Amendment No. 13 Summary
This is Amendment No. 13 to Agency Term Contract No. GC871, a petroleum contamination site response action services contract executed between the Florida Department of Environmental Protection (DEP) and Kimberly Ann Brown and Associates, Inc. The contract, originally executed on February 27, 2014, provides petroleum restoration program services in Florida's South Region. The amendment was executed on May 4, 2023, by President Kimberly Ann Brown for the contractor and Acting Deputy Secretary Justin Wolfe for the DEP.
Amendment No. 13 implements rate increases to the contractor's Rate Schedule (Attachment D, Version 3.4), effective for all new work assignments issued on or after the Rate Change Date of June 1, 2023. The rate adjustments range from approximately 2.45% to 8.00% across over 400 pay items encompassing mobilization services, drilling and boring operations, well installation and abandonment, soil and water sampling and analysis, debris and waste removal and disposal, remedial systems installation and operation, engineering controls, and professional services (including licensed professionals such as project engineers, geologists, and hydrogeologists). All pre-Rate Change Date work assignments and previously offered work assignments continue to apply the prior rate schedule. The amendment also updates technical specifications requiring photo documentation of drum interiors to ensure compliance with the 75% full industry standard, and modifies contract terms to prohibit new purchase orders or task assignments after the renewal term expiration, though outstanding work may continue for up to twelve months thereafter.
