About this file

This Construction Supplemental document, effective July 2024, outlines additional requirements applicable to a Maryland state construction contract for a Rooftop Unit Replacement project at Western Correctional Institution. The document does not specify project quantities, response dates, due dates, site visits, bidders' conferences, or award dates. However, it establishes that contractor personnel must comply with comprehensive security protocols, including displaying company identification badges at all times while on state premises, cooperating with state site requirements such as escorts and badge issuance, and submitting to random security checks and physical searches when entering or exiting state secured areas. The state reserves the right to refuse any contractor personnel based on criminal convictions and may immediately terminate the contract for default if security requirements are violated.

The supplemental also addresses bid/proposal bond requirements for construction contracts exceeding $200,000 and other contracts exceeding $100,000 when applicable, references construction contract retainage provisions under Maryland regulations, and mandates that all goods furnished under the contract be American-manufactured goods as defined in COMAR 21.11.15.04, unless the goods qualify as emergency life safety goods or the Department of General Services determines that exceptions apply based on price, availability, quality, or public interest considerations. Bidders certify compliance with American-manufactured goods requirements by submitting a signed certification to the procurement officer prior to contract award.
