E.2 Inspection
The above inspection clauses apply to delivery orders under this contract, as applicable. In the absence of other agreements negotiated with respect to time provided for Government review, deliverables will be inspected and the Contractor notified of the Government Technical Representative’s findings within seven (7) calendar days of normally scheduled review.
Unacceptable or unsatisfactory work will be handled as outlined in the QASP (see Section G and Section J attachments).
Inspection of all items delivered, pursuant to orders placed under this contract (including data items), shall be accomplished by a duly authorized representative of the Government agency placing the order. Inspections shall be conducted in conjunction with the GSA Contracting Officer and/or Contracting Officer's Representative (COR). Items will be inspected upon receipt at the place of delivery. Inspection shall ensure that items are delivered undamaged, and conform to the Statement of Work requirements and any standards referenced therein. T2SDT will be monitored for contract compliance on an ongoing basis as designated in the QASP.
All T2SDT delivery order work shall be subject to review by the USSOCOM task technical manager. The work shall be in accordance with USSOCOM policy as identified in technical orders, regulations, instructions, or subsequent superseding documentation; or as conveyed to
E − 2 of 3 contractor personnel by the USSOCOM Client Representative (CR) and/or Alternate Client Representative (ACR) or their designee(s) through the Contractor's Program Manager.
E.3 Acceptance
Acceptance of all items under this contract (including reporting and data requirements) shall be accomplished by the Contracting Officer, in conjunction with the GSA COR and other duly authorized representative of the Government. Only the Contracting Officer is authorized to accept nonconforming items or services. When applicable, acceptance of priced items will not be made unless accompanied by acceptable related Not-Separately-Priced items. Unless otherwise stipulated, approval of invoices for payment shall constitute acceptance of performance. Acceptance shall occur at the delivery location, unless otherwise indicated in the individual delivery orders.
For this contract, the duly authorized representatives are the CR (Client Representative) and ACR (Alternate Client Representative) (See Section G). The CR or ACR shall be responsible for inspection and recommended acceptance by the Government for all deliverables, including special tasks, data, and reports. For each task levied on the Contractor, the designated task technical manager may be designated by the CR or ACR to perform the initial evaluation and make the initial acceptance recommendation of all services performed and items delivered.
E.4 Acceptance or Rejection Notice
The inspecting official shall make every effort to notify the GSA Contracting Officer, COR, and the Contractor of the acceptance or rejection of the items within seven (7) calendar days of delivery. For serious delivery infractions the GSA Contracting Officer will follow up with a notification to the Contractor, seeking a remedy to the problem. If a deliverable is rejected, the Contractor shall take appropriate corrective action and re-submit the deliverable for inspection within ten (10) calendar days of receiving the rejection notice or within a different period as mutually agreed to by the parties. The Contractor is authorized to bill for all delivered items that have been accepted.
E.5 Title
Unless specified elsewhere in this contract, title to items furnished under this contract shall pass to the Government upon acceptance, regardless of when or where the Government takes physical possession.
