About this file
This is a wage theft prevention certification form issued by the City of Boston for compliance with an Executive Order designed to prevent wage theft in city contracts. The form applies to all vendors bidding on or awarded contracts with the City of Boston, including the On-Call BPS Moving Supplies contract with Boston Public Schools Facilities Department. Vendors must certify compliance by selecting either Box 1 (certifying no violations) or Box 2 (disclosing violations) regarding federal or state criminal or civil judgments, administrative citations, final administrative determinations, orders, or debarments resulting from violations of Massachusetts General Laws chapters 149 and 151 or the Fair Labor Standards Act within three years prior to bid submission. For multi-year contracts, the certification must be completed annually on the contract anniversary. All vendors must also certify that they will report any violations occurring during the pending bid period or contract term within five business days of receiving notice.
Vendors with disclosed violations within the three-year lookback period or during the contract term are required to submit monthly certified payrolls to the City Official for all employees working on the contract and may be required to obtain a wage bond or suitable insurance equal to one year's gross wages for all employees. Vendors subject to state or federal debarment for wage and hour violations or prohibited from contracting with the Commonwealth are ineligible to contract with the City, and the City may terminate any awarded contract upon a finding or order of debarment. Additionally, all contractors awarded a City contract must post the Massachusetts Wage and Hour Laws notice at mass.gov/ago/docs/workplace/wage/wagehourposter.pdf in conspicuous places to inform employees of protections under applicable laws. The form must be signed and included with all bid or proposal submissions, with failure to provide it resulting in rejection of the bid.
