Section A - Solicitation/Contract Form
GENERAL NOTES TO OFFERORS
1. Type of Contract: An Indefinite Delivery Indefinite Quantity (IDIQ) Contract with Fixed Price – Economical
Price Adjustment (FP-EPA) Pre-Priced Line Items will result from this solicitation. The IDIQ contract will be for a one year basic period with three one-year options. The maximum aggregate amount of the TAFB Paving IDIQ contract shall not exceed $43,300,000.00. Note that the Total Evaluated Price (TEP) of the offeror’s ITO Section L
Attachment #1.6 Paving Pricing Matrix is for evaluation purposes only and is not related to the total maximum aggregate value of the contract. The awardee will receive an initial delivery order for the TAFB Paving IDIQ for the minimum guarantee. The minimum guarantee will be the fixed amount of $5,000.00 to cover the expenses of attending the post award conference. The post award conference will be conducted approximately 14 days after contract award and will be held at Base Construction Contracting in building 3, Tinker AFB OK, 73145. The
Government will provide the post award conference date approximately seven days after contract award.
2. Schedule CLINs/SUBCLINs (Section B): There will be no pricing on the Contract Line Items (CLINS) in
Section B. The offeror shall propose fixed pre-priced line items utilizing the ITO Section L Attachment #1.6 Paving
Pricing Matrix for the base period and each option year to be used for the duration of the contract period.
3. Magnitude of Construction: In accordance with DFARS 236.204, Disclosure of the Magnitude of Construction
Projects, the estimated price range for this contract is between $25,000,000.00 to $100,000,000.00.
4. Contract Period: This is an IDIQ Contract for Tinker Air Force Base (TAFB) Paving. The performance period for the basic contract will be for a one- year base period and three, one- year options.
5. Performance Period(s) for Individual Delivery Orders: Performance periods shall be negotiated for each individual delivery order.
6. Pre-proposal Conference & Initial Site Visit: A pre-proposal conference and Tinker AFB tour for this acquisition will be conducted on 24 February 2015 from 9:00 a.m. to 12:30 p.m. The conference will be held at
Rose State College Professional Training Center, 1720 Hudiburg Drive, Midwest City, Oklahoma 73110. A bus will be used to transport all conference attendees onto the base for a base tour and a site visit for the sample project and will be returned to the conference site after completion of the tour.
Attendees are directed to notify A1C Regine Hazelett by e-mail at regine.hazelett@us.af.mil or call (405) 739-3367 before 20 February 2015, 1:00 p.m. if they plan to attend. Failure to notify could result in non-availability of transportation. All offerors are strongly urged to attend. All personnel attending will need to have in their possession a valid driver’s license or valid personal identification with photo and be able to pass a background check if required.
Pre-proposal confernce will be conducted to introduce the Government key personnel involved and general information concerning the source selection process. Base Tour “window tour” will be conducted to show all attendees the general size of the base with typical areas of work for this contract and to afford all attendees the opportunity to view and inspect the site where the sample project work is to be proposed and to satisfy themselves as to all general and local conditions that may affect the offerors technical approach of the project (Section L, Pgh 3.2.2
Technical Subfactor 1: Project Development and Execution of Sample Project). During this sample project site visit, only general questions are to be asked to the project manager or contracting officer. It is requested that all attendees submit written questions or concerns of the solicitation and sample project not later than 02 March 2015 to ensure that all parties are afforded the opportunity to see the question and answer (Q&A) that will be posted on
FedBizOpps.
IMPORTANT NOTE: ALL OFFERORS WILL BE LIMITED TO NO MORE THAN 4 INDIVIDUALS PER
PRIME (to include Sub-Contractors invited by the Prime) FOR ATTENDING THE PRE-PROPOSAL
CONFERENCE AND BASE TOUR.
7. Technical Specifications and Drawings: The technical specifications and drawings, referenced in Section J as attachments to this solicitation, have been prepared by the Base Civil Engineer. Any and all questions regarding these specifications and/or drawings must be submitted in writing to the Contract Specialist identified in Block 7 of the SF 1442. Any information obtained outside this procedure and acted upon may cause the resultant offeror to be non-responsive. Any and all questions received from industry will be responded by amendment to the solicitation.
Issuance of the amendment will incorporate all the terms and conditions into a resultant award.
8. Wage determinations: The most current prevailing Davis Bacon Wage Determination shall be incorporated with the solicitation for each task order. It is anticipated that the most common Wage Determination is construction type:
Building. The Davis Bacon Wage Determinations in effect at the issuance of this solicitation are found in Section J for reference purposes only. Cited on individual delivery orders.
9. Amendment Acknowledgement: It is the offeror’s responsibility to be aware of amendments, as made available.
Acknowledgement of amendments is required by the offeror in accordance with the instructions provided in Block
11 of SF 30, Amendment of Solicitation. Offerors that fail to acknowledge amendments may be considered ineligible for award.
10. Acceptance Period: Attention is invited to Blocks 13D and 17 of the SF 1442. IAW Block 17, the number inserted must be equal to or greater than the number of days listed in Block 13D.
11. Instruction to Offeror: The Offeror must adhere to the Instructions to Offeror (ITO) in Section L of the SF
1442.
12. Multiple Delivery Order Expectations: Offerors are advised of the necessity for the government to solicit multiple delivery order requirements at any given time in support of its mission. Any offeror proposing on this
TAFB Paving requirement is hereby fully notified of the government’s likeliness of multiple delivery order requirements and the contractor’s expected responsibility for support of the multiple delivery order awards simultaneously
13. Representation and Certifications: If already registered in System for Award Managemen (SAM) at www.sam.gov, the offeror is not required to fill out the representations and certifications that are within SAM;
however, section K clauses in the RFP not included in offeror’s SAM registration must be filled out within the solicitation.
14. Economic Price Adjustment (EPA): EPA provides for the upward and downward revision of the TAFB Paving
IDIQ fixed price line items based on material cost changes beyond the Contractor’s control. The procedures set forth in FAR Clause 52.216-4 shall be used for submission and approval of economic price adjustments under this contract. IAW FAR 52.216-4(c)(1)(ii) the only materials subject to the adjustments are the petroleum-base products listed on the TAFB Paving Line Item Pricing Matrix (Attachment 1.6 of Section L) as follows: Line Item Numbers
0001–0008, 0011–0013, 0016–0022, 0025, 1001–1008, 1011–1013, 1016–1022, 1025, 2001–2008, 2011–2013, 2016–2022, 2025, 3001–3008, 3011–3013, 3016–3022, and 3025.
15. Required Insurance: In accordance with (IAW) FAR 28.306 (Insurance Under Fixed-Price Contracts)) and
52.228-5(a) (Insurance – Work on a Government Installation) the coverage specified in FAR 28.307-2 (Liability), the Contractor shall, at its own expense, procure and thereafter maintain the following minimum kinds of insurance with respect to performance under the contract:
(a) Workers’ compensation and employer’s liability. Contractors are required to comply with applicable Federal and
State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers.

(b) General liability. (1) The contracting officer shall require bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence. (2) Property damage liability insurance shall be required only in special circumstances as determined by the agency.
(c) Automobile liability. The contracting officer shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.
16. Truck Entry Gate Notice: Tinker Air Force Base has constructed a “Truck Entry Gate” (Gate 33), which is located at the corner of 59th Street and Air Depot Blvd (southwest corner of the base). The gate will be opened beginning 15 September 2004.
Gate 33 shall be used for all deliveries by truck to this base.
(Trucks will not be allowed to gain access through any other gate.)
Since your firm’s delivery on this order is affected, please advise your delivery carrier to use the new gate. This should minimize the impact of your delivery.
DELIVERIES TO BUILDING 3001 (B3001)
Be advised that delivery vehicles destined for B3001 are prohibited from using “Staff Drive”.
Delivery vehicles may make deliveries only in designated unloading areas.
Since your firm’s delivery may be affected, ensure that your delivery carrier receives proper instructions on delivery
/ unloading requirements for B3001. Unloading in designated unloading areas will minimize any inconvenience, and, attendant ramifications, which may accrue, to your delivery / delivery carrier for failure to adhere to this requirement.
17. Contract Government Holidays: Government holiday observances – No contractor work will be conducted on these days; accordingly, the Government will not be billed for such holidays except when services are required by the Government and are actually performed on a holiday. Holidays in addition to those reflected in this contract, which are designated by the Government, will be billable provided the assigned Contractor employee was available for performance and was precluded from such performance.
The following days are Contract Government Holidays: New Year’s Day, Martin Luther King, Jr. Day, President’s Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving
Day, Christmas Day.
18. Notice to Offeror: The Government reserves the right to cancel this solicitation, either before or after the closing date.

52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (JULY 2013)
(a) Definitions. As used in this provision--
Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian
Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
Federal contracts and grants with total value greater than $10,000,000 means--
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(iv) In a criminal, civil, or administrative proceeding, a disposition of the matter by consent or compromise with an acknowledgment of fault by the Contractor if the proceeding could have led to any of the outcomes specified in paragraphs (c)(1)(i), (c)(1)(ii), or (c)(1)(iii) of this provision.
(2) If the offeror has been involved in the last five years in any of the occurrences listed in (c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence.
(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management database via https://www.acquisition.gov (see 52.204-7).

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the
Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the end of the period of performance specified in easch project delivery order . The time stated for completion shall include final cleanup of the premises.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $243.00 or other specified amount in individual project delivery order for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
