all employees or representatives of a foreign JSC contractor/subcontractor may not be admitted to the JSC site without special arrangements. For employees as described above, advance notice must be given to the Security Office of the host installation [JSC or White Sands Test Facility (WSTF)] at least three weeks prior to the scheduled need for access to the site so that instructions on obtaining access may be provided. Contractors should be aware that approval for access to the site and issuance of a badge may take much longer than three weeks and sufficient lead time must be allowed to accommodate the approval process.

(b) All visit/badge requests for persons described in (a) above must be entered Identity Management and Account Exchange (IdMAX) for acceptance, review, concurrence, and approval purposes. When an authorized company official requests a JSC or WSTF badge for site access, he/she is certifying that steps have been taken to ensure that its contractor or subcontractor employees, visitors, or representatives will not be given access to export-controlled or classified information for which they are not authorized. These individuals shall serve as the contractor’s representative(s) in certifying that all visit/badge request forms are processed in accordance with JSC and WSTF security and export control procedures. No foreign national, representative, or resident alien contractor/subcontractor employee shall be granted access into JSC or WSTF until approved and processed through the IdMAX.

Unescorted access will not be granted unless a favorable National Agency Check (NAC) has been completed by the JSC Security Office, and an approved NASA Foreign National Visitor Security/Technology Control Plan (STTCP), (previously called the Access Control Plan) has been submitted and approved.

(c) The contractor agrees that it will not employ for the performance of work onsite at JSC or WSTF any individuals who are not legally authorized to work in the United States. If the JSC International Visits Coordinator or the contracting officer has reason to believe that any employee of the contractor may not be legally authorized to work in the United States and/or on the contract, the contractor may be required to furnish copies of Form I-9 (Employment Eligibility Verification), U.S. Department of Labor Application for Alien Employment Certification, and any other type of employment authorization document.

The contractor agrees to provide the information requested by JSC or WSTF Security Office in order to comply with NASA policy directives and guidelines related to foreign visits to NASA facilities so that (1) the visitor/employee/ representative may be allowed access to JSC or other NASA centers for performance of this contract, (2) required investigations can be conducted, and (3) required annual or revalidation reports can be submitted to NASA Headquarters. All requested information must be submitted in a timely manner in accordance with instructions provided by JSC or any other center to be visited.

52.223-92 JSC Hazardous Materials Use. (May 2009) (JSC Procurement Instruction)

(a) This clause is JSC-unique, and the requirements are in addition to any U.S.

Environmental Protection Agency, U.S. Occupational Safety and Health Administration, or other state or Federal regulation or statute. Therefore, the following requirements do NOT supersede any statutory or regulatory requirements for any entity subject to this clause.

(b) "Hazardous materials," for the purposes of this clause, consist of the following:

(1) Those materials defined as "highly hazardous chemicals" in Occupational Safety and

Health Administration Process Safety Management Regulation, 29 Code of Federal Regulation 1910.119, without regard for quantity.

(2) Those "extremely hazardous substances" subject to the emergency planning requirements in the Environmental Protection Agency Emergency Planning and Community Right-to-Know Regulation, 40 Code of Federal Regulation 355, Part 355, without regard for quantity.

(3) Those "hazardous substances" subject to the release notification requirements under Environmental Protection Agency's Emergency Planning and Community Right-to- Know Regulation, 40 Code of Federal Regulation 302.4, without regard for quantity.

(4) Any radioisotope material or device that produces ionizing radiation.

(5) Any Class II, III, or IV laser as defined by the American National Standards

Institute No. Z136.1 (1986)

(6) Any explosive or any pyrotechnics

(7) Any pesticide.

(c) The contractor shall develop and maintain an inventory listing the identity and quantity of hazardous materials stored or used onsite at JSC for the performance of the contract.

(d) The contractor shall ensure that the proper training of its employees in the use and inherent hazards of these materials is accomplished prior to use.

(e) The contractor shall notify the JSC Clinical Services Branch (SD3) prior to any initial use or different application of these materials.

(f) The contractor shall use all hazardous materials properly and take all necessary precautions to ensure no harm is done to humans or the environment.

(g) The contractor shall insert the substance of this clause, including this Paragraph F with appropriate changes of designations of the parties, in subcontracts under which hazardous materials will be utilized, or may reasonably be expected to be utilized, onsite at JSC.

(h) In the event the contractor fails or refuses to comply with any aspect of this clause, such failure or refusal may be considered a material breach of this contract.

52.242-90 JSC Super-Flex Work Schedule (MAR 2014) (JSC Procurement Instruction)

Through Super-flex, JSC civil servants are encouraged to utilize the current civil service schedule to work 80 hours in a pay period, while “flexing” every other Friday simultaneously with the Center (first Friday of the JSC pay period). These Fridays are called “Flex Fridays”. Super-flex also expands the use of Work from Anywhere (WFA)/telework.

JSC does not require that our contractor team members adopt a matching schedule.

However, offerors should be aware that many civil servant customers will not be onsite on “Flex Fridays” and the center will go in “weekend mode” on “Flex Fridays”. "Flex Friday weekend mode" provides exceptions for some buildings. 52.242-92 Identification of Employees. (MAY 2013) (JSC Procurement Instruction)

At all times while on Government property, the contractor, subcontractors, their employees, and agents shall wear badges. These Badges will be issued at the following locations:

NASA Badging & Visitor Control Office, located in Building 110 at the Johnson Space Center (JSC) 6:00 a.m. to 5:30 p.m. Monday through Friday excluding holidays; the Sonny Carter Training Facility (SCTF) and the Software Development Integration Laboratory (SDIL) 7:00 a.m. to 3:30 p.m. Monday through Friday excluding holidays; Ellington Field, Building 265, 7:00 a.m. to 11:00 a.m. Monday through Friday excluding holidays; and the Main Gate at the White Sands Test Facility (WSTF) Monday through Friday from 8:00 a.m. to 4:00 p.m. excluding holidays and off every other Friday due to 9/80 hour scheduling. WSTF visitor badges will be issued on a 7-day-a-week, 24-hour-a-day basis. Resident aliens and foreign nationals/representatives shall be issued green foreign national badges.

Each individual who wears a badge shall be required to sign personally for the badge. The contractor shall be held accountable for issued badges and all other related items and must assure that they are returned to the NASA Badging & Visitor Control Offices upon completion of work under the contract in accordance with Security Management Directive (SMD) 500-15, "Security Termination Procedures." Failure to comply with the NASA contractor termination procedures upon completion of the work (e.g., return of badges, decals, keys, Controlled Access Area cards, clearance terminations, JSC Public Key Infrastructure (PKI)/special program deletions, etc.) may result in final payment being delayed.
