About this file

This is Amendment No. 6 to DEP Agency Term Contract No. GC871, an indefinite delivery vehicle between the Florida Department of Environmental Protection (FDEP) and Kimberly Ann Brown and Associates, Inc. The original contract, executed on February 27, 2014, provides petroleum contamination site response action services in the South Region of Florida. The amendment was executed on March 25, 2019, and is effective March 27, 2019.

Amendment No. 6 modifies the Schedule of Pay Items by superseding two existing pay items and adding two new pay items with negotiated rates applicable only to new work assignments offered on or after the effective date. Pay Item 14-1, "Direct Push Boring with In-Situ Injection [Per Foot]," is superseded by Pay Item 14-1.a, "Direct Push Boring with In-Situ Injection [Per Day]," at an agreed rate of $4,450.00 per day. Pay Item 14-2, "In-Situ Injection Into Existing Well/Treatment Point [Per Injection Point]," is superseded by Pay Item 14-2.a, "In-Situ Injection Into Existing Well/Treatment Point [Per Day]," at an agreed rate of $3,375.00 per day. All outstanding work assignments prior to March 27, 2019, continue under the previously applicable rate schedule. The amendment also adds a new provision to paragraph 37 regarding contractor certification that it is not on the Scrutinized Companies that Boycott Israel List, pursuant to Section 287.135, F.S., with provisions for contract termination if false certification or boycott involvement is discovered. Attachment D (V3.0), a comprehensive 27-page rate schedule, is incorporated into the contract and establishes pricing for all services including mobilization, drilling and boring, well installation and abandonment, sample collection and field testing, laboratory analysis, soil source removal, debris and waste disposal, petroleum storage tank removal, remediation system operation and maintenance, reports, and personnel services.
