About this file
This document is a Special Contract Requirements specification for a federal highway construction project at John Heinz Wildlife Refuge at Tinicum (Project PA ERFO FW TCM 2020-1(1)) administered by the Federal Highway Administration's Eastern Federal Lands Highway Division. It amends and supplements the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP-14).
The specification establishes detailed requirements for construction operations, material handling, environmental protections, and project management. Key operational constraints include prohibitions on work Saturdays, Sundays, and national holidays, with no work permitted between April 15 and August 31 without CO approval requested seven days in advance. Construction is limited to daytime operations only with hauling restricted to 40 mph or posted speed limits (25 mph on bridges) with 500-foot minimum spacing between vehicles. The contractor must obtain a Highway Occupancy Permit from PennDOT and dust control permits from the City of Philadelphia Air Management Services. Environmental protections for coastal plain leopard frogs require a qualified biological monitor with a Pennsylvania Scientific Collector's Permit to brief workers, conduct pre-construction searches, install and inspect silt fencing daily, and report all frog sightings to the CO and Pennsylvania Fish and Boat Commission, with immediate work stoppage if frogs are found. Material sampling and testing requirements specify submission of samples to the EFLHD Central Laboratory in Sevierville, Tennessee within 24 hours using specialized chain-of-custody procedures. The contractor must provide facilities and services including a Government field office within 5 miles of the project with specific equipment (laser copier, printer, FAX machine, high-definition monitor), telecommunications (cordless telephone with two lines, 25,000 kbps download/10,000 kbps upload Internet), and sample storage accommodating three-unit-high stacking. Additional requirements address asphalt concrete placement, aggregate specifications allowing PennDOT material standards subject to CO approval, turf establishment using specific wetland and cover crop seed mixes applied by dry methods, stone masonry with salvaged existing stone, and temporary traffic control with chain link fencing and signage compliance subject to $500 daily penalties for non-compliance beyond 24-hour correction periods.

The following Special Contract Requirements amend and supplement the Standard
Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP-14), U. S. Department of Transportation, Federal Highway Administration.
J-2
Section 101. — TERMS, FORMAT, AND DEFINITIONS
101.04. Delete the definitions for "Contract Time", "Drawings", "Notice to Proceed", "Substantial Completion", and "Work", and substitute the following:
Contract Time — The specified time allowed for the completion of the contract work. It may be a set date or a number of days from the Notice to Proceed.
Drawings — Documentation prepared by or for the Contractor consisting of drawings, diagrams, illustrations, schedules, and other data which show the scope, extent, and character of the work.
Notice to Proceed — Written notice to the Contractor that establishes the starting date for performance of the contract. See FAR Clause 52.211-10 Commencement, Prosecution, and
Completion of Work.
Substantial Completion — The point at which the project is complete such that it can be safely and effectively used by the public without further delays, disruption, or other impediments. For conventional bridge and highway work, the point at which bridge deck, parapet, pavement structure, shoulder, drainage, sidewalk, major demolition, roadway obliteration, permanent signing and markings, traffic barrier, safety appurtenance, utility, and lighting work is complete.
The point at which liquidated damages, if any, stop being charged.
Work — The entire completed construction or various separately identifiable parts required to be performed or furnished under the contract. Work includes and is the result of performing or furnishing design professional services and construction required by the contract.
101.04. Add the following:
Completion Date — The date set at the Notice to Proceed by which all contract work is to be complete.
Final Acceptance — The point at which the Government formally accepts the work and relieves the Contractor of further responsibility for the maintenance of the project. This does not include warranties, which remain in effect until they expire. See FAR Clause 52.246-21 Warranty of
Construction.
Final Completion — The point at which all work and tests are complete and all test results have been received. For typical projects, the point at which all punch-list items are acceptably completed and all turf is established. A request for final acceptance of the work cannot be made by the Contractor until this point is reached.
Partial Acceptance — The point on a project where a segment of the work is completed and, at the Government's option, it takes possession for its use. The CO may relieve the Contractor of further responsibility for maintaining partially accepted work.
J-3
Period of Performance — The time from award of the contract to final acceptance of all contract work by the Government.
Quality Control (QC) — A planned system with specific actions by a Contractor to monitor, assess, and adjust processes to minimize variability to ensure that the final product meets the specified level of quality and designed service life. Also called process control.
Validation — The mathematical comparison of two independently obtained sets of data.
Verification — Acceptance testing performed by the Government. Used to determine if the
Contractor's quality control test results can be used by the Government for acceptance decisions.
Section 104. — CONTROL OF WORK
104.03(c). Delete the first sentence of the first paragraph and substitute the following:
Furnish one full-size (22-inch by 34-inch) paper copy of the plans from the Government-provided electronic plans, and use this set of plans exclusively for as-built drawings.

(h) Rain day. A potentially lost workday on which rainfall is equal to or greater than 0.10 inches.
(i) Drying day. A workday immediately following a rainfall equal to or greater than 1.00 inch which is potentially lost because of wet ground conditions.
(j) Workday. A day not excluded from work by Section 108.
(k) Unusually severe weather. When the number of actual workdays lost is greater than the reasonably predictable weather for a specific month.
155.04(f). Add the following:
If a subcontract has not yet been awarded for a certain portion of the work, include the schedule for that work.
155.04. Add the following:
(j) A completed Table 155-1 prepared according to Subsection 155.04A.
Add the following after Subsection 155.04:
155.04A Reasonably Predictable Weather. Determine reasonably predictable weather for this contract by completing Table 155-1. Calculate data for Table 155-1 by computing the average number of workdays lost (rain days plus drying days) for each month and the standard deviation from the average, using the last 10 years of historical weather data from the nearest National
Oceanic and Atmospheric Administration (NOAA) weather data collection station. Add the average number of workdays lost to the standard deviation. The total number of lost days
(average workdays lost plus 1 standard deviation, rounded to whole days) will be considered normal for each month.
At the option of the Contractor, provide the necessary instrumentation to support weather-related impacts to the project if using the nearest weather station is impractical. If onsite weather instrumentation is not provided, use the nearest weather station.
Provide a weekly summary of the weather data gathered to the CO.
155.04B Unusually Severe Weather. If requesting a time extension due to unusually severe weather, calculate the number of actual workdays lost by totaling the actual rain days plus the
J-9 actual drying days occurring in the month in question. From this total, deduct any workdays meeting any one of the following conditions:
(a) The rain day or drying day occurred on a non-work weekday such as a holiday.
(b) The rainfall occurred at a time when no weather dependent work was in progress or occurred during planned or unplanned shutdowns due to other circumstances such as equipment failure, strikes, material supplies, delays, etc.
(c) The Contractor was still working or able to work on weather dependent activities to the extent that less than 50 percent of the workday was lost due to weather.
If the net number of actual workdays lost is greater than the total lost days, then unusually severe weather occurred during the month in question.

(1) For asphalt concrete Type I, cut two 6-inch diameter side by side cores. Obtain cores as soon as the pavement has cooled sufficiently to allow coring, but not later than 12 hours after final rolling. Remove them with a core retriever and fill and compact the core holes with asphalt concrete mixture. Label the cores and protect them from damage due to handling and temperature. Submit one core for verification testing. Dry the other core to constant mass at 125±5 °F or vacuum dry it according to ASTM D7227 before performing the core density and measuring the thickness. Use 62.245 pounds per cubic foot to convert specific gravity to density.
(2) After production paving has begun, use the average maximum specific gravity value (AASHTO T 209) for each day to adjust the percent compaction for the cores that represent that day’s paving.
(3) Do not use the supplemental procedure for mixtures containing porous aggregate (dry back method of AASHTO T 209).

Section 645. — LOCATING UTILIITES
Description
645.01 This work consists of locating and marking existing utilities.
Material
645.02 Replace excavated materials with equivalent materials that meet the applicable requirements of this specification.
Construction Requirements
645.03 General. Contact Pennsylvania One Call at 1-800-242-1776 or 811, or online at https://www.pa1call.org, at least 48 hours before any excavation to have the utilities marked in the field. If Pennsylvania One Call does not perform this service at the project site, contact and ensure that a commercial utility location service marks underground utilities in the field before any excavation begins. Notify the CO 48 hours before any excavation.
https://www.pa1call.org/
J-28
Exercise special care and extreme caution in order to protect and avoid damage to any utility company facilities. Existing utilities have been generally located and shown on the plans as they are believed to exist. The Government assumes no responsibility for the accuracy of locations shown in the plans. Locate and ensure the safety of all existing utilities. Coordinate the repair of damage caused by construction with the utility owners. Pay costs associated with these repairs.
See Subsection 107.02 for additional requirements.
Locate by test pit any utility that may be in conflict with the proposed work. If a conflict appears to exist, then notify the CO in writing immediately and provide information on the location and elevation of the utility so that the CO can adjust the proposed work.
Restore the test pit area to its original condition.
645.04 Locating Utility. Use geophysical prospective techniques, including electromagnetic, sonic, or other energy field devices to establish alignment of utilities where applicable. When necessary, thread a metal rod through non-metallic utility pipes to locate them. Where neither method is feasible, locate the utility by perpendicular trench or test pits.
645.05 Excavation. Excavate carefully to the assume depth using hand tools as needed to avoid disturbing utilities. When excavating within roadway pavements where traffic is being maintained, excavate by air-vacuum methods or equivalent, keeping the area of disturbance to a minimum. Uncover the utility sufficiently to make accurate measurements.
645.06 Record. Describe the utility found (size, material, function), determine the elevation of the top of utility, and prepare a field sketch of the pit. Indicate the date and the station and offset of the utility, noting whether the baseline or the centerline of proposed facility is being referenced. Submit one copy to the CO within 24 hours.
645.07 Marking. Mark the utility location by flags or paint. Maintain the markings, including repainting faded or damaged markings, for the duration of the project, or until the CO determines that the markings are no longer needed.
645.08 Restoration. Backfill using the excavated material or an approved equal. Thoroughly compact backfill material using appropriate compaction methods, approved by the CO. Restore aggregate courses and asphalt concrete pavement using approved materials and thicknesses, and appropriate compaction methods. For Portland cement concrete pavements, use a fast setting concrete.
645.09 Acceptance. Locating utilities will be evaluated under Subsection 106.02.
Measurement and Payment
645.10 Do not measure locating utilities for payment. See Subsection 109.05.
