About this file

This is a Task Assignment Notification Form (Task Assignment Number SL010.129) issued by the Florida Department of Environmental Protection (DEP) on October 17, 2024, under DEP Contract No. SL010. The task involves a title search report for two parcels in St. Lucie County: parcel 3435-132-0001-000-8 (owned by the Board of Trustees of the Internal Improvement Trust Fund) and parcel 3414-501-2110-250-3 (owned by JOHO Properties, LLC). The contractor is American Government Services Corporation (FEID No. 59-2346160), with Wendi McAleese and Tammy Mehl serving as the contractor contract managers. The DEP Designated Task Manager is Casey Jones, and Tanja Hall is the DEP Contract Manager.

The deliverable is a comprehensive Title Search Report addressing the validity and chain of title for both parcels, with particular focus on a 40-foot-wide easement that appears in the JOHO Properties deed and questions regarding whether the easement grantor had authority to grant an easement across Board of Trustees-owned lands, the status of platted roads and easements referenced in the survey, and associated documentation gaps in online records. The contracted rate for title search and closing commitment services is $325 per commitment, with a total task assignment value of $650 (2 commitments at $325 each). The title commitment is due within 14 days (excluding holidays) of task assignment execution, and the task assignment end date is 30 days after closing occurs. No liquidated damages per day charges are specified in the document. The funding source is allocated under organizational code 37101000000, fund code 408001, and object code 132600, with a total amount of $650.

From: Richardson, Brad To: Jones, Casey R Subject: Request for Title Work Date: Wednesday, October 16, 2024 1:03:55 PM Attachments: Misc 3510.pdf image001.png image002.png image003.png

Casey, As discussed, this is our request:

Parcel in question: 3435-132-0001-000-8 in St. Lucie County. BOT owned Inholding in question: 3414-501-2110-250-3. JOHO Properties, LLC owned

The deed into Joho contains a 40’ wide easement. We are questioning the validity of the easement. I.e. It appears the easement suddenly appeared in the chain of title, but my research indicates that when it first appeared, the Grantor didn’t own the lands to be able to grant an easement across BOT owned lands.

The survey attached (Misc 3510.pdf) references the easement and Bk/Pg, however, the online records do not contain a copy.

The reserved easement also makes mention of a Plat and I can’t tell if that plat was ever vacated or if the platted roads were ever vacated.

BOT parcel, with inholding in teal, seen here (disregard red square):
