Categorical Exclusion Form Natchez Trace Parkway

Project: PRA-NATR tAtS, BlO Date: March t8, 2014

Project description, including location:

The Eastern Federal Lands Highway Division of the Federal Highway Administration (FHWA), in cooperation with the National Park Service (NPS), is proposing to rehabilitate the Parkway motor road from milepost 423.70 to 442.25 in Williamson and Davidson Counties, Tennessee.

The rehabilitation work will include asphalt overlay, shoulder grading, spot patching, spot leveling, striping, safety improvements and other miscellaneous work. Milling will be required as needed at bridges, pulloffs, and parking areas to maintain a 6-inch curb reveal.

Describe the category used to exclude the action from further NEPA:

23 CFR § 771.117(d)(t) Modernization of a highway by resurfacing, restoration, rehabilitation, reconstruction, adding shoulders, or adding auxiliary lanes (e.g., parking, weaving, turning, climbing).

Describe any public or agency involvement effort conducted:

A letter dated January 8, 2013 was sent to the U.S. Fish and Wildlife Service (FWS) requesting concurrence that the proposed project may affect, but is not likely to adversely affect any Federally-listed species. By letter dated February 10, 2014, the FWS concurred with the FHWA's determination, stating that, "We are unaware of any federally listed or proposed species that would be adversely impacted by this project."

An Assessment of Actions Having an Effect on Cultural Resources was approved on March 12, 2014. The project will have no adverse effect on cultural resources.

The NPS categorically excluded the project from further NEP A analysis on March 12, 2014 and determined that the project would have no effect on federally-listed species.

23 CFR 771.117 Categorical exclusions (CEs) are actions which meet the definition contained in 40 CFR 1508.4, and, based on past experience with similar actions, do not involve significant environmental impacts.

The proposed action will: YES NO Induce significant impacts to planned growth or X land use for the area Require the relocation of significant numbers of X people

Have a significant impact on any natural, cultural, X recreational, historic, or other resource

Involve significant air, noise, or water quality X impacts

Have significant impacts on travel patterns X

Otherwise, either individually or cumulatively have X any significant environmental impacts

If any box is checked yes, the action may not be categorically excluded and an EA or EIS must be prepared. If none are checked yes, attach Environmental Screening Form, notes from consultation with agencies and/or the public, notes of site visits and any other material related to the environmental impact of the proposal. This becomes the NEP A piece of the statutory compliance file.

On the basis of the environmental impact information in the statutory compliance file, with which I am familiar, I believe the project should be categorically excluded from further NEP A analysis.

Subject: FWS# 14-CP A -0208. Natchez Trace Parkway Rehabilitation from Mile Post 423 to Mile Post 442; Project PRA-NATR 1A15, Williamson and Davidson counties, Tennessee.

Dear Mr. Rose:

Thank you for your correspondence dated January 8, 2014, regarding the proposal to rehabilitate the Natchez Trace Parkway from Mile Post 423 to Mile Post 442 in Williamson and Davidson counties, Tennessee. The project would involve resurfacing the roadway, shoulder grading, spot patching and leveling, striping, safety improvements, and other related activities. The Federal Highway Administration (FHWA) requests our concurrence on their project determination of"not likely to adversely affect" (NLAA) for the federally listed Nashville crayfish (Orconectes shoupi), Short's bladderpod (Physaria globosa), Price's potato-bean (Apios priceana), leafy prairie-clover (Da/ea fo/iosa), Indiana bat (Myotis soda/is), the proposed endangered northern long-eared bat (Myotis septentriona/is), candidate Baker Station cave beetle (Pseudanophthalmus insu/aris) and the delisted Eggert's sunflower (He/ianthus eggertii) and Tennessee purple coneflower (Echinacea tennesseensis). Personnel of the U.S. Fish and Wildlife Service have reviewed the subject proposal and offer the following comments.

Upon review of the information provided, we concur with the FHWA' s determination ofNLAA for the aforementioned species. We are unaware of any federally listed or proposed species that would be adversely impacted by this project. Therefore, based on the best information available at this time, we believe that the requirements of section 7 of the Endangered Species Act of 1973, as amended, are fulfilled for all species that currently receive federal protection under the Act.

Obligations under section 7 of the Act must be reconsidered if(1) new information reveals impacts of the proposed action that may affect listed species or critical habitat in a manner not previously considered, (2) the proposed action is subsequently modified to include activities which were not considered during this consultation, or (3) new species are listed or critical habitat designated that might be affected by the proposed action.

If you have any questions regarding our comments, please contact John Griffith of my staff at 931/525-4995 or by email atjohn_griffith@fws.gov.

Sincerely, J4nU-ll ¥ Mary E. J.ennings

F. INSTRUCTIONS FOR DETERMINING APPROPRIATE NEPA PATHWAY

First, always check D0-12, section 3.2, "Process to Follow" in determining whether the action is categorically excluded from additional NEPA analyses. Other sections within D0-12, including sections 2.9 and 2.1 0; 3.5;

4.5(G)(4) and (G)(5), and 5.4(F), should also be consulted In determining the appropriate NEPA pathway.

Complete the following tasks: conduct a site visit or ensure that staff is familiar with the site's specifics; consult with affected agencies, and/or tribes; and interested public and complete this environmental screening form.

If your action Is described in D0-12 section 3.3, "CEs for Which No Formal Documentation Is Necessary," follow the instructions indicated In that section.

If your action Is not described in D0-12, section 3.3, and IS described ts section 3.4, AND you checked YES or Identified "data needed to determine" impacts In any block In section D (Mandatory Criteria), this is an indication that there is potential for significant impacts to the human environment, therefore, you must prepare an EA or EIS or supply missing information to determine context, duration, and intensity of impacts.

If your action is described in section 3.4 and NO Is checked for all boxes in section D (Mandatory Criteria), AND there are either no effects or all of the potential. effects Identified in section C (Resource Effects to Consider) are no more than minor intensity, usually there is no potential for significant impacts and an EA or EIS is not required. If, however, during internal scoplng and further Investigation, resource effects still remain unknown, or are at the minor to moderate level of int~nsity, and the potential for significant impacts may be likely, an EA or EIS is required.

In all cases, data collected to determine the appropriate NEPA pathway must be included in the admin istrative record .

G. INTERDISCIPLINARY TEAM SIGNATORIES

All interdisciplinary team members sign as directed or deemed necessary by the Superintendent. By signing this form, you affirm the following: you have either completed a site visit or are familiar with the specifics of the site;

you have consulted with affected agencies and tribes; and you, to the best of your knowledge, have answered the questions posed in the checklist correctly.
