Questions and Answers for HTC711-14-R-R003 Call 0003

Stevedoring and Related Terminal Services (S&RTS) Pacific Northwest Solicitation

Questions 1-8

QUESTION# 1: Does the stevedore company have to maintain terminal space at each port?

Reference PWS Section 6.1 Page 9 Paragraph 1

ANSWER: At the Pacific Northwest No the stevedoring company does not have to maintain terminal space at each port.

QUESTION# 2: What will be the minimum lead time for each vessel call?

Reference Section 5.13.l Page 7 Paragraph 1

ANSWER: There is no established lead time for a vessel call.

QUESTION #3: Will the stevedore company be required to maintain a presence at each referenced port when no vessel is at the berth?

Reference Section 5.5 Page 7 Paragraph 1

ANSWER: There is no requirement to maintain a presence at a port. Just the ability to work at the ports designated in the PWS.

QUESTION #4: Please describe the process for approving/declining stevedore company identified transactional and other costs/out of pocket expenses.

Reference Section 5 .12 Page 7 Paragraph 1

ANSWER: Invoices and supporting documents are submitted to the cognizant COR for verification and forwarded to the payment authority. All additional costs and/or out-of-pocket expenses are approved with the COR in advance.

QUESTION #5: What level of HAZMAT endorsement will be required for all drivers and who will conduct the training/certification?

Reference Section 3 .1 .3 Page 5 Paragraph 1

ANSWER: In the Pacific Northwest Commercial Ports the training and certification will be what is required by the PMA to operate on the commercial ports facility handling those commodities.

QUESTION #6: The section states in part "All Contractor personnel who operate U.S Government or Contractor furnished munitions laden vehicles shall possess an approved license with HAZMA T endorsement. The Contractor shall provide the COR with a list of drivers being used each day to handle ammunition". Please confirm this applies just to tractor drivers or does this apply to tractor drivers, forklift drivers, crane operators, etc?

Reference Section 3.1.3 Page 5 Paragraph 1

ANSWER: In the Pacific Northwest Commercial Ports the training and certification will be what is required by the PMA to operate on those ports handling those commodities with a specified piece of equipment (crane, forklift, tractor). Historically ammunition has not been handled at the commercial ports. If authorized additional planning for safety of this type of operation would be conducted between the PNW DET and the contractor to ensure all safety requirements of the Port are being met.

QUESTION #7: The CBA ended on June 30th 2014, and currently the PMA and the IL WU are negotiating a new CBA. We do not yet know what the new labor wage rates and man hour assessments will be for the new CBA. Therefore would you like us to calculate our commodity and man hour rates for the base year of the contract on the old CBA labor wage rates and man hour assessments? Please confirm? Would those commodity and man hour rates then be adjusted for the new labor wage rates and man hour assessments according to a request to the COR under FAR 252.24 7-7002 once the negotiation of the new CBA is concluded? Would we also calculate the option periods in the same manner, ie using the old CBA labor wage rates and man hour assessments, and then request adjustment under FAR 252.24 7-7002?

Reference Attachment 3 The CBA Memorandum of Understanding (MOU) between PMA and the ILWU

ANSWER: Calculate commodity and man hour rates using old CBA labor wage rates and man hour assessments. IA W FAR 22.1012-2(b ), "For contractual actions other than sealed bidding, a new or changed collective bargaining agreement shall not be effective under section 4( c) of the Act if notice of the terms of the new or changed collective bargaining agreement is received by the contracting agency after award of a successor contract or a modification as specified in 22.1007(b ) ... Any notice of the terms of a new or changed collective bargaining agreement received by the agency not less than 10 days before commencement of the work shall be effective for purposes of the successor contract under section 4( c) of the Act." If notification of a new or changed CBA is received after 10 days prior to the start of contract performance or once contract performance begins, a wage adjustment must be requested in accordance with DFARS 252.247-7002.

QUESTION #8: Requirement states: "Offerer' s proposal provides information (e.g. , manufacture's specifications, test results, vendor certification) validating that its heavy tow equipment has the capacity and ability to retrieve deadline, inoperable, track-off and wheeled vehicles up to the weight specified in the "call" specific PWS on and off vessels with deck clearance as low that specified in the "call" specific PWS." JSC owns a substantial amount of equipment that meets the PWS requirements. To provide the required documentation for this solicitation would exceed the page limit requirement of this section of the solicitation. Is it acceptable to list the owned equipment that meets the requirement in a summarized format indicating the capabilities? If awarded the contract all manufacturer documentation could be provided at that time. Reference Section: Addendum to 52.212-2 Subfactor 1 - Technical Approach (le) Page: 7 Paragraph: 1

ANSWER:

All proposals received shall be incompliance with Atch 1 FAR PART 12 Instructions to Offereors & Evaluations.

In Accordance with page 3, Subfactor 1 - Technical Approach page limitation for this shall be no more than 25 pages (Note: a single side is considered one page).

Page 7 - Each offeror's Technical Proposal will be evaluated as Acceptable or Unacceptabl at the subfactor level as defined below.
