Use of Force (Reference: DODD 5210.56)
1. In cases warranting the use of force, NSF personnel may only use that force reasonably necessary to control or stop unlawful resistance to reach the objective and prevent the unlawful commission of a serious offense. Always use the following principles.
a. Force must be reasonable in intensity, duration, and magnitude.
b. There is no requirement to delay force or sequentially increase force to resolve a situation or threat. NSF personnel will attempt to de-escalate applied force if the situation and circumstances permit. NSF personnel will warn persons and give the opportunity to withdraw or cease threatening actions when the situation or circumstances permit.
c. Warning shots are prohibited. Warning shots are authorized from U.S. Navy and Naval Service vessels and piers in accordance with Chairman of the Joint Chiefs of Staff Instruction 3121.01B, “Standing Rules of Engagement/Standing Rules for the Use of Force for U.S.
Forces,” 13 June 2005.
d. Firearms shall not be fired solely to disable a moving vehicle. When deemed as a threat to DoD assets or persons’ lives, NSF personnel shall use reasonably necessary force and caution when firearms are directed at a vehicle borne threat.
e. If excessive force is used in discharging assigned responsibilities, NSF shall be subject to administrative or judicial action IAW Article 92 of the UCMJ or U.S., local, or HN laws.
2. Special considerations for the use of deadly force. Sentry shall fire shots only with due regard for the safety of innocent bystanders.
Do not fire shots if they are likely to endanger innocent bystanders.
When possible, give an order to “HALT” before discharging a firearm to prevent death or serious bodily harm to others.
a. When you are under hostile attack in protection and recovery operations “involving nuclear weapons or lethal chemical agents,” the presence of innocent bystanders or hostages “must not deter” you from stopping the attack through all means at your disposal.
b. When you discharge a firearm, fire it with the intent of rendering the targeted person or persons incapable of continuing the activity or course of behavior that led you to shoot. Rendering incapable may not require death in every circumstance. Warning shots are not authorized at Naval Support Activity Mechanicsburg.
c. Follow the specialized rules of engagement for protection of assets IAW NTTP 3-07.2.1, “Antiterrorism.”
