Amendment Number A00005

14A. This Amendment is issued to answer the following questions submitted in response to this Solicitation.

QUESTION: Page – 11, Clin 0007 Standard Transportation Services Discussion: Clin 0007: Standard Transportation Services and Subsequent Option Year Clin’s -The Clin request a flat mileage Rate based on driver and other cost. Actual cost to the Government will vary greatly depending on how far the contractor has to travel to reach different depending on the Contractors location in relation to the destination of the boat. In other words Contractor A has to travel 25 miles to deliver a boat and Contractor B has to travel 100 miles to deliver the same boat. The Governments cost will be four time as much if contractor B delivers the boat then if Contractor a delivers the boat. Will the Contractors location in regard to possible destination points and cost to the Government be evaluated in the in a manner that takes the Contractors location a consideration factor in the selection process?

ANSWER: The Government understands the price will vary depending on the Offeror’s location and point of delivery for boats, therefore, the proposed mileage rate shall be evaluated for reasonableness only.

QUESTION: Page 4, Clin 003 Full load Operational Test Discussion: Clin 0003 and Subsequent Option Year Clin’s require the Contractor to work on the water and waterfront. The Longshore and Harbor Workers Act of 1927 requires that employees working on the water or waterfront be covered by USL&H workers compensation insurance. Is USL&H workers compensation insurance a requirement for this solicitation?

ANSWER: The Longshore and Harbor Workers Compensation Act does not apply therefore USL&H workers compensation is not required.

QUESTION: Discussion: Clin 0007: Standard Transportation Services and Subsequent Option Year Clin’s - The Clin request a flat mileage Rate based on driver and other cost which includes fuel cost. We are willing to estimate the Base year transportation cost on current fuel prices but for the option years of the contract cost of fuel is an unknown that cannot be calculated using normal inflation factors. Will the Government consider including a fuel surcharge based on the difference between the established base year fuel cost and each option year fuel cost? Example: Current fuel cost for diesel fuel in our area is $4.00 per gallon and in option year one the cost is $4.50 a gallon. The difference would be $.50 a gallon and the surcharge would be a percentage based on fuel consumption of the tow vehicle. Conversely if in the option year fuel prices dropped to $3.50 a gallon the Government would receive a discounted rate based on the a percentage based on fuel consumption of the tow vehicle. As an option will the Government consider providing a base rate cost per gallon to be used for all option years and adjust up or down with each option year based on current fuel cost?

ANSWER: Yes, and no. The Government understands the volatility of fuel prices. The Government cannot advise Offeror’s how to submit price proposals. The Government will, however, consider the volatility of prices during performance of the contract and negotiate with the awardee when it becomes necessary. The Government will not revise the solicitation at this time. As stated in the first question/answer, the proposed rate shall be evaluated for reasonableness only.
