The certification pertains to lobbying restrictions and disclosure requirements mandated under 44 C.F.R. Part 18 and 31 U.S.C. Section 1352. Contractors must certify that no federal appropriated funds have been or will be used to influence federal officials, members of Congress, or congressional staff in connection with the award of this contract. The certification must be signed by the contractor's authorized official and submitted to the City of Pasadena as a prerequisite for contract award. The language of this certification must be included in all subaward documents at all tiers, including subcontracts and subgrants, with all subrecipients required to certify and disclose accordingly.
Any contractor failing to submit the required certification is subject to civil penalties ranging from $10,000 to $100,000 for each failure. Additionally, contractors understand that the provisions of 31 U.S.C. Chapter 38 regarding administrative remedies for false claims and statements apply to their certification and disclosure submissions. The contractor's authorized official must certify the truthfulness and accuracy of all statements made in the certification, acknowledging that submission constitutes a material representation of fact upon which the City's decision to enter into the transaction relies.
