Please confirm each Contractor must have Defense Base Act (DBA) insurance for OCONUS work. Or confirm that the government will waive this requirement for the AMC AAS RFP.
We believe (FAR 52.228-3, and -4 and related clauses) requires every business that has US citizen working overseas on US government work must provide DBA (outside the US workers comp) insurance unless they have a waiver from the Dept of Labor (DOL). The law requires this insurance even if the clause is not in a specific contract. We ask this because many small businesses are not aware of this requirement and it is expensive and must be considered in OCONUS pricing.
Please note that FAR 52.228-3 and 4 apply when the contract will be a public-work contract performed outside the US (See FAR 28.310). The Government will require insurance Per FAR 52.228-5, but will not require “Workers Compensation Insurance” (Defense Base Act).

The skill level an individual qualifies for is dependent upon the relevant education, experience, and capabilities of the individual which equips him or her to perform within the assigned functional area. Task order SOOs will be written in terms of desired outcome and may reference the discipline areas only to categorize the type of support needed to perform the task. For each task, Contractor shall propose the required disciplines, skills mix, and skill level which are most effective for accomplishing the task. |
