About this file

This document comprises the technical specifications and bid documents for the Dyal Water Treatment Plant (WTP) Operations Building Remodel project prepared by Jacobs for the City of Cocoa, Florida. The project encompasses renovations and alterations to a portion of the first floor of the existing WTP Operations Building located at 28400 SR 520, Christmas, Florida, specifically targeting the Instrument Repair/Office, Breakroom, and Electrical Workshop areas. Work includes demolition of existing spaces, installation of new flooring, lighting, and ceiling tiles, painting, HVAC system alterations, electrical and lighting circuit modifications, and kitchen cabinetry and appliance replacement. The breakroom remodel involves partitioning to create two additional offices. All work must be completed to provide finished rooms ready for occupancy, with the project requiring phased sequencing to maintain continuous WTP operations during construction. The construction sequencing suggests relocating instrument and electrical workshop operations to the breakroom initially, followed by completion of those two rooms, subsequent work on the breakroom and corridor areas, and final punch list completion. Working hours are scheduled between 7 a.m. and 5 p.m., excluding weekends and holidays, with outside hours requiring written owner approval.

Payment procedures establish a lump sum contract structure with progress payments based on a percentage-complete basis using an owner-approved Schedule of Values. The contractor must submit a preliminary progress schedule at least seven days prior to the preconstruction conference and a detailed progress schedule within 30 days of the effective date, with monthly updates required thereafter. Progress meetings are scheduled bi-weekly to review work progress, payment applications, and contract modifications. The contractor is responsible for all mobilization costs, including permits, temporary power and utilities, sanitary facilities, and field office setup. Temporary facilities must include adequate dust and water pollution controls, erosion and sedimentation management, and fire protection equipment compliant with NFPA 241. The contractor must maintain a clean work environment within the active occupied building, conducting weekly cleaning and debris removal, and implementing wet-down procedures to minimize dust. All submittals require contractor approval stamps and must be submitted in PDF format with proper documentation and transmittal forms before engineer review.

PROJECT COORDINATION

PART 1 GENERAL

1.01 DEFINITIONS

A. Substantial Completion: The time at which the Work (or specified part thereof) has progressed to the point where, in the opinion of the Engineer, the Work (or a specified part thereof) is sufficiently complete, in accordance with the Contract Documents, so that the Work (or a specified part thereof) can be utilized for the purposes for which it is intended. The terms “substantially complete” and “substantially completed” as applied to all or part of the Work refer to Substantial Completion thereof.

1. When the Contractor considers the entire Work ready for its intended use the Contractor shall notify the Owner and the Engineer in writing that the entire Work is substantially complete (except for items specifically listed by Contractor as incomplete) and request that the Engineer issue a certificate of Substantial Completion.

2. Promptly after Contractor’s notification, the Owner, Contractor, and Engineer shall make an inspection of the Work to determine the status of completion. If the Engineer does not consider the Work substantially complete, the Engineer will notify the Contractor in writing giving the reasons therefor.

3. If the Engineer considers the Work substantially complete, the Engineer will deliver to the Owner a tentative certificate of Substantial Completion which shall fix the date of Substantial Completion. There shall be attached to the certificate a tentative list of items to be completed or corrected before final payment. The Owner shall have seven calendar days after receipt of the tentative certificate during which to make written objection to the Engineer as to any provisions of the certificate or attached list. If, after considering such objections, the Engineer concludes that the Work is not substantially complete, the Engineer will, within 14 calendar days after submission of the tentative certificate to the Owner, notify Contractor in writing, stating the reasons therefor. If, after consideration of the Owner’s objections, the Engineer considers the Work substantially complete, the Engineer will, within said 14 calendar days, execute and deliver to the Owner and the Contractor a definitive certificate of Substantial Completion (with a revised tentative list of items to be completed or corrected) reflecting such changes from the tentative certificate as the Engineer believes justified after consideration of any objections from the Owner.

C. If an activity is not completed by its latest scheduled completion date and this failure is anticipated to extend Contract Times (or Milestones), submit, within 7 days of such failure, a written statement as to how nonperformance will be corrected to return Project to acceptable current Progress Schedule. Actions by Contractor to complete the Work within Contract Times (or Milestones) will not be justification for adjustment to Contract Price or Contract Times.

2. In all other respects, Engineer’s acceptance of Contractor’s schedule indicates that, in Engineer’s judgment, schedule represents reasonable plan for constructing Project in accordance with the Contract Documents. Engineer’s review will not make any change in Contract requirements. Lack of comment on any aspect of schedule that is not in accordance with the Contract Documents will not thereby indicate acceptance of that change, unless Contractor has explicitly called the nonconformance to Engineer’s attention in submittal. Schedule remains Contractor’s responsibility and Contractor retains responsibility for performing all activities, for activity durations, and for activity sequences required to construct Project in accordance with the Contract Documents.

B. Unacceptable Preliminary Progress Schedule:

1.08 ADJUSTMENT OF CONTRACT TIMES

A. Evaluation and reconciliation of Adjustments of Contract Times shall be based on the Updated Progress Schedule at the time of proposed adjustment or claimed delay.

B. Schedule Contingency:

1. Contingency, when used in the context of the Progress Schedule, is time between Contractor’s proposed Completion Time and Contract Completion Time.

2. Contingency included in Progress Schedule is a Project resource available to both Contractor and Owner to meet Contract Milestones and Contract Times. Use of Schedule contingency shall be shared to the proportionate benefit of both parties.

3. Use of schedule contingency suppression techniques such as preferential sequencing and extended activity times is prohibited.

4. Pursuant to Contingency sharing provisions of this specification, no time extensions will be granted, nor will delay damages be paid until a delay occurs which (i) consumes all available contingency time, and (ii) extends Work beyond the Contract Completion date.

C. Claims Based on Contract Times:

1. Where Engineer has not yet rendered formal decision on Contractor’s Claim for adjustment of Contract Times, and parties are unable to agree as to amount of adjustment to be reflected in Progress Schedule, reflect an interim adjustment in the Progress Schedule as acceptable to Engineer.

2. It is understood and agreed that such interim acceptance will not be binding on either Contractor or Owner, and will be made only for the purpose of continuing to schedule Work until such time as formal decision has been rendered as to an adjustment, if any, of the Contract Times.

3. Revise Progress Schedule prepared thereafter in accordance with Engineer’s formal decision.
