RATIONAL FOR DETERMINATION OF CATEGORY: This contract clause is specific to the task orders (TO) issued for one Indefinite Delivery/ Indefinite Quantity (ID/IQ) contract, the Antenna Program Support (APS) III.
JUSTIFICATION: Currently FAR 52.215-8 “Order of Precedence-Uniform Contract Format” establishes an order of precedence between the contract schedule, representation and other instructions, contract clauses, other documents, exhibit, and attachments, and the specifications. A supplemental clause is needed to assign an order of precedence for “other documents, exhibits, and attachments” cited under FAR 52.215-8(d). This supplemental clause provides clarity in an effort to avoid inconsistencies in the contract. In addition, this clause should obviate any disputes involving conflicting language or interpretation concerning the order of precedence of “other documents, exhibits, and attachments.”

This clause is intended to supplement FAR 52.215-8, “Order of Precedence-Uniform Contract Format” by clarifying the broad language of FAR 52.215-8(d) “Other documents, exhibits, and attachments.” This clause does not change the order of precedence established in FAR 52.215-8(a thru e).
For purposes of Solicitation/Contract Number: FA8102-22-R-0007, the order of precedence established by this clause for FAR 52.218(d)- “Other documents, exhibits, and attachments” is as follows:
1. Performance Work Statement (PWS)
2. Exhibits to include Contract Data Requirement List (CDRL)
3. Attached and Incorporated Technical Proposal
