About this file
This is a Labor & Material Payment Bond form (SE-357, 2023 Edition) for construction contracts in South Carolina. The bond is executed between a contractor, surety, and a state or local agency to ensure payment for all labor, materials, and equipment required for contract performance.
The bond obligates the contractor and surety, jointly and severally, to pay all claimants for labor, materials, and equipment furnished for the work. Claimants who have not received full payment within 90 days after the last labor was performed or materials were supplied may pursue legal action against the bond. Remote claimants—those with contractual relationships only to subcontractors—must provide written notice by certified or registered mail to the contractor within 90 days to preserve their rights. All lawsuits must be filed in the county or circuit where the construction contract is to be performed and must be commenced within one year from the date the last labor was performed or materials supplied. Upon receiving a claim, the surety must send an answer within 60 days stating undisputed amounts and the basis for any disputed amounts, then pay or arrange payment of undisputed sums. The surety waives notice of any changes to the contract and is not liable for contractor obligations unrelated to the contract. The bond is governed by South Carolina law, specifically Title 29, Chapter 5 and SC Code of Laws Section 11-35-3030(2)(c), and is construed as a statutory bond rather than a common law bond.
