JPATS ADS-B (OUT) BASE SUPPORT AGREEMENT
Base support will be provided by the US Government (USG) to the contractor in accordance with the provisions of this agreement. Failure by the contractor to comply with the provisions of this agreement will release the USG, without prejudice, from its obligation to provide base support by the date(s) required. If warranted, and if the contractor has complied with the provisions of this agreement, an equitable adjustment will be made if the USG fails to provide base support by the date(s) required.
Base support includes USG-controlled working space or other support (including use of the
Defense Switched Network [DSN]) which the USG determines can be made available at, or through, any USG installation where this contract will be performed.
Unless otherwise stipulated in the contract schedule, support will be provided on a no-charge-for-use basis and the value will be a part of the USG's contract consideration.
The contractor agrees to immediately report to the USG Contracting Officer (with a copy to the cognizant Administrative Contracting Officer) inadequacies, defective Government Furnished
Property (GFP), or non-availability of support stipulated by the contract schedule, and recommend a plan for obtaining the required support. The USG agrees to determine (within 10 workdays) the validity and extent of the involved requirement and the method by which it will be fulfilled (e.g., purchase, rental, lease, GFP, etc.). Facilities will not be purchased under this agreement. Additionally, the contractor (or authorized representative) will not purchase, or otherwise furnish any base support requirement provided by the agreement (or authorize others to do so), without prior written approval of the USG Contracting Officer regarding the price, terms, and conditions of the proposed purchase or approval of other arrangements.
Following are installations where base support will be provided: JBSA-Randolph, TX; Laughlin
AFB, TX; Vance AFB, OK; Columbus AFB, MS; Sheppard AFB, TX; Naval Air Station (NAS)
Pensacola (CSO), FL, and NAS Pensacola (NFO), FL.
Government Support
The USG support to be furnished under this contract is as follows:
1. Base Access
The contractor shall identify all members of the design and development team and each contractor field team when requested by the USG Contracting Officer. Team personnel information will be provided to the base security office. The host base will provide base access upon successful completion of the base security office processes and procedures.
2. Fire Protection
The host base will:
a. Provide and operate structural firefighting, equipment, and vehicles when required
b. Accomplish appropriate fire hazard inspections and fire preventative measures
c. Provide and maintain fire extinguishers at the facilities occupied by the contractor in accordance with local procedures
3. Furnishings and Equipment
The host base will provide USG GFP furnishings for use by Contractor personnel to perform duties under this contract. These furnishings include, by way of example:
a. Desk, table, and chairs
b. Work benches with accessories and stools as required
c. 1 each stand to access the cockpit per aircraft
d. 1 each ladder (NAS Pensacola, FL NFO only) per aircraft
e. Shop Air
f. Barfield 1811D 405 pitot static test set
3.1. Maintenance of Facilities and Operation of Utilities
a. The host base will provide access to trash containers (dumpster bulk-type or equivalent)
4. USG Facilities
The USG will provide the following secured facilities for contractor use:

b. Hangar space for one aircraft

a. Hangar space for two aircraft

5. USG Services
The USG shall provide aircraft maintenance support for the ADS-B (Out) modification
5.1. Aircraft Maintenance
a. Prep aircraft for ADS-B (Out) modification
b. Return aircraft to flight airworthiness status after ADS-B (Out) modification is completed
c. During the development phase, to prepare the aircraft for modification, the
Government will:
1. Provide the contractor with a Mission Capable (MC) aircraft capable of receiving external electrical power.
2. Tow the aircraft to the designated hangar space, chock the aircraft, ground the aircraft, make it safe for maintenance, and open basic access panels to allow access to avionics systems.
3. Safe, remove, and stow the aircraft’s egress equipment (i.e. ejection seats).
4. Provide external power when requested.
5. When requested, remove aircraft panels/components/equipment identified by the contractor as needing removal for installation of the developmental kit.
d. During the development phase, after the aircraft modification is complete, the
Government will:
1. Reinstall those aircraft panels/components/equipment removed at the contractor’s request during development.
2. Perform a post-system checks to ensure the aircraft is mission capable. Note:
The contractor will be responsible for performing a post-systems check on the installed ADS-B (Out) system prior to the Government’s effort for the entire aircraft.
e. During the validation and verification of the retrofit kit, to prepare the aircraft for modification, the Government will:
1. Provide the contractor with a Mission Capable (MC) aircraft capable of receiving external electrical power.
2. Tow the aircraft to the designated hangar space, chock the aircraft, ground the aircraft, make it safe for maintenance, and open basic access panels to allow access to avionics systems.
3. Safe, remove, and stow the aircraft’s egress equipment (i.e. ejection seats).
4. While writing the draft Time Compliant Technical Order (TCTO)/Technical
Directive (TD), work with the contractor to define respective contractor and
Government actions needed to execute the kit installation. Responsibility for removal of aircraft panels/components/equipment will be addressed in the
TCTO/TD.
f. After the validation and verification of the aircraft retrofit kit, the Government will:
1. Reinstall those aircraft panels/components/equipment identified in the draft
TCTO/TD as the responsibility of the Government to reinstall.
2. Perform a post-system checks to ensure the aircraft is mission capable. Note:
The contractor will be responsible for performing a post-systems check on the installed ADS-B (Out) system prior to the Government’s effort for the entire aircraft.
g. During kit retrofit execution of the T-6A fleet, to prepare each aircraft for modification, the Government will:
1. Provide the contractor with a Mission Capable (MC) aircraft capable of receiving external electrical power.
2. Tow the aircraft to the designated hangar space, chock the aircraft, ground the aircraft, make it safe for maintenance, and open basic access panels to allow access to avionics systems.
3. Safe, remove, and stow the aircraft’s egress equipment (i.e. ejection seats).
4. Provide external power when requested.
5. Remove those aircraft panels/components/equipment designated as a
Government responsibility in the final approved TCTO/TD.
h. During kit retrofit execution of the T-6A fleet, after each aircraft is modified, the
Government will:
1. Reinstall those aircraft panels/components/equipment identified in the final approved TCTO/TD as the responsibility of the Government to reinstall.
2. Perform a post-system checks to ensure the aircraft is mission capable. Note:
The contractor will be responsible for performing a post-systems check on the installed ADS-B (Out) system prior to the Government’s effort for the entire aircraft.
5.2. Egress Shop
a. Remove/store/install egress equipment from aircraft as required to support aircraft for ADS-B (Out) modification
5.3. Inspection/Defense Contract Management Agency/Contracting Office Representative
a. Provide contract oversight
b. Preform final government aircraft acceptance upon completion of each ADS-B (Out) modification
The contractor shall not incur any cost resulting from nonsupport prior to Contracting Officer concurrence in accordance with this agreement.
This is a firm fixed price contract and the contractor agrees that, in the performance of this contract or any major subcontract, no direct or indirect costs for property or services will be incurred if the USG determines that property or service is available at or through any USG installation where this contract shall be performed. Only prior written approval of the USG
Contracting Officer can relieve the contractor from this restriction.
