About this file
DEP Contract No. GC871 Amendment No. 2 is an amendment to a Petroleum Restoration Program indefinite delivery contract originally executed on February 27, 2014, and restated on September 30, 2015, between the Florida Department of Environmental Protection (DEP) and Kimberly Ann Brown and Associates, Inc. (KBAA). The amendment was executed on March 4, 2017, by the contractor and April 5, 2017, by DEP. This document modifies specific contract paragraphs and establishes new operational requirements and compliance standards for the contractor.
The amendment makes substantive revisions to contract administration procedures, including updated notice and communication protocols, public records management requirements, record keeping and audit standards, tax exemption recognition, contractor disqualification criteria, employment eligibility verification via E-Verify, anti-scrutinized company certifications for contracts exceeding one million dollars, MyFloridaMarketPlace transaction fee obligations, and execution procedures for counterparts. Additionally, the amendment updates the Scope of Services Appendix by deleting Item No. 44 ("Investigations Near Petroleum Storage Systems") and adding two new items: Item No. 44.a covering a restatement of guidance for amended and restated agency term contracts and petroleum storage system damage protocols (effective December 16, 2016), and Item No. 44.b establishing performance standards for state-funded investigations near petroleum storage systems and utilities (effective December 15, 2016). All other terms and conditions of the restated contract remain unchanged.
