About this file
This document outlines the construction insurance requirements established by the State of Colorado and the Auraria Higher Education Center for contractors performing work under the AHEC-27701-R On-Call Service Providers/Small Construction contract. Contractors must obtain and maintain multiple types of insurance coverage throughout the contract term, including workers' compensation insurance as required by state statute, commercial general liability insurance with minimum limits of $2,000,000 general aggregate and $1,000,000 per occurrence, automobile liability insurance with $1,000,000 combined single limits, and builder's risk insurance in the amount of the initial contract sum plus subsequent modifications. For projects exceeding $10,000,000, contractors must also secure umbrella liability insurance with $5,000,000 per occurrence and aggregate limits. Professional liability insurance is required specifically for abatement contractors, and pollution liability insurance of $1,000,000 is mandatory for contractors performing work involving pollution or environmental hazards. Certificates of insurance must be provided within seven business days of the contract's effective date and no later than the commencement of services.
The State of Colorado and Auraria Higher Education Center must be named as additional insureds on all applicable policies, with coverage required to be primary and non-contributory to any state insurance or self-insurance programs. Insurance policies must include provisions preventing cancellation or non-renewal without at least 45 days' notice to the State by certified mail, except for non-payment which requires 10 days' notice. All policies must include waiver-of-subrogation clauses protecting the State of Colorado, its agencies, institutions, officers, agents, employees, and volunteers from recovery claims. Renewal certificates must be submitted no later than 15 days prior to policy expiration dates, and the State retains the right to request proof of compliance at any time during the contract term. For contractors classified as public entities under the Colorado Governmental Immunity Act, alternative self-insurance arrangements may be permitted upon demonstration of adequate coverage.
