10 MAILING LISTS

1 Scope The CDRL establishes the data to be delivered by the Contractor to include the submittal, approval, and distribution requirements of all of the data items contained within. The data requirements are listed on the enclosed copies of the Department of Defense (DD) Form 1423, Contract Data Requirements List. These forms have been completed in accordance with Department of Defense (DoD) 5010.12-M, Procedures for the Acquisition and Management of Technical Data, May 1993.

2 Applicable Documents The associated data item descriptions (DID) are identified in block 4 of the enclosed copies of DD Form 1423. All DIDs are available to the Contractor at the following website:

4 Data Deliveries

Delivery Dates Unless otherwise specified in block 16 of the CDRL, all references to “days” will refer to calendar days. The data must be delivered by 1600 (4:00pm) Eastern Standard Time on the due date in order to be counted as on-time. In the event a CDRL delivery date falls on a Saturday or Sunday, the delivery must be made by the Friday before the weekend to be counted as an on-time delivery.

Tailored Data Items Tailoring instructions are as described in block 16 of each affected CDRL. If the data preparation instructions contained in block 16 of the CDRL are different than the instructions contained in Block 10 of the DID, the instructions in the CDRL shall take precedence.

Approval of Data An "A" designator in block 8 of the CDRL indicates the Government will formally reply to each data submittal with either: (1) an approval, (2) approval with comments, (3) rejection, or (4) http://quicksearch.dla.mil/ disapproval. The Government will respond by issuing a Contracting Officer (CO) letter to the Contractor. This response can be expected within 30 calendar days, unless otherwise specified block 16. The Government will reject a data delivery if it is determined to be incomplete or inadequate to the point where a comprehensive review cannot occur. The Government will disapprove a data delivery if, after a thorough review, it is determined the document is not acceptable. This 30-day response time does not apply to Engineering Change Proposals (ECP) or Contract Change Proposals (CCP). Any ECP or CCP will be reviewed and briefed to the Government Configuration Control Board (CCB) for disposition. After the CCB, a CO letter will be sent apprising the Contractor of the action.

For those CDRLs with an "N/A" in block 8, Government approval of the content is not required;

however, compliance with data item format and content requirements as specified in block 10 of the DID (and as tailored in block 16 of the CDRL) is mandatory. If there is an “N/A” in block 8, the Government will not provide a formal response back to the Contractor; however, the Government retains the right to reject or disapprove any data submittal(s) not in compliance with requirements of the contract, the DID, or the CDRL.

The Contractor is legally obligated to meet these requirements because the CDRL is a contractual document and, as such, is, therefore, binding in and of itself.

Resubmittal of Data If resubmittal of a CDRL is required, it shall be resubmitted within 30 calendar days after the date the CO notification letter is sent, unless otherwise specified in the CO notification letter.

Should the Contractor disagree with the proposed resubmittal requirements, it shall submit its comments to the CO within 30 calendar days of notification. Each page of a resubmittal shall have changes indicated by a vertical line down the outer right margin to designate any areas of the document (including figures and tables) that have been revised. The document revision number shall be indicated both on the title page of the data item and in the header of each page of the CDRL as well as any summary section of document changes.

The Contractor shall resubmit CDRL deliverables whenever an update is made.

Final Submittal of Data For the final delivery of each data item in the contract/delivery order, the Contractor shall clearly state in its Letter of Transmittal (LT) that the last submittal is being made and that all contractual requirements concerning that data item have been fulfilled. The proper format and required information for the Contractor’s LTs is covered in section 6 below.

When the final delivery on a CDRL has been made, Block 16 of the CDRL shall be modified to state “CDRL is considered complete per Contract Modification XXX.” The revised CDRLs will then be incorporated into the contract via the referenced modification.

DD Form 250, Material Inspection and Receiving Report Requirements Block 7 of the CDRL directs the method of submittal— an individual DD Form 250 is required only if indicated in block 7. All other submittals shall be via an LT.

Classified Data Any CDRL delivery containing classified data shall be submitted in accordance with the requirements established by the Contractor’s DD Form 254, Contract Security Classification Specification. The Contractor shall contact the CO for appropriate mailing addresses for classified data.

5 Electronic Data Transmission

Submission The Contractor shall submit electronic versions of all data deliverables in accordance with block 14 of the individual DD 1423 forms, unless specified differently in block 16. All data deliverables will be posted to the electronic data management system website as described in the Statement of Work, para 3.11.3. In addition, all addressees identified in block 14 shall be notified via email of the posting. The email shall include the data deliverable and a link to the website. The Contractor shall ensure versions of the software used for data deliverables shall remain compatible with current JPATS T-6A ADS-B Out Program Office software. Any submittals by other means shall require JPATS Program Office approval prior to delivery of data. Data being submitted by electronic data transmission shall be identified in “Block 14.b Repro” of the CDRL.

Electronic delivery includes delivery/availability of data files via a Government-approved website, web page, and server or via attachment of electronic files, as mutually agreed to between the Government and the Contractor. Electronic data delivery and access is subject to Government protection/security requirements.

Alternative Delivery Formats The Contractor shall inform the JPATS Program Office if any of their data deliverables cannot comply with the required electronic formats. In such cases the Contractor shall recommend, for Program Office approval, an alternative delivery format(s). A request for an alternative delivery format should not be considered an automatic approval for a late delivery of the data.

Financial Information Format Any financial information provided in an MS Excel spreadsheet shall be able to be manipulated.

6 Letters of Transmittal

Required Format (General) All data deliveries shall include an LT. The LT may be in the form of a letter or e-mail from the designated Contractor representative. As a minimum, the LT shall contain contractor’s point of contact (POC) contractor’s address date contract number and program name letter control number document control number document revision level document date

Required Format (Paper) If a paper copy of the LT is prepared, a complete list of addressees shall be placed at the end of the LT, annotating the recipients (as identified on the DD Form 1423, block 14), including the transmittal-letter-only recipients.

Required Format (email) If submittal is made via e-mail, the list of addressees in the “To” line shall include the complete list of addressees and shall be considered sufficient.

7 Modification of Data Requirements During the performance of this contract, the CO may unilaterally increase or decrease the number of addressees and/or number of copies the JPATS Program Office requires or may make other administrative or clarification changes to the CDRL.

Changes to Contract Price (Limits & Conditions) Any amendment shall be made at no change in contract price, provided the increase for an individual line item of data is not greater than 150 percent nor a decrease of less than 50 percent in the total number of copies initially specified in the CDRL. In the event of an increase greater than 150 percent or of a decrease greater than 50 percent, the parties will negotiate any equitable adjustment in accordance with the procedures of the “Changes” clause.

Administrative Changes and Clarifications The CO may unilaterally make other administrative and/or clarification changes to the CDRLs.

The contract price will constitute full satisfaction of any entitlement of equitable adjustment under the “Changes” clause, provided the Contractor agrees to accept such change at no change in contract price. Unilateral action shall be by the issuance of a CO's letter, which will reference this paragraph as its authority. The Contractor shall notify the CO of the estimated cost if the changes impact the contract price.

9 Marking Technical Documentation

Distribution Marking System:

Required distribution statements have been annotated in block 9 of each CDRL and are defined in paragraph 9.2 below. If the Contractor feels a different statement is required, the Contractor must notify the CO with its recommended distribution statement. The Government will review the request, determine which statement is the most appropriate, and provide the Contractor with either an acceptance of its proposed change or the Government’s reason for not accepting the Contractor’s request for change.

Marking Technical Data

9.2.1 The Contractor shall mark all requested technical information, regardless of its medium, with a distribution statement. This marking requirement for technical data includes technical reports, blueprints, drawings, technical orders, technical manuals, plans, instructions, computer software, viewgraphs, film, technical papers, photographs, etc. If the document contains export-controlled technical data, it also must be marked with an export control warning statement. Distribution statements can be applied to technical data that contain or reveal proprietary information.

9.2.2 Certain types of technical data may preclude placing the entire notice on the document. To accommodate this problem, each distribution statement contains an authorized abbreviation form. Abbreviated distribution statements are to be used only when the available space precludes placing the entire notice on the document. The use and wording of these statements are described in the following paragraphs.

Distribution Statements One of the following statements, in accordance with block 9 of the CDRL, regarding distribution must appear on the cover and title page of each document submitted, including the first sheet of each drawing.

Export-Controlled Warning Statement Besides a distribution statement, the marking system also requires the use of a warning notice on all documents that contain export-controlled technical data. The warning notice may be used in conjunction with any of the five limited distribution statements: “B,” “C,” “D,” “E,” and “F.”

Statement “A,” which denotes public release, cannot be used in conjunction with the export-control warning notice:

WARNING - This document contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751, et seq.) or the Export Administration Act Of 1979, Title 50, U.S.C., App. 2401, et seq.), as amended.

Violations of these export laws are subject to severe criminal penalties.

Disseminate in accordance with provisions of DOD 5230.25.

Destruction Notice All unclassified technical data marked with distribution statements “B,” “C,” “D,” “E,” or “F” shall be handled and destroyed as “For Official Use Only” documents, in accordance with DoD 5400.7-R, DOD Freedom of Information Act Program, September 1998. Classified data and classified limited technical data shall be handled and destroyed in accordance with the procedures in Chapter IX of DoD 5200.1-R, Information Security Program Regulation, or follow the procedures in DoD 5220.22-M, Industrial Security Manual.
