a. The Contractor is an independent contractor and not an agent of the Government. This is not a personal services contract in accordance with FAR 37.104 and is being procured as a product and not a service requirement. This is a firm-fixed-price award in accordance with FAR 16.2. There are no inherently governmental functions in accordance with FAR 7.5 associated with this requirement. Funds are currently unavailable for this requirement but are being procured and are expected to be authorized before award in accordance with FAR 52.232-18.

b. Inherent in performing this contract, the contractor shall provide the personnel, supervision, management, and financial capabilities necessary for the efficient and effective administration and control of work requirements. The Contractor shall ensure adequate resources are dedicated to comply with the standards, guidelines and procedures as stated to satisfy the requirements of the contract. The contractor is required to provide all of their own equipment and supplies necessary for the performance of this contract. Should the Government provide any Government furnished property, it will be stated clearly in the contract.

Government furnished property will be managed in accordance with the GOVERNMENT PROPERTY

CLAUSE, FAR 52.245-1.

c. The contractor shall work in accordance with this contract issued by the Contracting Officer (KO). Should the contractor be instructed by an individual other than the Contracting Officer to perform work that it considers a change to the contract; the contractor shall not perform such work and shall immediately notify the Contracting Officer and/or Contracting Officer’s Representative (COR). Any changes to the contract shall only be authorized via a modification issued by a contracting officer at PSNS & IMF.

d. Navy Maintenance Database (NMD). Contractor shall obtain access to NMD to provide electronic communication of work requirements associated to this contract. Access to NMD shall be coordinated through the Contracting Officer’s Representative upon contract award.

Included in the Contractor NMD communications work requirements are Conditions Found Reports (CFR’s;

see C 2.4) whereby the Contractor will identify needed repairs and recommend corrective action during contract performance for those deficiencies discovered which are not covered by the original work item specifications. The CFR shall be submitted via the NMD system within three (3) working days of identification of the requirement. At a minimum, the CFR will include the following:

• Identify contract number, ship and hull number

• Serialized by CFR number

• Identification of the applicable Work Item Specification number

• Date requirement was discovered

• Description of the work requirement

• Specific location of the work

• Recommendation for corrective action

• Recommendation for the appropriate/best time to accomplish the work (i.e. during current availability with or without schedule change).

• Provide supporting rational for the recommendation, such as cost efficiencies, availability of work force, availability of material, premium expenditures, etc.

• Identification of related changes, if any, to production milestones/key events and contract completion date.

If none, so state.

A Rough Order of Magnitude (ROM) cost estimate shall be included as part of the CFR submission in NMD.

The Government Maintenance Team will review the CFR deficiency identified, the Contractor’s recommendation for corrective action, estimate for correctness, and further determine if the work is required and potentially affordable.

If the CFR is inadequate or incomplete, it will be rejected back to the Contractor in NMD. To mitigate this, in many cases, the Government and Contractor will meet, discuss the recommendation for corrective action, make ship checks etc. to determine the full scope of work and evaluate costs prior to submittal of the CFR. If the identified CFR is determined to be necessary, a Request for Contract Change (RCC) will be generated.

In concert with the answered CFR, the RCC will be generated by the Government maintenance team to accomplish the scope of work.

SECTION L

Therefore, the Government encourages offerors to contact the Contracting Officer in writing in order to request an explanation of any aspect of these instructions.

2. A proposal should not simply rephrase or restate the Government’s requirements but rather provide convincing rationale to address how the offeror meets these requirements. Offerors shall assume that the Government has no prior knowledge of their facilities and experience and will base its evaluation on the information presented in the offeror’s proposal.

3. The overall security classification of the proposal shall be UNCLASSIFIED. 5. Relationship between Instructions and Evaluation: Your attention is directed to the functional relationship between Sections L and M of this solicitation. RFCs shall reference the solicitation and specification page and paragraph number and be submitted on a request for clarification form (Attachment J-3) provided with this solicitation. A request for clarification form Attachment J-3 shall be submitted for each question.

b. Proposal Submission Instructions:
