ANSWER: Yes.
QUESTION: Section 1.6., page 14: Will OCONUS travel be required with any of the task orders?
ANSWER: Yes, travel may be required to support pilots and content reviews. However, in recent history (past 6 years) we have not had any OCONUS travel.
QUESTION: Section 3.4., page 18: Are all technologies listed in the RFP provided as GFE? For example, will the Government provide all the technologies listed under 3.4 including Composica licenses, streaming media server, and communication technologies that expand the classroom?
ANSWER: Government will provide access to applications if deemed necessary. There are a few technologies where the contractor will work closely with the DAU project team (internal access only) to update content.
QUESTION: I saw your solicitation today and wanted to ask if this was pertaining to specific content for deliverables or as a whole you are looking for design and development services to work with Subject Matter Experts onsite.
ANSWER: Specific content will be identified at the task order level.
QUESTION: Page 62 of 98, 52.203-2 CERTIFICATE OF INDEPENDENT PRICE DETERMINATION (APR 1985). Would the Government please clarify if 52.203-2 Certificate of Independent Price Determination need to be included in the price proposal?
ANSWER: Yes. Section L is updated to include this Certificate in the Cost/Price Volume.
QUESTION: Page 75 of 98, 252.215-7009 PROPOSAL ADEQUACY CHECKLIST, In the Proposal Adequacy Checklist section, it states, “The offeror shall complete the following checklist, providing location of requested information, or an explanation of why the requested information is not provided.” Would the Government please clarify which volume to insert the Proposal Adequacy Checklist?
ANSWER: Yes. Section L is updated to include the Proposal Adequacy Checklist in the Cost/Price Volume.
QUESTION: Page 86 of 98, 2. Submission Requirements, 2.1 Administrative Documents, Would the Government please confirm that subcontractor employees are included as offerors and there would not be a need to complete a “Certificate of Proposal Preparation” for subcontractor employees?
ANSWER: The Government requires the offeror to complete the Certificate of Proposal Preparation; sub-contractors and do not require certificates from them.
QUESTION: Page 9 & 10 of 18, Factor 1 Corporate Experience and Factor 2 Past Performance. Amendment 1, Factor 1 Corporate Experience, page 9, states “Relevant corporate experience is experience (within the past five years) that is of the same or similar scope, magnitude (performing $5,000,000.00 annually), and complexity.” Would the Government please clarify if the $5M annually is a total across Corporate Experience combined or does the Government mean $5M per year for each Past Performance example?
ANSWER: See Section L and Section M for revised magnitude definition.
QUESTION: Page 9 & 10 of 18, Factor 1 Corporate Experience and Factor 2 Past Performance. Amendment 1, Factor 1 Corporate Experience, page 9, states “Relevant corporate experience is experience (within the past five years) that is of the same or similar scope, magnitude (performing $5,000,000.00 annually), and complexity.” Given the $15M size standard, would the Government consider allowing the SB Corporate Experience contract value to be a total contract value acceptable vs. $5M annually to make this a more competitive bid?
ANSWER: See Section L and Section M for revised magnitude definition.
QUESTION: In accordance with the draft Performance Work Statement issued for these requirements on May 31, 2019, the Government initially intended to compete these requirements as a Woman-Owned Small Business (WOSB) set-aside. This Request for Proposal is now open to all small businesses under NAICS 611710. Why did the procurement strategy change?
ANSWER: It’s the Contracting Officer’s discretion to change the procurement strategy.
QUESTION: In the draft Performance Work Statement issued on May 31, 2019, the Government noted an intent to issue multiple Indefinite Delivery, Indefinite Quantity (IDIQ) awards. On page 2, Section B.1, the solicitation indicates that the Government “intends to issue a single award Indefinite Delivery, Indefinite Quantity (IDIQ) contract”. Why did this aspect of the procurement strategy change?
ANSWER: It’s the Contracting Officer’s discretion to change the procurement strategy.
QUESTION: Page 2, Section B.2: This section indicates that “the type of order authorized under this contract is Cost-plus-Fixed-Fee Completion and Firm-Fixed-Priced.” Attachment 5 does not include space for a firm-fixed price estimate, and the solicitation does not contain instructions regarding which requirements to use as a basis for the firm-fixed price estimate. Can the Government clarify what portion of the contract is contemplated to be issued as a firm-fixed price order? In addition, can the Government provide instructions on how Offerors should present a firm-fixed price estimate using Attachment 5 – Pricing Template?
ANSWER: See tab Menu of FBLRs.
QUESTION: Pages 86-88, Submission Requirements: This section indicates that the Non Price/Cost Volume shall include up to 6 pages for Factor 1 – Corporate Experience and up to 6 pages for Factor 2 – Past Performance. This does not allow for Offerors to propose a technical approach and methodology for meeting DAU’s requirements and demonstrating the potential innovation and value we stand to bring to the Government. Can the Government clarify why a technical approach is not required in this submission?
ANSWER: It’s the Contracting Officer’s discretion to change the evaluation criteria.
QUESTION: Page 87, Factor 2 – Past Performance: This section indicates that relevant past performance is performance under contracts or efforts of similar scope and magnitude, which equals performing $5,000,000 annually. Given that this solicitation is being competed amongst small businesses that fit under the threshold of $15,000,000 – as dictated by NAICS code – it is not reasonable to expect a small business to provide 3 examples of contracts performing at this dollar value annually. Will the Government consider revising its definition of relevance in terms of scope and magnitude so that it more accurately the size of efforts performed by small businesses?
ANSWER: See Section L and Section M for revised magnitude definition.
QUESTION: Can the vendor use different projects for Corporate Experience (factor 1) and Past Performance (factor 2)?
ANSWER: Yes.
QUESTION: Can we propose additional key personnel and resumes than the ones proposed in the solicitation?
ANSWER: This requirement has no key personnel requirement. Section C: Key functions is revised to remove references of key personnel.
QUESTION: Where does the vendor provide key personnel resumes? Which section? Can key personnel resumes be excluded from the 6 page limitation?
ANSWER: This requirement has no key personnel requirement. Section C: Key functions is revised to remove references of key personnel.
QUESTION: Does all corporate experience and past performance need to be $5M annually or majority of the corporate experience and past performance need to be $5M annually?
ANSWER: See Section L and Section M for revised magnitude definition.
QUESTION: In the absence of a technical volume, can the government allocate 1 additional page for corporate overview/executive summary?
ANSWER: No; offerors shall submit the technical volume in accordance with the RFP.
QUESTION: On pricing attachment 5, can the government make the "Composite Team" tab as "optional" or remove it from submission? It is harder to determine the % work share by labor category until we see the task orders released and determine which labor category need to be engaged by each subcontractor according to the Task order requirements.
ANSWER: No.
QUESTION: On pricing attachment 5, if the subcontractor’s rates are within the Prime vendor ceiling rate structure, do the subs have to submit a separate rate build up package? Please advise.
ANSWER: Yes.
QUESTION: On pricing attachment 5, in the "Cost Element Summary" column "H" 52.217-8 "Option to Extend Services" is the vendor required to calculate the 6 month extension pricing? Please confirm.
ANSWER: Yes.
QUESTION: General. The Draft RFP released by the Government on 14 June 2019 bears very little resemblance to the Final RFP released by the Government less than two months later on 9 August 2019. Specifically, the Government completely changed the evaluation criteria, introduced an exceptionally high dollar value for relevant experience and past performance for offerors, removed all non-price criteria except experience and past performance, and changed the award type from multiple award to single award (which defies the FAR guidance re: a preference (e.g.: ‘must’) for multiple awards – see FAR 16.504(c)(2) – especially when the responses to the RFI/Sources Sought was, according to DAU, ‘significant’). These changes have very significant impact on teaming and preparation by small businesses. To be more direct, these changes – and the fact that the proposal timeline allows inadequate time to accommodate them -- will directly prevent many small businesses who had expressed interest in this procurement from bidding. The changes appear to be designed to limit competition, a practice the FAR discourages and that the Defense Acquisition University specifically trains its thousands of students to avoid.
Recommend the Government cancel the current Final RFP and re-issue it as a Draft RFP on which interested potential offerors can comment and ask questions. This action would enable interested bidders to suggest alternative approaches and (in the absence of a change by the Government) provide adequate time for small businesses to prepare appropriate teaming relationships to pursue the effort. It would also provide evidence that the Government is open to competition and interested in providing fair opportunity for small business offerors.
ANSWER: The Government will not cancel the Final RFP.
QUESTION: Section L, 2, Submission Requirements, Factor 1, Corporate Experience, and Factor 2, and Factor 2, Past Performance, pages 86-88. The NAICS code (611710) under which the effort is issued has a Small Business Size Standard of $15 million in average annual receipts. The RFP establishes a relevance threshold that deems any contract with revenues less than $5M per year as not relevant to the requirement. The great majority of small businesses with less than $15M in annual revenues do not have any contracts with revenues at or greater than $5M per year. This requirement appears to be designed to limit competition. Recommend the Government change the annual revenue relevance requirement to a level that is much more realistic in enabling assessment of small business capability (e.g., $500,000 in annual revenue).
ANSWER: See Section L and Section M for revised magnitude definition.
QUESTION: Section L, 2, Submission Requirements, Factor 1, Corporate Experience, and Factor 2, and Factor 2, Past Performance, pages 86-88. The current LADSS contract (competed on an unrestricted basis and currently executed by a large business) has average revenues of approximately $3 million annually. The referenced portions of the RFP state, “Relevant corporate experience is experience (within the past five years) that is of the same or similar scope, magnitude (performing $5,000,000.00 annually), and complexity.” The RFP has established a relevance magnitude threshold that is not aligned with execution under the current contract. This requirement appears to be designed to limit competition on a basis that is not realistic given the workload experienced under the existing contract. Recommend the Government change the definition of magnitude to a level that is more reflective of current execution. Specifically, recommend the Government establish that at least one of the three contracts submitted by the offeror demonstrate performance of $3M annually (in line with current LADSS execution), with the other two demonstrating performance of at least $500,000 annually.
ANSWER: See Section L and Section M for revised magnitude definition.
QUESTION: References: HQ003419R0166 Amendment 1, pp. 15 and 16 of 18; and the two RFP Attachments for Corporate Experience (Atch 2) and Past Performance (Atch 3). Can the Government confirm that references to “performing $5,000,000 annually” for the evaluations of Corporate Experience and Past Performance refers to the sum total of an Offeror’s annual workload in each of those two areas? We ask this question to clarify that the sum of the Offeror’s submitted Corporate Experiences forms must be at least $5M annually, and the sum of the Offeror’s submitted Past Performances forms must be at least $5M annually—and that the $5M figure is not a by task order or by contract requirement.
Under the Government’s RFP requirements, the current unrestricted predecessor contract would not be evaluated as relevant. Since the prime contractor for the current LADSS contract is a large business, that contractor cannot compete as a prime on LADSS.
There are many small businesses supporting the current LADSS contract. Some of these contractors have been supporting the contract for 10 years and bring work that is identical in scope and highly relevant in terms of complexity. Obviously, since the total value of the current LADSS contract (at the prime level) does not meet the relevance threshold, none of the work performed under LADSS subcontracts meets the relevance threshold due solely to the unrealistically high annual dollar value threshold. This requirement appears to be designed to limit the size of the competitive field and results in eliminating a set of small businesses that have the most relevant past performance on LADSS. Recommend the Government change the definition of relevance for corporate experience and past performance. Specifically, recommend the Government establish that at least one of the three contracts submitted by the offeror demonstrate performance of $3M annually (in line with current LADSS execution), with the other two demonstrating performance of at least $500,000 annually. Additionally, recommend execution under the current LADSS contract be awarded a higher relevance score than any other past performance references.
ANSWER: See Section L and Section M for revised magnitude definition.
QUESTION: Section L, 2, Submission Requirements, Factor 1, Corporate Experience, and Factor 2, and Factor 2, Past Performance, pages 86-88. Because the NAICS code (611710) under which the effort is issued has a Small Business Size Standard of $15 million in average annual receipts, and because the great majority of small businesses with less than $15M in annual revenues do not have any contracts with revenues at or greater than $5M per year, the overwhelming majority of offerors will be forced to use the past performance of large business subcontractors to meet the past performance requirements. The removal of all non-price criteria except experience and past performance combined with the definition of relevance as contracts with a value higher than $5M per year creates a situation where the Government could have absolutely no information to use in evaluating the technical capability of the small business prime contractor. Since the Small Business Set Aside designation requires delivery of more than 50% of the work by small business providers, the Government is establishing an environment where it could make a selection of a prime provider with no information on that prime’s technical capability. If this requirement is not deliberately designed to limit competition to the very low number of small businesses who have relevant scope and complexity contracts with $5 million or more in annual revenues, it presents a situation where the Government invites risk by failing to evaluate the technical capability of the selected prime contractor.
Recommend the Government change the definition of magnitude to a level that guarantees evaluation of the prime contractor’s experience and capability. Specifically, recommend the Government establish that at least one of the three contracts submitted by the offeror demonstrate performance of $3M annually (in line with current LADSS execution), with the other two demonstrating performance of at least $500,000 annually. Additionally, require that at least one contract reference be provided by the prime offeror.
ANSWER: See Section L and Section M for revised magnitude definition.
QUESTION: Section M, 1.0 Evaluation Criteria, 1.1, Factor Identification. The Government’s 14 June 2019 LADSS Draft RFP included three non-price factors: Technical Approach (with subfactors including Performance Approach, Project Planning and Technical Approach, and Corporate Experience); Management Approach; and Past Performance. Additionally, the Draft RFP provided offerors with a total of 36 pages to provide their approaches and credentials. In contrast, the Final RFP issued 9 August 2019 included only Corporate Experience (limited to six pages and three references) and Past Performance (limited to six pages and three references). It appears that in less than two months’ time, the Government decided that it no longer needed to know if the small business offeror could deliver the technical and management approaches and credentials to meet DAU’s specific requirements. These actions appear to be intended to limit the competitive field and shorten the review process by removing important criteria that should be used to evaluate the approach and capabilities of offerors.
Recommend the Government cancel the current Final RFP and re-issue it as a Draft RFP on which interested potential offerors can comment and ask questions, including questions on how the Government intends to evaluate the offeror’s DAU LADSS-specific approaches, methods, and technical/management delivery mechanisms. This action would enable interested bidders to suggest alternative instructions and evaluation approaches and (in the absence of a change by the Government) provide adequate time for small businesses to prepare appropriate teaming relationships to pursue the effort. It would also provide evidence that the Government is open to competition, interested in providing fair opportunity for small business offerors, and dedicated to evaluating capabilities that are highly relevant to the successful execution of LADSS.
ANSWER: The Government will not cancel the Final RFP.
QUESTION: References: HQ003419R0166 Amendment 1, Factor 3-Price/Cost, pp. 17-18 of 18; and, RFP Attachment 5 (DAU LADSS Pricing Template). Can the Government confirm that Offerors shall only price the LCATs listed in the LADSS Pricing Template (RFP Attachment 5) at the number of hours listed, and that Offerors are not allowed to define and price additional LCATs and reallocated annual hours beyond the LCATs and hours provided by the Government? We ask this question to help prevent an Offeror from playing pricing games by defining, for instance, another category of Instruction Systems Designer—L4—and then moving a sizeable portion of the ISD L3 hours to the ISD L4 LCAT at a significantly lower FBLR.
ANSWER: Offerors shall only price the LCATS and corresponding hours listed in the LADSS Pricing Template.
QUESTION: Reference: PWS 2.3 (Contract Management Plan [CMP]), p. 15 of 98. What is the period of transition (e.g. the number of many work days) being allowed by the Government if the Incumbent Vendor is unseated by another Offeror?
ANSWER: There is no transition.
QUESTION: References: PWS 2.4.1 (Bi-Weekly Program Status Meeting), p. 15 of 98; and, Section L, para 4 (Factor 3 – Price/Cost, Cost Element Summary), pp. 90-91 of 98. Can the Government confirm the typical location for the Bi-Weekly Program Status Meetings? If these meetings are face-to-face, can the Government affirm that the contractor’s travel costs are part of the travel provided as plug-numbers in Section L of the solicitation?
ANSWER: Bi-weekly Program Status Meetings are typically conducted via tele-conference. Contractor travel costs will not exceed the total estimated value of the travel CLINs.
QUESTION: References: PWS 7 (Key Functions), p. 22 of 98; and, Attachment 4 (LCAT Descriptions), p. 2 of 10.
Can the Government clarify that it does not expect Offerors to provide a Resume and Letter of Commitment for their proposed Program Manager (PM) the IDIQ level? We ask this question because the PM position has several distinct qualifications. Seeing the Resume and Letter of Commitment (LoC) for each Offeror’s IDIQ-level PM would enable the Government to better distinguish among the competing proposals during the evaluation of Factor 1 in at least two ways: 1) a highly-qualified PM may lower Government concerns about an Offeror’s risk to successful execution; and,
2) an Offeror whose PM has qualifications that significantly exceed the baseline in Attachment 4 may be evaluated by the Government as a “strength.” If the Government decides to include Resumes and LoCs, these documents could be limited to a total of 3 pages above the 6 already allowed under Corporate Experience (e.g. 9 pages in total), or by instructing Offeror to attach their PM Resume and LoC as an Appendix at the end of Volume I, with those pages being excluded from the page limitation.
ANSWER: The Government does not require offerors to provide resumes and/or letter of commitment for their proposed PM at the IDIQ level.
QUESTION: References: Proposal Adequacy Checklist, p. 75 of 98; and, Section L. Can the Government clarify whether it requires offerors to provide c completed version of the Proposal Adequacy Checklist? If Offerors are required to do so, can the Government confirm that Offerors shall place the completed checklist with in the Administrative Documents? We ask this question because the top sentence on p. 75 of 98 says, “The offeror shall complete the following checklist …” However, the instructions in Section L do not inform Offerors where to place the completed Proposal Adequacy Checklist.
ANSWER: Yes. Section L is updated to include the Proposal Adequacy Checklist in the Cost/Price Volume.
QUESTION: RFP_ATTACHMENT_5_DAU_LADSS_PRICING_TEMPLATE_DATED_9_AUG_2019.XLSX.
Sheets “G&A Expenses” and “Overhead or Other Indirect Rate”. Please clarify if Column E is for the current Fiscal Year, what is required for Columns F, G, H and I?
ANSWER: Column E is for the Current Fiscal Year; Columns F-I is for each subsequent fiscal year.
Are subcontractors required to provide sealed pricing in this format?
ANSWER: Yes.
Sheet “Cost Element Summary”, Please clarify CLIN 0001 Total is the total of Year 1, Year 2, Year 3, Year 4 and Year 5?
ANSWER: Yes. CLIN 0001 Total is the total of Year 1, Year 2, Year 3, Year 4 and Year 5.
QUESTION: RFQ Reference Section, L.2.1. Page 87. Factor 1 - Corporate Experience. On page 87 the solicitation states that the offeror shall complete a "Corporate Experience Form" (RFP Attachment 2) for each reference submitted, and that information that does not fit on the form can "continue onto another sheet of paper." Does this mean that only a maximum of 2 pages - the form and the additional sheet of paper - can be submitted for each reference? Or can the offeror use as many pages as possible to describe each past performance, provided they do not exceed a total of 6 pages for the entire section?
ANSWER: Only a maximum of 2 pages can be submitted for each reference.
QUESTION: RFQ Reference Section, L.2.1. Page 87. Can the offeror maximize the six-page limit for the Corporate Experience section regardless of the number of references submitted? Or is it a 2 page maximum per reference (Corporate Experience Form plus additional sheet of paper)?
ANSWER: Only a maximum of 2 pages can be submitted for each reference
QUESTION: RFQ Reference Section, L.2.1. Page 87. Factor 1 - Corporate Experience. Will the government please clarify what is meant by "If subcontractor experience is provided as part of the 3 of its most relevant contracts or efforts, the subcontractor experience will be given weight relative to the scope, magnitude and complexity of the aspects of the work under the solicitation that the subcontractor is proposed to perform"? Additional information is needed to understand what should be provided when using subcontractor past performance and how the information provided will be evaluated and effect offeror's score.
ANSWER: Subcontractor experience can be included as part of the Corporate Experience and/or Past Performance volumes. The information will be evaluated in accordance with the procedures outlined in Section M. The weight relative to scope, magnitude, and complexity will be determined by the amount performed on the effort.
QUESTION: Is a pre-award accounting system audit required prior to the award of a cost reimbursable contract?
ANSWER: No, it is not. However, offerors accounting systems will be required to comply with clause 252.242- 7006, Accounting System Administration. A preaward survey may be conducted to evaluate a prospective contractor's ability to perform the proposed contract. See Revisions to 2.1.5 under Section L and 1.2 Section M.
