2. Where are we stock piling this large amount of material?

Response – stock piling is no longer required.

3. Is it acceptable to mulch the pipe corridor as shown on plans ‘C-201’ and “C-202’?

Response – mulch and tree removal is acceptable.

4. Can the existing topsoil remain in place, provided we meet the required specifications for cleanliness, without the need for stockpiling?

Response – yes, topsoil is no longer being stripped and stockpiled but the cleanliness must still be met. See revised specification 31 10 00 Site Clearing Ad 5.

5. Will the City of Milton be responsible for the removal of the gopher tortoise?

Response – the City of Milton will engage the services of a certified agent who will make the determination of appropriate action/permitting required to move forward with clearing of each location. Those services will be covered by the City.

The following Special Conditions take precedence over, or compliment the Plans and Specifications:

1. ARCHEOLOGICAL FINDS

During any activities which involve excavation or ground disturbance, Contractor shall monitor all construction activities. In the event that fortuitous finds or unexpected discoveries, such as prehistoric or historic artifacts, including pottery or ceramics, stone tools or metal implements, or other physical remains that could be associated with North American cultures or early colonial or American settlement are encountered at any time within the project areas, the Contractor should cease all activities involving subsurface disturbance in the immediate vicinity of such discoveries. If the excavation process uncovers items, or evidence thereof, which might be of archaeological, historic, or architectural interest, Contractor shall to stop work immediately and take all reasonable measures to protect the items in a manner sufficient to avoid additional harm until the significance of the discovery can be determined. If items of significance are discovered, the Owner will contact the appropriate agencies for a determination of required actions. Project activities should not resume in the area without written authorization from the Owner.

In the event that any human remains are unearthed, all work shall stop immediately and the area shall be secured in accordance with local, state, and federal statutes.

2. EASTERN INDIGO SNAKE

The eastern indigo snake is classified as a Threatened species by both the USFWS and the Florida Fish and Wildlife Conservation Commission. “Taking” of eastern indigo snakes is prohibited by the Endangered Species Act without a permit. “Take” is defined by the USFWS as an attempt to kill, harm, harass, pursue, hunt, shoot, wound, trap, capture, collect, or engage in any such conduct. Penalties include a maximum fine of $25,000 for civil violations and up to $50,000 and/or imprisonment for criminal offenses, if convicted. Only individuals currently authorized through an issued Incidental Take Statement in association with a USFWS Biological Opinion, or by a Section 10(a)(1)(A) permit issued by the USFWS, to handle an eastern indigo snake are allowed to do so.

A. IF YOU SEE A LIVE EASTERN INDIGO SNAKE ON THE SITE:

• Cease clearing activities and allow the live eastern indigo snake sufficient time to move away from the site without interference;

• Personnel must NOT attempt to touch or handle snake due to protected status.

• Take photographs of the snake, if possible, for identification and documentation purposes.

• Immediately notify supervisor or the applicant’s designated agent, and the appropriate USFWS office, with the location information and condition of the snake.

• If the snake is located in a vicinity where continuation of the clearing or construction activities will cause harm to the snake, the activities must halt until such time that a representative of the USFWS returns the call (within one day) with further guidance as to when activities may resume.

B. IF YOU SEE A DEAD EASTERN INDIGO SNAKE ON THE SITE:

• Cease clearing activities and immediately notify supervisor or the applicant’s designated agent, and the appropriate USFWS office, with the location information and condition of the snake.

• Take photographs of the snake, if possible, for identification and documentation purposes.

• Thoroughly soak the dead snake in water and then freeze the specimen. The appropriate wildlife agency will retrieve the dead snake.

3. BEAR COMMITMENT

If a Florida black bear is observed in or adjacent to the active work area, cease construction, do not disturb it and allow it to leave the area on its own. Report the sighting immediately to the FWC. The Contractor shall be required to remove garbage from the site daily or provide bear-proof garbage receptacles.

4. GOPHER TORTOISE

Gopher tortoise burrows have been identified along the power transmission line across Site 4 and several locations on Site 2. The burrows are within the proposed clearing and grubbing area. The City intends to engage the services of a Gopher Tortoise Agent who will conduct a 100% site survey of each parcel within 90 days of the commencement of construction. The findings of that survey effort will determine actions to be taken prior to commencement, including applications for permits if necessary. Should a Gopher Tortoise burrow be discovered during construction, the Contractor is cautioned to keep any construction activities outside of a 25 foot radius of the burrows until the relocation has occurred. If a gopher tortoise is observed in the active work area, do not disturb it, cease all work in the area, and allow it to leave the area on its own.

5. COMPLIANCE WITH REGULATORY AUTHORITY

It is the Contractor’s responsibility to satisfy any and all requirements as specified by the Florida Department of Environmental Protection (FDEP), Santa Rosa County, or any other regulatory agency relative to Federal, State or County agencies. Contractor shall be liable for and pay fines or penalties associated with his activities as may be levied by authorities having jurisdiction.

6. ACCLIMATE WEATHER DETERMINATION

The procedure below explains the City’s consideration of claims for a contract time extension due to abnormal weather. All days shall be considered as calendar days.

A. The City maintains a spreadsheet that documents the amount of rainfall for each day of the month for rainfall at the Milton WWTF. The data set time period that will be used is the the period from September 2021 tthrough August 2025.

B. From this spreadsheet the average rainfall for each month is calculated. The source for this historical data can be accessed from the records on file at the Milton WWTF. The spreadsheet which will be used for this project appears at the end of this paragraph.

C. Any time there is a documented rainfall of 0.1” or greater, this is counted as a rainfall day. The official measurement used is rainfall at the Milton WWTF. If another measurement location is desired, this must be proposed and accepted by the City before the beginning of the project.

D. Each month the number of rainfall days is determined by the Contractor and verified by the Engineer. This information shall be submitted with each pay application for the last full calendar month.

E. The number of rainfall days for the month is then compared to the historical recorded average of rainfall days (0.1” and greater of rainfall) for the month.

F. If the number of rainfall days is more than the historical average, then the Contractor has a positive value of rainfall days for the month.

G. If the number of rainfall days is less than the historical average, then the Contractor has a negative value of rainfall days.

H. Upon reaching Substantial Completion for the project, all positive and negative rainfall days for each individual month of the project will be added together for a total number of rainfall days for the project.

I. If this final rainfall day number is a positive number, then the contract has been impacted by that number of rainfall days and the Contract Time will be adjusted accordingly. If the final rainfall day number is either zero or a negative number, then no modification of the Contract Time will be made.

J. The time period for which rainfall days will be considered shall coincide with the dates for commencement of work and Substantial Completion, as defined in the Standard Form of Agreement of the Contract. For partial months, a prorated number of days shall be calculated using the number of Contract days in that month divided by the total number of days in that month, multiplied by the historical number of rainfall days for that month. This calculation shall be rounded to the nearest whole number.

K. If there is a significant, recorded, rainfall event in one, or more, consecutive day(s), the Contractor may submit a claim for additional delay in accordance with the time-frames delineated in paragraph 11.06 of the Standard General Conditions of the Construction Contract. The City will review any such timely filed claim and determine (at the City’s sole discretion) if an additional equitable Contract Time extension is warranted. A decision by the City of such adjustments will occur within a reasonable time of the submission of the claim; the City will not wait until Substantial Completion of the project as described in Item H above.

L. Other than precipitation, the City may, in its sole discretion, consider on a case-by-case basis other abnormal weather conditions (e.g., temperature, tropical storm activity) that the Contractor can affirmatively demonstrate have had an impact on construction. If the Contractor believes such an event has occurred, the Contractor may submit a claim for additional delay in accordance with the time-frames delineated in paragraph 11.06 of the Standard General Conditions of the Construction Contract. The City will review any such timely filed claim and determine (at the City’s sole discretion) if an equitable Contract Time extension is warranted. A decision by the City of such adjustments will occur within a reasonable time of the submission of the claim; the City will not wait until Substantial Completion of the project as described in Item G above.

SECTION 31 10 00 - SITE CLEARING

PART 1 - GENERAL

1.1 RELATED DOCUMENTS

A. Drawings and general provisions of the Contract, including General and Supplementary Conditions and Division 01 Specification Sections, apply to this Section.

1.2 SUMMARY

A. Section Includes:

1. Protecting existing vegetation to remain.

2. Removing existing vegetation.

3. Clearing and grubbing.

4. Stripping and stockpiling topsoil.

5. Temporary erosion and sedimentation control.

1.3 DEFINITIONS

A. Subsoil: Soil beneath the level of subgrade; soil beneath the topsoil layers of a naturally occurring soil profile, typified by less than 1 percent organic matter and few soil organisms.

B. Surface Soil: Soil that is present at the top layer of the existing soil profile. In undisturbed areas, surface soil is typically called "topsoil," but in disturbed areas such as urban environments, the surface soil can be subsoil.

C. Topsoil: Top layer of the soil profile consisting of existing native surface topsoil or existing in-place surface soil; the zone where plant roots grow. Its appearance is generally friable, pervious, and black or a darker shade of brown, gray, or red than underlying subsoil; reasonably free of subsoil, clay lumps, gravel, and other objects larger than 2 inches (50 mm) in diameter; and free of weeds, roots, toxic materials, or other nonsoil materials.

D. Plant-Protection Zone: Area surrounding individual shrubs or other vegetation to be protected during construction and indicated on Drawings.

E. Tree-Protection Zone: Area surrounding individual trees or groups of trees to be protected during construction and indicated on Drawings.

F. Vegetation: Trees, shrubs, groundcovers, grass, and other plants.

1.4 MATERIAL OWNERSHIP

A. Except for materials indicated to be stockpiled or otherwise remain Owner's property, cleared materials shall become Contractor's property and shall be removed from Project site.

1.5 INFORMATIONAL SUBMITTALS

A. Existing Conditions: Documentation of existing trees and plantings, adjoining construction, and site improvements that establishes preconstruction conditions that might be misconstrued as damage caused by site clearing.

1. Use sufficiently detailed photographs or video recordings.

2. Include plans and notations to indicate specific wounds and damage conditions of each tree or other plant designated to remain.

1.6 FIELD CONDITIONS

A. Traffic: Minimize interference with access road.

1. Do not close or obstruct access road without permission from Owner and authorities having jurisdiction.

2. Provide alternate routes around closed or obstructed access ways if required by Owner or authorities having jurisdiction.

B. Utility Locator Service: Notify Sunshine One Call for area where Project is located before site clearing.

C. Do not commence site clearing operations until temporary erosion- and sedimentation-control are in place.

D. Soil Stripping and Handling: Perform only when the soil is dry or slightly moist.

PART 2 - PRODUCTS

PART 3 - EXECUTION

3.1 PREPARATION

A. Protect and maintain benchmarks and survey control points from disturbance during construction.

B. Verify that trees, shrubs, and other vegetation to remain or to be relocated have been flagged and that protection zones have been identified and enclosed.

3.2 TEMPORARY EROSION AND SEDIMENTATION CONTROL

A. Provide temporary erosion- and sedimentation-control measures to prevent soil erosion and discharge of soil-bearing water runoff or airborne dust to adjacent properties, according to erosion- and sedimentation-control Drawings and requirements of authorities having jurisdiction.

B. Verify that flows of water redirected from construction areas or generated by construction activity do not enter or cross protection zones.

C. Inspect, maintain, and repair erosion- and sedimentation-control measures during construction until permanent vegetation has been established.

D. Remove erosion and sedimentation controls, and restore and stabilize areas disturbed during removal.

3.3 TREE AND PLANT PROTECTION

A. Protect trees and plants remaining on-site.

B. Repair or replace trees, shrubs, and other vegetation indicated to remain or be relocated that are damaged by construction operations.

3.4 CLEARING AND GRUBBING

A. Remove obstructions, trees, shrubs, and other vegetation.

1. Grind down stumps and remove roots larger than 2 inches in diameter, obstructions, and debris to a depth of 6 inches below exposed subgrade.

2. Use only hand methods or air spade for grubbing within protection zones.

3. Chip removed tree branches and dispose of off-site, or burn as approved by the Division of Forestry .

B. Fill depressions caused by clearing and grubbing operations with satisfactory soil material unless further excavation or earthwork is indicated.

3.5 DISPOSAL OF SURPLUS AND WASTE MATERIALS

A. Remove surplus soil material, unsuitable topsoil, obstructions, demolished materials, and waste materials including trash and debris, and legally dispose of them off Owner's property.

B. Burning tree, shrub, and other vegetation waste is permitted according to burning requirements and permitting of authorities having jurisdiction. Control such burning to produce the least smoke or air pollutants and minimum annoyance to surrounding properties. Burning of other waste and debris is prohibited.

INTRODUCTION

Applicants to Santa Rosa County for various development activities have numerous submittal requirements. As part of the county’s development review process, an applicant may be asked to provide specific information relating to “Environmentally Sensitive Lands” to assist county staff in determining if the proposed project complies with established development standards. The document conveying the requisite technical information is called a "Site Specific Survey for Environmentally Sensitive Lands.”

UES formulated this Site-Specific Survey report to identify features potentially subject to the protections articulated in Chapter 3 of Santa Rosa County’s Land Development Code (LDC). The current version of the LDC can be viewed online at Santa Rosa County LDC.

Per the objectives of the resource protection standards, the Site-Specific Survey report conveys the following as relates to the subject property:

• A site location map (Exhibit 1) for orientation and general reference;

• A reproduction of a portion of the U.S. Geological Survey (USGS) 7.5-minute topographic map for the appropriate quadrangle (Exhibit 2);

• A current aerial image of the site (Exhibit 3);

• Identification of the U.S. Department of Agriculture Natural Resource Conservation

Service (NRCS) soil series underlying the site (Exhibit 4);

• A map indicating the proximity of the subject property to known (mapped) environmentally sensitive lands (Exhibit 5), which may include any of the following:

o Aquatic preserves, including the Yellow River Marsh Aquatic Preserve and the

Escambia River Water Management Area o Outstanding Florida Waters o Essential Fish Habitat (including seagrass beds) o FEMA >1% flood hazard zone o Potable water wells and wellhead protection zones o Water Resource Concern Areas;

• Presentation of the results of a wetland jurisdictional determination and delineation (Exhibit 6), It is the City of Milton’s intent to establish the western property boundary to coincide with the wetlands boundary identified, to avoid impacts;

• Presentation of any present natural communities (Exhibit 7);

• Presentation of the results of an imperiled species survey, including a graphical depiction of habitat limits or population locations (Exhibit 8, if present);

• United States Fish and Wildlife Service (USFWS) Information for Planning and Consulting

(IPaC) on the federally threatened and endangered species likely to be found on the site (Attachment A)

• Florida Natural Areas Inventory (FNAI) Element Occurrence data on the state threatened and endangered species likely to be found on the site (Attachment B)

• Presentation of the results of a protected tree inventory (Exhibit 9, if present) will follow in a separate report.

SITE LOCATION AND TOPOGRAPHY

A Site-Specific Survey for Environmentally Sensitive Lands was conducted on the approximately 7.58-acre corridor located approximately 1.1 miles north of Highway 90 in Milton, Florida (Exhibit 1). The site includes portions of five different parcels identified as parcel numbers 27-2N-27- 0000-00200-0000, 22-2N-27-0000-00202-0000, 22-2N-27-0000-00203-0000, 22-2N-27-0000- 00204-0000, and 22-2N-27-0000-00205-0000 by the Santa Rosa County Property Appraiser. It is approximately 200-foot wide and spans approximately 1,650 feet. According to the United States Geological Survey (USGS) Quadrangle topographical map, elevations onsite range between approximately 130 to 140 feet above sea level and gently slopes from south to north (Exhibit 2).

The site is primarily undeveloped and includes a portion of a powerline easement along the western boundary (Exhibit 3). Outside of the easement, the site consists primarily of successional uplands with a small man-made pond and depressional wetlands on the southern portion of the property. There are also several unpaved trails that transect through the property.

SOIL TAXONOMY

Applications for development approval for sites to be served by an onsite stormwater management system and located in a soil series that poses moderate to severe limitations to development require detailed soil analysis. To aid the applicant and staff in determining the suitability of proposed stormwater management systems, a map depicting the United States Department of Agriculture Natural Resource Conservation Service (NRCS) web soil survey results is included as Exhibit 4. The NRCS depicts the site as being underlain by the Lakeland, Troup, and Bonifay soil series.

Bonifay ST2 (non-hydric) The Bonifay series consists of very deep, well drained, moderately slowly permeable soils on ridges and side slopes in the Southern Coastal Plain. They formed in thick beds of sandy and loamy marine sediments. Near the type location, the mean annual temperature is about 68 degrees F., and the mean annual precipitation is about 55 inches. Slopes range from 0 to 12 percent. Taxonomic class: Loamy, siliceous, subactive, thermic Grossarenic Plinthic Paleudults.
