About this file
This is Amendment No. 9 to the DEP Agency Term Contract No. GC871, a rate increase amendment executed between the Florida Department of Environmental Protection (FDEP) and Kimberly Ann Brown and Associates, Inc. The original contract was executed on February 27, 2014, to provide petroleum contamination site response action services in the South Region. The amendment was processed and became effective on June 19, 2020, following departmental data processing and authorization by both parties.
Amendment No. 9 modifies rates for 168 pay items within the contract's comprehensive rate schedule (Attachment D, Version 3.2), which encompasses services spanning site assessments, drilling and boring, well installation and abandonment, sample collection, laboratory analysis, soil source removal, remedial action construction, pilot testing, system operations and maintenance, reports, and professional engineering and geology services. The rate changes apply exclusively to new work assignments offered on or after the Rate Change Date (June 19, 2020) while pre-rate change work assignments continue under the previous rate schedule. Rate adjustments vary by line item, with changes ranging from decreases of up to 28.88 percent to increases of up to 5.00 percent, reflecting the contractor's justified requests that did not exceed the maximum 5.00 percent increase allowed under contract provision 11.B.ii. All other terms and conditions of the original contract remain in effect, and the amended schedule maintains the reimbursable cost structure and percentage surcharge provisions for laboratory turnaround time options.
