About this file
This is an Exhibit C document outlining liquidated damages provisions for a contract with Metro PM. The contract establishes a project schedule with defined milestones outlined in Section 1.05 of the Scope of Services (Exhibit A). The contractor is obligated to complete all milestones within specified timeframes, with any delays beyond the designated periods resulting in financial penalties. Metro PM retains discretionary authority to waive liquidated damages if circumstances warrant such action.
Liquidated damages are assessed at a daily rate of $1,962.00 per calendar day for each missed milestone. The financial liability for any individual missed milestone is capped at 14 days of damages, regardless of the actual duration of the delay. This maximum cap applies uniformly across all milestones, meaning that even if a milestone is delayed beyond 14 days, the total liquidated damages charge for that specific milestone cannot exceed the equivalent of 14 days' worth of penalties. The structure ensures predictable financial exposure while incentivizing timely milestone completion.
