WAFB ENVIRONMENTAL PROTECTION

PART 1 GENERAL

1.1 REFERENCES

1.1.1 The publications listed below form a part of this specification to the extent referenced. All references listed in this specification are intended to be the current version or edition, unless specifically identified otherwise. The contractor shall conform to the Occupational Safety &

Health Act, Environmental Protection Agency (EPA), Wyoming Department of Environmental

1.2 UNIT PRICES

1.2.1 PERMITS AND FEES

1.2.1.1 No separate payment will be made for work covered under this section. The contractor shall be responsible for payment of fees associated with environmental permits, applica-tion, and/or notices obtained by the contractor. All costs associated with this section shall be included in the contract price. The contractor shall be responsible for payment of all fines/fees for violation or non-compliance with Federal, State, regional and local laws and regulations.

1.2.1.2 The contractor shall be responsible for obtaining and complying with all environmental permits and commitments required by Federal, State, regional, and local environmental laws and regulations.

1.2.1.3 Demolition Work: Contractors shall notify the Wyoming Department of Environmental

Quality, 122 West 25th St, Herschler Building, Cheyenne WY 82002 for all demolition work where load-bearing members are removed.

1.3 DEFINITIONS

1.3.1 AFI – Air Force Instruction

1.3.2 CFR – Code of Federal Regulations

1.3.3 Chemical Wastes – Includes salts, acids, alkalis, herbicides, pesticides, and organic chemicals.

1.3.4 Debris – Includes combustible and noncombustible wastes, such as ashes, waste materials that result from construction or maintenance and repair work, leaves, and tree trimmings.

1.3.5 Garbage – Refuse and scraps resulting from preparation, cooking, dispensing, and consumption of food.

1.3.6 Hazardous Material (HAZMAT) – Includes all items (including medical supply items, but excluding drugs in their finished form and pharmaceuticals in individually-issued items) covered under Emergency Planning & Community Right-To-Know Act (or other host nation, Federal, State, or local) tracking requirement, the OSHA HAZCOM Standard, and all Class I and Class II

Ozone Depleting Substances.

1.3.7 Oil – Any kind of oil in any form including, but not limited to: fats, oils, or greases of animal, fish, or marine mammal origin; vegetable oils, including oils from seeds, nuts, fruits, or kernels;

and, other oils and greases, including petroleum, fuel oil, sludge, synthetic oils, mineral oils, oil refuse, or oil mixed with wastes other than dredged spoil.

1.3.8 Oily Waste – Includes petroleum products and bituminous materials.

1.3.9 POL – Petroleum, Oils, and Lubricants (regulated by the F. E. Warren AFB SPCC plan).

1.3.10 Rubbish – A variety of combustible and noncombustible wastes such as paper, boxes, glass, crockery, metal, lumber, cans, and bones.

1.3.11 Sanitary Water – A pipe or conduit which carries sewage and to which storm waters, surface waters and ground waters are not intentionally admitted.

1.3.12 Sediment – Soil and other debris that has been eroded and transported by runoff water.

1.3.13 Sewage – Wastes characterized as domestic sanitary sewage.

1.3.14 Solid Waste – Rubbish, debris, garbage, and other discarded solid materials resulting from industrial, commercial, and agricultural operations, and from community activities.

1.3.15 Spill Prevention, Control, and Countermeasures (SPCC) Plan – Guidance for preventing spills of

POL products to navigable waters. The plan includes controls countermeasures that are required for activities performed on the installation.

1.3.16 Storm Water – A pipe or conduit which carries storm or surface waters and drainage, but excludes sewage and industrial wastes.

1.3.17 Cultural Resources - Any building, structure, object, site or district that is listed in or eligible for listing in the National Register of Historic Places. This includes properties that are contributing elements to the FEW AFB National Historic Landmark District.

1.3.18 Cultural Resources Manager - The person appointed by the Installation Commander to manage the FEW AFB cultural resources program.

1.3.19 Historic Property - Any prehistoric or historic district, site, building, structure, or object included in, or eligible for inclusion on the National Register, including artifacts, records, and material remains related to such a property or resource.

1.3.20 Secretary’s Standards - The Secretary of the Interior’s Standards for the Treatment of Historic Properties.

1.4 DELIVERY, STORAGE, AND HANDLING

1.4.1 STORAGE OF HAZARDOUS MATERIALS

1.4.1.1 All materials used by the contractor on base property shall be stored properly in special areas in accordance with all regulatory and F. E. Warren AFB Fire Department require-ments. Storage shall include, but is not limited to:

a. Keeping containers closed when not in use.

b. Labeling containers with warning labels.

c. Posting hazardous signs as required.

d. Providing storage with secondary containment and routinely checking for leaks and spills and appropriately documenting.

e. Storing materials at a central location.

f. Storing flammable items in an approved flammable storage locker.

g. All fuel storage tanks must have secondary containment.

1.4.2 HAZARDOUS WASTE PROCEDURES

1.4.2.1 All hazardous waste, except those that come under Universal Waste Rules, must be ma-naged and disposed of in accordance with 40 CFR Subchapter I, Parts 260-268.

a. The contractor is responsible for the disposal of all hazardous waste generated from their opera-tions, including spill cleanup. The contractor shall bear all costs associated with hazardous waste disposal.

b. Contractors storing hazardous waste on-site for more than 24 hours must follow the F. E.

Warren AFB Hazardous Waste Plan, 90 SW PLAN 32-2. As a minimum, the contractor must establish satellite accumulation points, and appoint and train satellite accumulation point man-agers. If more than 55 gallons of hazardous waste or more than five (5) pounds of acutely ha-zardous waste is generated, the contractor must obtain approval for and establish a 90-day ac-cumulation site, or further specific instructions must be obtained from 90 CES/CEAN.

c. The contractor shall manage their generated waste accumulations in accordance with 40 CFR

Section 262.34 (c)(1). The contractor shall characterize and offer for disposal (including sam-pling, analysis and manifesting) of hazardous waste to a RCRA-permitted facility. The con-tractor must arrange for a DOT-trained and authorized person from 90 CES/CEAN to inspect the shipment and sign the hazardous waste manifest before manifesting the waste off base. The contractor shall provide a copy of the manifest to 90 CES/CEAN, building 944, prior to ha-zardous waste being shipped off the installation. A signed copy of the manifest must be re-turned to 90 CES/CEAN within 45 days.

d. The contractor is responsible for all fines and penalties that may stem from a hazardous waste inspection of their operation.

1.4.2.2 Fluorescent Light Tubes

a. All fluorescent light tubes are considered hazardous waste even if they are sent to a recycling facility (unless there is data showing otherwise). Fluorescent light tubes are to be managed in compliance with RCRA, 40 CFR Part 273, Universal Waste Rules and sent to recycling. All fluorescent light tubes shall be handled in such a way as to prevent breakage and the subsequent release of mercury-containing vapor. All tube removal related work shall be performed in con-formance with all environmental, safety and health regulations.

b. Fluorescent light tubes shall be carefully removed from fixtures and packaged to prevent brea-kage during subsequent handling and shipping. If fluorescent bulbs are broken, the contractor must cleanup immediately and the material must be treated as a hazardous waste. Broken bulbs must be managed under the provisions of 40 CFR, part 260. If bulbs are broken, they must be managed according to Section 10.1.

c. Fluorescent tube recycling must be performed at a qualified recycling center that complies with

40 CFR 273 Subpart E standards for destination facilities. Upon completion of recycling, the contractor must provide the Contracting Officer and 90 CES/CEAN certificates detailing the number of tubes recycled, date of recycling, and name and location of the recycler. Each certif-icate shall be signed and dated by the contractor removing the tubes and by the recycling firm performing the recycling.

1.4.2.3 The contractor may obtain guidance from 90 CES/CEAN (307-773-4441) on proper sto-rage and handling of hazardous waste while on F. E. Warren AFB; however, all responsi-bility rests with the contractor to comply with all Federal and State hazardous waste re-quirements and any information obtained from 90 CES/CEAN does not remove responsi-bility from the contractor for proper waste management.

1.4.3 SOLID WASTES

1.4.3.1 The contractor is responsible for handling and disposing of all solid waste generated at the job site including laboratory testing and any documentation submittals required by the landfill owner.

1.4.3.2 Solid wastes (excluding clearing debris) shall be placed in containers that are emptied on a regular schedule. Handling, storage, and disposal shall be conducted to prevent contami-

nation. Segregation measures shall be employed so that no hazardous or toxic waste will become co-mingled with solid waste. The contractor shall transport solid waste off Gov-ernment property and dispose of it in compliance with Federal, State, and local require-ments for solid waste disposal. A Subtitle D RCRA-permitted landfill shall be the mini-mum acceptable off-site solid waste disposal option. The contractor shall verify that the selected transporters and disposal facilities have the necessary permits and licenses to op-erate.

1.4.3.3 Contractors are required to divert/recycle any solid waste generated from their work. The following on-site generated waste must be recycled: glass, tin, aluminum, cardboard, newspaper and office paper.

1.4.3.4 The contractor shall submit a report by the 5th day of the month that lists the materials di-verted/recycled during the previous month. The amounts shall be reported in tons (2,000 lbs). The report shall include, where applicable:

a. Waste and Debris Diverted from Landfill

(1) Total solid waste diverted through composting (in tons)

(2) Total solid waste diverted through mulching (in tons)

(3) Total solid waste diverted through Recycling (in tons)

(4) Total solid waste diverted through Reuse (in tons)

(5) Total solid waste diverted through Donation (in tons)

(6) Total solid waste to energy incineration (in tons)

(7) Total construction and demolition debris diverted (in tons)

(8) Total construction and demolition debris landfilled (in tons)

(9) Total solid waste landfilled (in tons)

1.4.3.5 The contractor shall make all arrangements for disposal of any wastes including wastes requiring special handling such as asbestos and lead-containing materials, rubble, sludge or non-hazardous chemical wastes.

1.4.3.6 Solid Waste Disposal Facilities

a. All non-hazardous wastes shall be properly disposed of through a licensed landfill or recycling center. Wyoming Department of Environmental Quality written approval is required for any non-inert materials such as asphalt containing materials, asphalt roofing materials, steel con-taining materials, etc., that are to be disposed of in a Class III landfill site. No written approval is required if a Class II or Class IV landfill site is used for disposal of these non-inert materials.

b. Class IV landfills accept Group VI wastes, which include construction and demolition waste such as waste building materials, packaging, and rubble resulting from construction, remode-ling, repair, and demolition operations on pavements (including asphalt waste), houses, com-mercial buildings, and other structures.

c. Regulated hazardous wastes are excluded from all Class II, III and IV landfill sites. Class II landfill sites can receive any wastes acceptable at Class III and Class IV landfill sites in addi-tion to municipal and household solid wastes such as garbage and putrescible organic materials.

d. No landfill site is available on base. Demolition rubble shall not be buried or placed upon the land anywhere on base or at the work site.

e. The cost for cleanup of improperly disposed wastes and/or the costs for removals of improperly placed hazardous waste materials shall be the responsibility of the contractor.

f. Copies of all disposal documents, weight tickets, and diversion rates shall be furnished to the

Contracting Officer monthly.

1.5 PROJECT/SITE CONDITIONS

1.5.1 NATURAL RESOURCES

1.5.1.1 Protection of Natural Resources

a. Preserve the natural resources within the project boundaries and outside the limits of permanent work. Restore to an equivalent or improved condition upon completion of work. Confine con-struction activities to within the limits of the work indicated or specified.

b. Except in areas to be cleared, do not remove, cut, deface, injure, or destroy trees or shrubs without the Contracting Officer's permission. Do not fasten or attach ropes, cables, or guys to existing nearby trees for anchorages unless authorized by the Contracting Officer. Where such use of attached ropes, cables, or guys is authorized, the contractor shall be responsible for any resultant damage.

c. Protect existing trees that are to remain and that may be injured, bruised, defaced, or otherwise damaged by construction operations. Remove displaced rocks from uncleared areas. By ap-proved excavation, remove trees with 30 percent or more of their root systems destroyed.

d. Remove trees and other landscape features scarred or damaged by equipment operations, and replace with equivalent, undamaged trees and landscape features. Obtain Contracting Officer's approval before replacement.

e. Do not disturb fish and wildlife. Do not alter water flows or otherwise significantly disturb the native habitat adjacent to the project and critical to the survival of fish and wildlife, except as indicated or specified.

1.5.1.2 Management and control of noxious weeds

a. Invasive weeds are plants that have been introduced into an environment outside of their native range, where they have few or no natural enemies to limit their spread. The spread of invasive and noxious weeds is a significant issue in construction projects that involve land disturbance.

Earth-moving activities contribute to the spread of weeds, as does the use of contaminated con-struction fill, seed, or erosion control products. Experience has demonstrated that prevention is the least expensive and most effective way to halt the spread of noxious and invasive weeds.

Preventing the establishment and spread of weeds shall include the development of a site-specific weed control plan as part of the project work plan. The plan shall address the contrac-tor’s proposed methods for:

(1) Educating workers, on an ongoing basis, about the importance of managing weeds;

(2) Properly identifying weed species;

(3) Avoiding existing weed populations, when feasible;

(4) Washing or otherwise decontaminating earth-moving equipment prior to use on the in-stallation, and prior to leaving a project site, in order to prevent the transport of weed seeds and/or plant parts;

(5) Determining appropriate location(s) for washing or otherwise decontaminating earth-moving equipment;

(6) Obtaining soil components and mulches from certified weed-free sources;

(7) Purchasing and using only certified weed-free native seed;

(8) Reestablishing desirable native vegetation on all bare ground to minimize the spread of weeds;

(9) Ensuring establishment and maintenance of vigorous, desirable native vegetation to dis-courage weeds;

(10) Minimizing contact with sources of weed seed in areas not yet revegetated;

(11) Monitoring all seeded sites for weed infestations; and

(12) Reporting all new infestations on or adjacent to the project site to 90 CES/CEAN within

72 hours of discovery.

1.5.1.3 Threatened Species and Habitat

a. The contractor shall obtain written permission from 90 CES/CEAN prior to disturbing any areas of the base that support threatened species, or any areas that are considered suitable habi-tat for threatened species. Any disturbance to these areas must be approved in advance by the

U.S. Fish and Wildlife Service, which can take up to 120 days.

b. Areas of the base that support threatened species are Crow Creek (400 feet north of the creek and 400 feet south of the creek), Diamond Creek (400 feet north of the creek and 400 feet south of the creek), and the unnamed drainage in the southwestern corner of the base (200 feet north of the drainage and 200 feet south of the drainage).

1.5.2 CULTURAL RESOURCES

1.5.2.1 The FEW AFB Cultural Resources Manager (CRM), assigned to the 90th Civil Engineering Squadron, Asset Management Flight, Natural Resources Management Element (CEAN), is responsible for coordinating all FEW AFB activities under the NHPA. The CRM is legal-ly designated as the agency official for all FEW AFB undertakings within the context of Section 106. In order to comply with all Federal cultural resource authorities, the FEW AFB CRM will have an opportunity to review and comment on all proposed actions and undertakings. All Section 106 consultations shall follow the procedure outlined in the FEW AFB Integrated Cultural Resources Management Plan. No undertaking shall commence until Section 106 consultation is complete.

1.5.2.2 All historic buildings will be treated in accordance with the applicable Secretary of the Inte-rior’s Standards for the Treatment of Historic Properties.

1.6 SUBMITTALS

1.6.1 Government approval may be required on any of the following items. Items requiring submittals will be listed on the Submittal Register. Provide copies of all submittals per the requirements in

Section 01 33 00, Submittal Procedures, or as listed on the Submittal Register.

1.7 RELATED REQUIREMENTS

1.7.1 The information provided in this section applies to all other specification sections that are applicable to protect.

PART 2 PRODUCTS

2.1 AFFIRMATIVE PROCUREMENT

2.1.1 In compliance with the Affirmative Procurement requirements of Section 6002 of RCRA and

Executive Order 13101, the Government requires the use of the recycled and recovered materials and products identified in the Environmental Protection Agency's Comprehensive Procurement

Guidelines in all purchases.

2.1.1.1 These materials and products must meet the requirements of the specifications, must not delay the progress of the work, and must not be cost prohibitive.

2.1.2 EPA guideline items are seen as the minimum that should be considered when evaluating recycled/reuse materials. Other materials and products not listed, but commonly used in industry outside of the government should also be considered.

2.1.3 Material and product submittals for all recycled-content items required will list the recycled and recovered materials used and the percentage content.

2.1.4 Any decision not to acquire guideline items as required in the contract must be approved by the

Contracting Officer. All purchases of guideline items must be verified by the Contracting Officer before contract closure. Activities subject to upward reporting and verification will be contracts with a total value over $100,000.

2.1.5 Paper products such as government documents, agreements, contracts, etc., shall be printed on paper containing 30% post-consumer materials. The use of bio-based or bio-based containing products is encouraged.

2.1.6 All contractually required documents and reports produced by or for the Air Force longer than two pages shall be double-sided.

PART 3 EXECUTION

3.1 AIR QUALITY

3.1.1 Equipment operation, activities, or processes performed by the contractor shall be in accordance with all Federal and State air emission and performance laws and standards.

3.1.2 Burning of material is not allowed on base by the contractor.

3.1.3 Particulates – The contractor shall not operate a construction site or demolition project unless reasonable precautions are taken to control emissions of particulate matter. Such emissions of airborne particulate matter shall not exceed 20% opacity as defined in 40 CFR 60 Appendix A.

3.1.4 Sound Intrusions – The contractor shall keep construction activities under surveillance and control to minimize environment damage by noise. The contractor shall comply with the provisions of the State of Wyoming rules.

3.1.5 Ozone Depleting Chemicals (ODCs)

3.1.5.1 The contractor shall ensure activities performed under this contract are in compliance with

the Air Force Policy on ODCs. The contractor shall not purchase, use, nor specify the use of any Class I ODC in the production, design, or maintenance of the end item. Class II

ODCs may be used or specified only with the written approval of the Contracting Officer.

ODCs are identified and classified in Air Force Instruction (AFI) 32-7080.

3.1.5.2 Air Conditioning and Refrigeration Equipment – Any maintenance, repair and demolition work to air conditioning and refrigeration equipment shall require that all chlorofluorocar-bon (CFC) handling standards be met. The contractor shall not furnish any equipment that requires the use of ozone depleting chemicals nor shall he vent or cause to be vented CFC or hydrochlorofluorocarbons (HCFC) refrigerants or other mixtures containing CFCs to the atmosphere during repair, maintenance or demolition work on the equipment covered by this contract. The contractor shall have available refrigerant recovery or reclamation equipment to perform the work. Personnel who operate refrigerant reclaiming or recy-cling equipment shall possess the necessary State and local certifications for operating the equipment. The contractor shall be responsible for meeting all requirements, permitting, licensing and certification required by State or local ordinance to work on refrigeration systems. Replacement compressors and other replacement equipment used in repairing

CFC-containing systems shall be compatible with CFC replacement refrigerants.

3.2 WATER RESOURCES AND STORM WATER DISCHARGE

3.2.1 The contractor shall monitor construction activities to prevent pollution of surface and ground waters. Toxic or hazardous chemicals shall not be applied to soil or vegetation unless otherwise indicated. The contractor shall monitor all water areas affected by construction activities. For construction activities immediately adjacent to impaired surface waters, the contractor shall be capable of quantifying sediment or pollutant loading to that surface water when required by State-issued or Federally-issued Clean Water Act permits.

3.2.1.1 Storm Sewer – The contractor shall not discharge any contaminated materials into the storm drain system on base. EPA authorizes the following non-storm water discharges:

fire fighting activities; fire hydrant flushing; potable water sources; irrigation drainage;

lawn watering; routine building wash-down without detergents; pavement wash-waters where spills/leaks of toxic or hazardous materials have not occurred and where detergents are not used; air conditioning condensate; springs; uncontaminated groundwater; and foundation/footing drains where flows are not contaminated with process materials such as hydrocarbons/solvents.

3.2.1.2 Ground Water – For discharge of ground water, the contractor shall obtain a State or Fed-eral permit specific for pumping and discharging ground water prior to surface discharging in accordance with all Federal, State, and local laws and regulations.

3.2.1.3 Sanitary Sewer – The contractor shall not dump any materials down the sanitary sewer or wastewater disposal system without approval of the Air Force. All discharges to the sewer shall meet Federal, State, and local regulatory requirements and shall meet the permit re-quirements limiting F. E. Warren AFB discharges. Restricted wastewater materials in-clude, but are not limited to, those that create a fire or explosion hazard; are toxic or poi-sonous; waters or wastes having a pH lower than 5.0 or higher than 11.0; solid or viscous substances that can obstruct the sewer flow; interfere with the biological activity of a treatment plant; inhibit biological activity by increasing the temperature; any fats, wax, grease, or oils, total petroleum hydrocarbons, noxious or malodorous liquids; metals, phe-nols or dyes; and radioactive material. Wastewater discharged to F. E. Warren AFB’s sa-nitary sewer shall not exceed the following limitations:

3.2.1.4 Storm Water Discharge Permit for Construction Activities – Storm Water Discharge Per-mit – WYPDES (Wyoming Pollutant Discharge Elimination System) General Permit for

Storm Water Discharges Associated with Construction Activity is required for construc-tion activity in which clearing, grading, and excavation will result in disturbance of one

(1) acre or more of land.

a. For construction projects that disturb at least one (1) acre but less than five (5) acres, the con-tractor shall obtain and comply with all requirements of a general small construction Wyoming

Pollution Discharge Elimination System (WYPDES) permit (WYR10-A000). To obtain this permit, a site-specific Storm Water Pollution Prevention Plan (SWPPP) shall be signed by an approved company official (as per Part 11.7 of the General Permit) and submitted to the 90th

Civil Engineer Squadron Environmental Flight (90 CES/CEAN) thirty (30) days prior to the construction start date for approval. All Best Management Practices (BMPs) listed in the

SWPPP shall be installed prior to construction. The contractor shall comply with all permit re-quirements until the site has reached final stabilization, which is determined by 90 CES/CEAN and includes, but is not exclusive to the following:

(1) The Storm Water Pollution Prevention Plan (SWPPP) plan shall meet the basic require-ments provided in Part 8 of the General Permit.

(2) The SWPPP shall be maintained on the construction site as per Part 8.5 of the General

Permit.

(3) The contractor shall perform and document inspections as per Part 9 of the General Per-mit until the site has reached final stabilization.

(4) Upon final stabilization of the site, the contractor shall submit copies of all inspection logs to 90 CES/CEAN.

b. For construction projects that disturb five (5) or more acres, the contractor shall obtain and comply with all the requirements for the general large construction WYPDES permit (WYR10-

0000). Forty (40) days prior to the construction start date, the contractor shall submit a Notice of Intent (NOI) and the site-specific SWPPP signed by an approved company official (as per

Part VII G of the General Permit) to 90 CES/CEAN for approval. The contractor shall submit the approved NOI to the Wyoming Department of Environmental Quality (WDEQ) at least thir-

ty (30) days prior to the construction start date. The contractor shall submit a copy of the

WDEQ signed permit to 90 CES/CEAN. All BMPs listed in the SWPPP shall be installed prior to construction. The contractor shall comply with all permit requirements until the permit has officially been terminated, which includes, but is not exclusive to the following:

(1) The SWPPP shall meet the basic requirements of the SWPPP provided in Part IV of the

General Permit.

(2) The SWPPP shall be maintained on the construction site as per Part IV E. of the General

Permit.

(3) During construction, the contractor shall perform inspections as outlined in Part III of the

General Permit.

(4) The contractor shall pay WDEQ all fees associated with the permit.

(5) After the site has achieved final stabilization, as determined by 90 CES/CEAN, the con-tractor shall submit a Notice of Termination (NOT) to 90 CES/CEAN and WDEQ; and the contractor shall submit copies of all inspection logs to 90 CES/CEAN.

c. The contractor should reference the WDEQ website for forms, instructions, SWPPP informa-tion, and other guidelines for complying with Wyoming storm water requirements.

3.2.1.5 Permits to Construct – The Wyoming Department of Environmental Quality (WDEQ) re-quires approval and/or permit-to-construct prior to commencing construction of sanitary sewer systems or water systems, including but not limited to, water and sewer lines (all sizes), lift stations, fire hydrants, lawn sprinkler systems, and backflow preventers. The

Cheyenne Board of Public Utilities is required to review and approve the plans, specifica-tions, and design report prior to submittal to the WDEQ for approval and permit-to-construct. The plans, specifications, and design report must be certified by a Professional

Engineer (PE) registered in the State of Wyoming. The contractor shall be responsible for coordinating the submittal requirements, approval of the design, and/or permit-to-construct with F. E. Warren AFB Environmental Flight and Bioenvironmental Engineer-ing, the City of Cheyenne Board of Public Utilities, and the WDEQ Water Quality De-partment. Any time work is performed on the water supply, the F. E. Warren AFB Bioen-vironmental Flight must be contacted to conduct required sampling.

3.3 EROSION, SEDIMENT CONTROLS, AND WETLANDS

3.3.1 Wetlands – The contractor shall not enter, disturb, destroy, place fill into, or allow discharge of contaminants into any wetlands except as specifically authorized herein. The contractor shall be responsible for the protection of wetlands on F. E. Warren AFB. Authorization to enter specific wetlands identified shall not relieve the contractor from any obligation to protect other wetlands within, adjacent to, or in the vicinity of the construction site and associated boundaries. Maps showing locations of wetlands within F. E. Warren AFB can be obtained from 90 CES/CEAN.

3.3.2 The contractor shall be responsible for providing erosion and sediment control measures in accordance with Federal, State, and local laws and regulations. The erosion and sediment controls selected and maintained by the contractor shall be such that water quality standards are not violated as a result of the contractor’s construction activities. The area of bare soil exposed at any one time by construction operations should be kept to a minimum. The contractor shall construct or install temporary and permanent erosion and sediment control Best Management

sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins. The contractor’s BMPs shall also be in accordance with the base Storm Water Pollution Prevention

Plan (SWPPP), which may be reviewed at the F. E. Warren AFB Environmental Office. Any temporary measures shall be removed after the area has been stabilized.

3.4 TOXICS

3.4.1 The contractor is responsible for ensuring that no employee is exposed to toxic materials such as airborne asbestos, lead from lead-based paint (LBP), or polychlorinated biphenyls (PCBs).

3.4.1.1 Asbestos and Asbestos Hazards – The contractor shall conform to all the requirements of

29 CFR 1926.1101, Occupational Exposure to Asbestos; 40 CFR 61 Subpart M, National

Emission Standards for Hazardous Air Pollutants (Asbestos); 40 CFR 763, Asbestos; WY-

DEQ/AQD Chapter 3, Section 8 (Emission Standards for Asbestos); and any and all other applicable regulations pertaining to asbestos. Suspect asbestos-containing materials in-clude floor and/or ceiling tile, tile mastic, roofing materials and flashing mastics, pipe and boiler insulation, wall coverings, sheet rock joint compound, transite materials, etc. For facilities constructed prior to 1981, all suspect materials must be presumed to contain as-bestos unless survey data indicates otherwise. Survey data is available through 90

CES/CEAN for most facilities on base.

a. No new asbestos-containing materials shall be used or installed at any facilities under the juris-diction of F. E. Warren AFB.

b. The contractor shall notify the Wyoming Department of Environmental Quality, Air Quality

Division, 122 West 25th St, Herschler Building, Cheyenne WY 82002, of all demolition and renovation work where Regulated Asbestos Containing Materials (RACM) removal quantities meet minimums specified for notification in WY-DEQ/AQD Regulations, Chapter 3, Section 8.

Notification is required for demolition work even though the facility contains no asbestos con-taining material (40 CFR 61.145(a)(2)) (Demolition work is defined as any alteration of a struc-ture where a load-bearing beam is removed.) Copies of the advance notification indicating that the notifications have been made must be provided prior to allowing the contractor to perform work.

c. The contractor shall use workers that have been properly trained to conduct the work under the discipline and type of work that they will be performing under the contract, and shall be current on any and all annual refresher courses for that discipline. Copies of all training certificates must be submitted for all workers before they will be allowed to perform asbestos work.

3.4.1.2 Paint and Paint Hazards – Existing Paint: Existing painted surfaces may contain LBP.

For facilities constructed prior to 1981, it must be presumed that paint coatings contain lead unless survey data indicates otherwise. Limited survey information is available through 90 CES/CEAN. The contractor shall conform to all the requirements of 29 CFR

1926.62, Lead Exposure in Construction; 40 CFR 745, Lead-Based Paint Poisoning Pre-vention in Certain Residential Structures; 24 CFR 35, Lead-Based Paint Poisoning Preven-tion in Certain Residential Structures; and any and all other applicable regulations pertain-ing to lead. The contractor is responsible for ensuring that no employee is exposed to concentrations of lead in excess of the permissible exposure limit (PEL) equal to an eight hour time weighted average of 50 micrograms per cubic meter (g/m3). The contractor shall conform to all the requirements of 29 CFR 1926.62, Lead Exposure in Construction.

Workers are to wear respirators unless air testing establishes that lower protection factors are sufficient. Lead Safe Engineering Controls and Work Practices may be sufficient to reduce exposure to or below the PEL. If the lead PEL is exceeded, all workers shall wear

appropriate personal protective equipment. The contractor shall adhere to all other re-quirements of 29 CFR 1926.62. The contractor shall keep a steady mist of water on any demolition work that may cause exposures. Runoff shall be contained on the work site to prevent contamination to any watersheds or the sanitary sewer system. The contractor shall not contaminate the soil with lead due to excessive use of water. The site shall be limited to access by the public, and the contractor is responsible for non-exposure of the public to any lead concentrations above the PEL. The contractor must dispose of waste properly.

a. New-Paint Restriction – The contractor shall not furnish or use any paints or coatings contain-ing mercury or lead for interior or exterior applications.

b. No oil-based paints or coatings are to be used on base unless the entire liquid material is ap-plied to the intended surface. No oil-based paint liquid is to be left for disposal by base person-nel nor is any of this material to be improperly disposed of by the contractor.

c. Use of environmentally safe water-based paints and stains is recommended.

d. The contractor shall use workers that have been properly trained to conduct the work under the discipline and type of work that they will be performing under the contract, and shall be current on any and all refresher courses for that discipline. Copies of all training certificates must be submitted for all workers before they will be allowed to disturb LBP.

3.4.1.3 Polychlorinated Biphenyls (PCBs) – No PCBs or products containing PCBs shall be in-stalled on F. E. Warren AFB.

a. Turn in all light ballasts or electrical equipment with PCBs to 90 CES/CEAN. Transformers, capacitors, switching gear, etc., often contain PCBs for cooling purposes.

b. If hermetically sealed equipment, then turn in to 90 CES/CEAN assuming it has a PCB concen-tration greater than the 500-ppm limit.

c. The contractor shall:

(1) Count the number of units for turn in.

(2) Place units in a 49 CFR 178.500, Subpart L shipping container furnished by the contrac-tor.

(3) Call 90 CES/CEAN (307-773-4441) three (3) days in advance to schedule contractor de-livery.

(4) Deliver to appropriate storage facility.

3.5 HAZARDOUS MATERIALS (HAZMAT) CONTRACTOR AUTHORIZATION PROCEDURES

3.5.1 Contractors must obtain an authorization prior to bringing any hazardous materials (Federal

Standard 313) on Air Force installations. Contractors must submit all required documentation including appropriate Material Safety Data Sheet (MSDS) and projected usage information to

Bioenvironmental Engineering and 90 CES/CEAN through the Contracting Officer. This review is to ensure that no Air Force restricted hazardous materials are being proposed for use.

3.5.1.1 Following contract award, the contractor will enter the HAZMAT authorization informa-tion (i.e., AF Form 3952 Chemical/Hazardous Material Request/Authorization Form) into the Environmental Management Information System (EMIS) using a HAZMART com-puter terminal. This authorization requires 90th Civil Engineer approval. The Civil Engi-neer approval is for environmental and emergency response purposes only.

3.5.1.2 Contractors must also have their hazardous materials bar coded and, at least weekly, pro-vide the HAZMART with specific usage data.

3.5.1.3 The HAZMART ensures entry of the contractor information into EMIS. This action in-cludes the addition of the contractor to the Authorized Unit Listing (AUL) by

HAZMART.

3.5.1.4 The contractor shall maintain MSDSs for all hazardous materials used on base, and the

MSDSs shall be on file on-site at the construction site office at all times.

3.5.1.5 Prior to completion of the contract, the contractor shall provide a finalized report of the ac-tual quantities used during the contract, remove excess materials, and close out the

HAZMART account.

3.5.1.6 The contractor shall submit all of the above data as a formal contract submittal.

3.6 PETROLEUM, OILS, AND LUBIRCANTS (POL)

3.6.1 The contractor shall ensure all petroleum (fuels), oils, and lubes (POL) in containers 55 gallons or greater are stored and managed in accordance with the FEW Spill Controls and Countermeasures

(SPCC) Plan. A copy of the FEW SPCC Plan can be made available electronically by contacting the FEW Natural Resources Management Element, 90 CES/CEAN, Storage Tank Program

Manager, located in Bldg 321. A notification of the 90 CES/CEAN Storage Tank Program

Manager must be made prior to transporting POL containers in excess of 55 gallons onto F. E.

Warren AFB.

3.6.2 Take special measures to prevent oils or other hazardous substances from entering the ground, drainage areas, or local bodies of water. Surround all temporary fuel oil, petroleum, or liquid chemical storage containers greater than or equal to 55 gallons with secondary containment of sufficient size and strength to contain the contents of the tanks and freeboard precipitation (2” per

24-hour period) in the event of content leakage of spillage.

3.6.3 POL storage greater than 55 gallons is subject to monthly visual inspection in accordance with the FEW SPCC Plan.

3.6.4 Tank locations must be coordinated though 90 CES/CEAN and should be sited in an area that provides the most protection to the environment in case of spill.

3.6.5 Used lubricants and oils that will be disposed of or recycled shall be stored in marked corrosion-resistant containers and recycled or disposed in accordance with 40 CFR 279, State, and local laws and regulations.

3.6.6 Petroleum stained areas – The contractor shall conduct weekly visual inspection throughout the project to ensure there are no signs of petroleum stains on impervious surfaces at the project site.

This includes leaks or drips from heavy equipment used during the project. In the event petroleum staining is identified, the contractor is responsible for complete removal and disposal, including the replacement of the stained surface (such as soil and grass). The contractor and

QAE shall confirm that no petroleum stained soil is present in or around the area affected by the project on the final walk through.

3.7 EMERGENCY PLANNING AND COMMUNITY RIGHT-TO-KNOW ACT (EPCRA)

3.7.1 For contracts over $100,000, contractors shall comply with the Toxic Release Inventory reporting provisions of EPCRA Section 313 by filing Form R reports during the life of the contract.

Contractors shall provide a list of any extremely hazardous or hazardous substances listed under

EPCRA along with maximum inventory and consumption. HAZMART registration fulfills this requirement. Contractors shall provide this information to 90 CES/CEAN and HAZMART.

Should the potential contractor not be subject to reporting under EPCRA, he shall certify as such.

3.8 SPILLS AND SPILL RESPONSE PROCEDURES

3.8.1 It is the contractor's responsibility to properly handle and dispose of clean up materials. Spills of any type material (excluding clean water) shall be reported immediately to the QAE and

90 CES/CEAN (307-773-4441) to determine which State and Federal agencies are to be notified.

AT NO TIME WILL THE CONTRACTOR OR CONTRACTING AGENT CALL A

FEDERAL OR STATE AGENCY TO REPORT A SPILL WITHOUT APPROVAL FROM

90 CES/CEAN.

3.8.2 The contractor will be charged for any clean-up and disposal costs accomplished by F. E. Warren

AFB civilian or contract personnel.

3.8.3 All spill clean-ups will be completed by trained personnel only and in accordance with the

F. E. Warren AFB Hazardous Waste Management Plan.

3.8.4 Any hazardous products or materials of environmental concern cleaned up on F. E. Warren AFB facilities must be tested to determine if it is a hazardous waste.

3.8.5 In most cases, the following spill response will apply:

3.8.5.1 For spills beyond the capabilities of contractor personnel, call the Base Fire Dept at 911.

3.8.5.2 Determine if the spill can be contained by the contractor. If it can be contained without in-jury to personnel, without assistance from base response personnel, and has not impacted a storm drain or waterway, perform the following:

a. Evacuate the area downwind of the spill if warranted by the type of release.

b. Ensure all workers shut down their operations and secure their equipment, time permitting.

c. Stop source of spill without undue risk of personal injury. Use on-site containment, safety equipment, and materials.

d. Contain and/or control the release. Clean up the release using proper absorbent media for the chemical spilled.

e. Recover as much of the spill as possible using absorbent media or approved vacuum device to minimize hazardous waste volume. Do not hose down the spilled material into storm drains.

f. Report the spill to the Contracting Officer and 90 CES/CEAN (307-773-4441) for the proper reporting and guidance in the proper disposal of recovered material.

3.9 DISCOVERY OF CONTAMINATED SOILS, MILITARY MUNITIONS, AND HISTORIC,

ARCHAEOLOGICAL, OR CULTURAL RESOURCES

3.9.1 If contaminated soil is encountered during any excavation work, the Spill Response procedure shall be followed. Following site evaluation, the Contracting Officer will advise of the steps that the contractor must follow to complete the work through the contaminated area. This may include a requirement for 40-Hour Hazardous Waste Operations and Emergency Response training, Confined Space Entry training and permitting, respiratory protection, and completion of a Site Safety and Health Plan. Any additional cost, not specified in the original contract, of work performed by the contractor in the contaminated area, shall be negotiated through the F. E.

Warren AFB Contracting Office.

3.9.2 Historical, Archaeological, and Cultural Resources [Known historical, archaeological, and cultural resources within the contractor's work area are shown on the drawings]. The contractor shall protect historical, archaeological, and cultural resources and shall be responsible for their preservation during the life of the contract. If during excavation or other construction activities, any previously unidentified or unanticipated historical, archaeological, and cultural resources are discovered or found, all activities that may damage or alter such resources shall be temporarily suspended. Resources covered by this paragraph include, but are not limited to: any human skeletal remains or burials; artifacts; shell, midden, bone, charcoal, or other deposits; rock alignments, paintings, walls, or other constructed features; and any indication of other human activities. Upon such discovery or find, the contractor shall immediately notify the Contracting

Officer and the Base Historic Preservation Officer so that the appropriate authorities may be notified and a determination made as to their significance and what, if any, special disposition of the finds should be made. The contractor shall cease all activities that may result in impact to or the destruction of these resources. The contractor shall secure the area and prevent employees or other persons from trespassing on, removing, or otherwise disturbing such resources.

3.9.2.1 Modifications/construction in historic buildings has been approved by the Wyoming State

Historic Preservation Office (SHPO). Any proposed changes to the approved project plans must be reviewed and approved in writing by the Base Historic Preservation Officer and the SHPO.

3.9.3 Military Munitions: In the event the contractor discovers or uncovers military munitions as defined in 40 CFR 260, the contractor shall immediately stop work in that area and immediately inform the Contracting Officer.
